HomeMy WebLinkAboutResolution 99-113 quit-claiming the town's interest in the town hall property to the MMPCMARANA RESOLUTION NO. 99-113 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE EXECUTION OF A DEED QUIT-CLAIMING THE TOWN'S INTEREST IN THE TOWN HALL PROPERTY TO THE TOWN OF MARANA MUNICIPAL PROPERTY CORPORATION. WHEREAS, the Town of Marana Municipal Property Corporation, an Arizona nonprofit corporation (the "MMPC"), was formed to transact any or all lawful business for which a nonprofit corporation may be incorporated under the laws of the State of Arizona, including without limiting the generality of the foregoing, any civic or charitable purpose such as financing the cost of acquiring real property suitable for use by, and for leasing to, the Town of Marana; and WHEREAS, the MMPC did finance and acquire real property, legally described as set forth on Exhibit A attached hereto and incorporated herein by this reference (the "Town Hall Property"), for the purpose of leasing the Town Hall Property to the Town of Marana for use by the Town as a town hall complex site; and WHEREAS, the Town Hall Property was mistakenly titled in the name of the Town of Marana; and WHEREAS, the Mayor and Town Council of the Town of Marana desire to correct that mistake and find that correcting that mistake will benefit the residents of the Town of Marana and will be in the Town's best interest; and WHEREAS, town staff has prepared a Quit-Claim deed by which the Town can quit-claim the Town Hall Property to the MMPC to correct the mistake; and WHEREAS, town staff has prepared a lease agreement by which the Town can lease the Town Hall Property from the MMPC. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, that the Mayor and Town Clerk are authorized to execute a deed quit-claiming the Town Hall Property, as legally described on Exhibit A, to the MMPC, and town officers and staff are authorized to execute any other documents and take any other steps necessary and proper to effectuate its purpose.
