Hein, Town Manager SUBJECT Ordinance No. 98.14, amending Chapter 10 (Health and Sanitation) ofthe Town Code to add criminal sanctions to those penalties which already exist for a violation of Sections 10-2-2 and 10-2-3, which prohibit dumping within the town limits. DISCUSSION: Ordinance No. 98.14 makes certain changes to the Town Code concerning dumping and littering within Town limits. The effect of this Ordinance will be that the Town will be able to criminally prosecute persons who dump trash or litter either in public places or on private premises. This Ordinance will permit the placing of signs within the Town prohibiting such dumping or littering. Such signs would directly cite the applicable Town Code provision. By adding the potential for criminal prosecution to the civil sanctions available for littering and dumping, the Town would have greater discretion as to the punishment sought for violators depending upon the severity of the dumping or littering. This Ordinance classifies dumping or littering as a class 2 misdemeanor, the potential penalties for which are four months injail, $750 fine, and/or two years probation. RECOMMENDATION: Staffrecommends that Ordinance 98.14 be adopted. SUGGESTED MOTION: I move the adoption of Ordinance No. 98.14 amending Chapter 10 (Health and Sanitation) of the Marana Town Code.
