HomeMy WebLinkAboutTown Code Chapter 07-2002 CHAPTER 7 BUILDING Article 7-1 BUILDING CODES Section 7-1-1 Purpose A. The Marana building code shall have the folbwing purposes: 1. Regulate the site preparation and construction, alteration, moving, demolition, repair, use and occupancy of buildings, structures and building service equipment within the jurisdiction; 2. Provide for the issuance of permits and collection of fees; 3. Provide for a building codes advisory board; 4. Provide for penalties for the violation of building codes. Section 7-1-2 Building Codes Adopted A. The Marana Building Code, codified in this chapter, adopts by reference the 2000 International Building Code asamended, of the InternationalCode Council, together with the following code documents: 1. The 1997 Uniform Administrative Code, with amendments; 2. The 1994 Uniform Plumbing Code, with amendments; 3. The 2000 International Residential Code, with amendments; 4. The 2000 International Mechanical Code, with amendments; 5. The 2000 International Property Maintenance Code, with amendments; 6. The 1999 National Electric Code, with amendments; 7. The 1997 Uniform Fire Code, with amendments; 8. The April 2000 Building Valuation Data as compiled and published by the International Conference of Building Officials as the basis for the permit fee schedule. B. The Marana Building Code adopts by reference the following local ordinances and codes by reference: 1. 1996 Spa/Pool Code; Marana Town Code MARANA TOWN CODE 7-1 rev. 2002 2. 1996 Outdoor Lighting Code. No. 2001.04] Section 7-1-3 Copies on file Three copies of the Marana building code are on file in the office of the clerk of the town of Marana and available for public inspection during regular working hours. Section 7-1.4 Building official designated The building official, or his or her duly authorized representative, is the authority charged with the administration and enforcement of the Marana building code. The building official may appoint a chief plans examiner, a chief building inspector, a chief electrical inspector, a chief mechanical inspector, a chief plumbing inspector, and other related technical officers and inspectors and other employees as shall be authorized from time to time. Section 7-1-5 Violation a civil infraction It shall be a civil infraction for any person, firm or corporation to violate any of the provisions of this chapter. Civil infractions shall be enforced through the hearing officer procedure provided by A.R.S. § 9-462.08. Penalties for civil infractions shall not exceed the amount of the maximum fine for a class 2 misdemeanor. Each day a violation continues shall be considered a separate offense. Section 7-1-6 Administrative appeal process A. Whenever a violation of this building code is determined, whether during construction or at the plan review stage, and the applicant wishes to appeal the decision of the staff because of code interpretation, unreasonable hardship or other acceptable reasons, the applicant may appeal to the building official's hearhg committee as follows: 1. The applicant shall file a written appeal on the forms provided by the buiEling official, on or before Friday of the week of the violation, no later than four-thirty p.m. 2. The appeal will be heard by the hearing committee within seven days, at a specified time. 3. The hearing committee shall consist of the building official, an inspection supervisor, and the appropriate plans examiner. At the discretion of the building official, additional inspectors or other technical persons may be added for a particular appeal. 4. Adequate information shall be provided by the applicant in order to fully describe the conditions in question. 5. The applicant may, but is no~ required to, personally attend the hearing committee meeting. Marana Town Code MARANA TOWN CODE 7-2 rev. 2002 6. If an appeal is denied by the hearing committee, the applicant shall either comply with the decision or appeal to the advisory board of the town. Article 7-2 BUILDING PERMITS Section 7-2-1 Application requirements A. Any person, partnership, firm orcorporation desiring toconstruct, erect or move any residential building or mobile home or associated outbuilding where such building or mobile home contains morethan one hundred twenty square feet and unattached to any structure, or desiring to enlarge or substantially modify any residential building or mobile home where such work will involve an area of more than one hundred twenty square feet and unattached to any structure, shall first make application for a building permit to the building department and shall not commence any such construction without first obtaining a building permit from the town. B. Any person, firm or corporation desiring to construct any additions to an existing structure regardless of the size of the addition or structure shail first make application to the building department for a building permit and shall not undertake any such construction, enlargement or movement without first obtaining a building permit from the town. C. Any person, firm or corporation desiring to erect, construct, enlarge, move or substantially modify any commercial, industrial, quasi-public or public building or structure shall first make application to the building department for a separate building permit for each such building or structure and shall not undertake any such construction, enlargement or movement without firstobtaining a building permit from the town. D. All applications for a building permit shall be accompanied by plans which have been drawn to scale and which show the actual dimensions of the lot to be built upon, the size and location of existing buiUings, if any, the building to be erected, enlarged, modified or moved, the location and layout of said structures with respect to front, rear and side property lines, and the location and layout of proposed off-street parking areas. 1. Plans submitted for new construction or enlargement shall provide sufficient details of proposed structural features, and electrical, plumbing, and mechanical installations for review by the town plans examiner to permit evaluation of their adequacy by the town building inspector. E. The term, "substantially modify" means the installation or removal of any interior or exterior wall or the addition or replacement of an amount of electrical wiring or plumbing equal to twenty-five percent or more of such installation in the modified building or structure. F. When a building permit is issued for a structure on a lot that is not on a dedicated street or which is not served by a sewer system operated by Pima County or the town, a statement to that effect will be placed on the building permit before issuance. Marana Town Code MARANA TOWN CODE 7-3 rev. 2002 Article 7-3 FEES Section 7-3-1 Base fees The base fee for a building permit shall be the square footage of the building times the applicable rate according to building use and construction type as listed in Table 7-1. Section 7-3-2 Other inspections and fees A. The fee for other inspecticns and fees shall be: 1. Inspections outside normal business hours (2 hour minimum) ................................... $30.00/hr 2. All other buildings ................ 65% of building permit fee Article 7-4 FIBER OPTICS CODE Section 7.4-1 Purpose The purpose of lhe code is to provide minimum requirements and standards for the protection of the public health, safety and welfare as they apply to the installation, alteration, addition, repair, relocation, replacement, or maintenance of fiber optic cables and lines. Marana Town Code MARANA TOWN CODE 7-4 rev. 2002 Section 7-4-2 Permit required A. All installations of fiber optic cables or lines, whether in new conduit installations or existing conduit installations, shall require a permit. B. All applications for a permit shall be accompanied by plans which clearly delineate that fiber optic cables or lines are to be installed and the location of the fiber optic cables or lines. Any of the foregoing plans prepared shall include a special warning of sufficient size and placed on the plans in such a way that contractors will be aware of the presence and existence of fiber optic cables or lines. C. Whenever the town, private consultants or entities or other agencies request any information on existing utilities to be used in the preparation of improvement or development of other plans, existing fiber optic cables or lines shall be clearly indicated on information furnished by the applicable utility company. Section 7-4-3 Installation requirements A. Fiber optic cables or lines installed within the municipal limits of the town shall not be installed as a direct bury cable and shall meet the following requirements: 1. All fiber optic cables or lines shall be installed within a conduit of at least one inch PVC or other approved material. At the time of initial installation, one extra conduit of at least one inch PVC or other approved material for future expansion shall also be installed. 2. New conduit installations designated for fiber optic cables or lines shall be encased in a minimum of six inches of concrete on all sides of the conduit or conduits. New installations shall have a minimum of four feet of cover on the top of the concrete encasement. A magnetic warning tape or some comparable locating system shall be placed two feet above the encasement, which shall include a written message indicatingthe presence of fiber optics in the conduit system below. These requirements shall apply to all future conduit systems installed, even if they are initially intended tocarry standard copper wire cables. B. In the event that fiber optic cables or lines are to be installed in existing conduit systems, the installation thereof shall comply with the specifications outlined in subsection A of this section. Section 7-4-4 Recordation of location A. Any fiber optic cables or lines installed within the town shall be located in the fie~d, during construction, as part of the "blue stake" program. B. Any locations marked on the ground surface shall include special notations that will adequately indicate the existence of fiber optic cables or lines to the contractor. The requirement for installing one extra conduit for future expansion as set forth in section 7-4-3(A)(2) of this section, and ~he encasement requirements as set forth in section 7-4-3(A)(2) may be waived by the chief building official fer installation of fiber optic cables and lines in those areas where future construction is neither contemplated nor foreseen as indicated on the town's general plan or on any proposed or adopted master plans or specific plans. B. The issuance of a waiver or the failure to issue a waiver by the chief building official may be appealed pursuant to the provisions of this code. Section 7-4-6 Installation in right-of-ways Any installation of fiber optic cables in the town right-of-ways shall meet the above requirements and, prior to installation, plans and specifications shall be submitted to the town engineer for approval. Article 7-5 ADDITIONAL BUILDING REQUIREMENTS Section 7-5-1 Location of gasoline pumps GasoPine pump islands and similar facilities for the dispensing of flammabre materials, including diesel fuel, propane, and butane, shall be set back not Jess than eighteen feet from any street right-of-way line to which the pump island is perpendicular and not less than twelve feet from any street right-of-way line to which the pump isPand is parallel, and not less than twelve feet from the property line of any residential lot. If the pump island is set at an angle on its lot, it shall be so located that motor vehicPes stopped for service shall not extend over the property line of the lot. In no case shall pumps be set closer than twelve feet to any side or rear Pot line. Lots from which gasoline or similar flammable fluids are dispensed to customers at retail or wholesale shall be not less than seventy-five feet in width nor less than one hundred feet in length. APl approaches to gasoline pumps or similar facilities shall be paved to a distance of no less than eighteen feet from the pumps or to the nearest property line, whichever distance is smaPler. Section 7-5-2 Waste disposal Sewerage systems and/or septic tank systems sh~l be constructed in accordance with the standards of the Arizona Department of HeaPth Services and the Pima County Health Department, with compliance with such standards to be certified by the appropriate state or county agency or the town engineer.
