A RESOLUTION OF THE TOWN COUNCIL OF TI-IE TOWN OF MARANA, ARIZONA, AUTHORIZING, WITH CONDITIONS, AN EXTENSION OF A 208 PLAN FOR A WASTEWATER TREATMENT FACILITY ('MSP 208 PLAN") FOR MARK PALKOWITSH OF MSP PROPERTIES, EXTENDING THE MSP 208 PLAN FOR MSP PROPERTIES FOR AN ADDITIONAL MAXIMUM THREE (3) YEAR PERIOD. WHEREAS, Mark Palkowitsh is the owner of MSP Properties and currently holds a 208 Plan for the construction of a wastewater treatment facility, said Plan due to expire on June 26, 1997; and WHEREAS, an extension of the MSP Plan will allow time to determine if a wastewater treatment facility on the property is a viable option; and WHEREAS, it is in the best interest of the citizens of the Town of Mararia that an extension of three (3) years be granted. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Mamaa, Arizona that Mark Palkowitsh is granted a three O) year extension of the MSP 208 Plan for a wastewater treatment facility, subject to following conditions: Should the results of a study of the Marsha Areawide 208 Plan indicate that the vicinity of MSP Properties is not a viable location for interim and/or permanent wastewater treatment facilities, the MSP Properties 208 Plan will be extinguished as of the date the Mararia Areawide 208 Plan is approved by the Pima County Association of Governments ('PAG'). If the Mararia Areawide 208 Plan has not yet been adopted by PAG as of June 26, 1998, the MSP Properties 208 Plan Amendment will be extended until June 26, 1999, subject to condition 1 above. If PAG still has not adopted the Marsha Areawide Plan by this date, further consideration will be granted by the Regional Council for an additional time extension. o Should the results of the Marana Areawide 208 Plan indicate that the vicinity of MSP Properties is a viable location for interim and/or permanent wastewater treatment facilities, MSP Properties will have until two (2) years after the completion and acceptance by PAG of the Marsha Areawide 208 Plan to have their treatment plant designed, permitted, operational, and accepted by Pima County Wastewater Management Department, under the following conditions: a) b) Recordation of the first phase Final Plat (and overall Block Plat if applicable); Approval of a sewer service agreement by Pima County Wastewater and the Town of Mararia; Maran~, Arizona Resolution No. 97-67 Page 1 of~, c) Approval of a watex service agreement by the area provider and the Town of Marana, if different; Approval of an aquifer protection permit, if applicable; Approval of effluent reuse agreements, if applicable; and Approval of Infrastructure improvement plans for the first phase.
