APPROVAL OF AGENDA Upon motion by Council Member Escobedo, seconded by Council Member Blake, approval of the agenda as written was unanimous. VI. STAFF REPORTS There were no questions regarding staff reports. VIII. GENERAL ORDER OF BUSINESS A. CONSENT AGENDA Resolution No. 2002-01: Releasing the Assurance Agreement for Continental Ranch Parcel 4, Trust No. 624, for Lots 1 thru 145 and Common Areas Al, A2, BI and B2 and Acceptance of Public Improvements for Maintenance (Farhad Moghimi) w Resolution No. 2002-0?- Releasing the Assurance Agreement for Continental Ranch Parcel 9, Trust No. 623, for Lots 3-13, 15-31, 80-122, 130-144, 187-189 & 105-237 and Acceptance of Public Improvements for Maintenance (Farhad Moghimi) 3. Resolution No. 2002-05: Acquisition Agreement to purchase a 2.5 acre parcel in Berry Acres (Dan Groseclose) Resolution No. 2002-04: Contract Between the Town of Marana and Silverbell 290 Limited Partnership for Construction of Water Facilities Under Private Contract (Brad DeSpain) Resolution No. 2002-03: Agreement Between the Town of Marana and New World Homes for Construction of Water Facilities and Provision of' Water Utility Service (Brad DeSpain) Upon motion by Council Member McGorray, seconded by Council Member Blake, Consent Agenda Items 1, 2, 4, and 5 were unanimously approved. Council Member Escobedo filed a Statement of Agenda Conflict in reference to Consent Agenda Item 3, Resolution No. 2002-05, and did not participate in the Council vote on that item. The Statement of Agenda Conflict has been made a permanent part of this record. By motion of Council Member Blake and a second by Council Member Honea, Consent Agenda Item 3, Resolution No. 2002-05, was approved 6- 0, with one abstention by Council Member Escobedo. 2 MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN HALL JANUARY 2, 2002 B. COUNCIL ACTION 1. P_Presentation/Discussion: Traffic controls on Cortaro Road during construction improvements (Jim DeGrood) Mr. DeGrood presented an overview of the construction to date, making specific reference to mitigating traffic congestion by implementing the following measures: Split phasing at the Cortaro and Silverbell intersection. By adjusting green time, this allows for extra right turn movement off of Cortaro onto Silverbell. The contractor is scheduled to start construction and installation of temporary traffic signal at Ina and Silverbell. Estimated completion is within 60 days of Notice to Proceed, which should be issued by the third week of January. Mr. Moghimi addressed several questions raised by citizens. With respect to restoration of second lane on northbound Silverbell at Cortaro intersection during evening rush hour and restoration of a second Cortaro right turn lane onto Silverbell north during evening rush hour be accelerated, Mr. Moghimi responded that he felt there should be right turn shift phasing of all construction at the intersection of Silverbell and Cortaro. However, at this time, staff is working with the contractor to determine the impact of the phasing shift affecting the schedule and any additional costs associated with that. Regarding the possibility of eliminating all future morning and evening rush hour lane closures unless an alternate lane for the closed lane is made available, Mr. Moghimi responded that our traffic control plan does not impact the capacity of the existing lane order and that we will maintain two lanes at all times. Mr. Moghimi further explained with respect to these issues, the Town staff is working with ADOT to implement a detour plan, which would mitigate for traffic construction on Cortaro Road. He then explained all the details of the traffic control plan. MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN HALL JANUARY 2, 2002 Mayor Sutton inquired as to how soon the plan could be implemented. Mr. Moghimi stated that Town staff and ADOT need to finalize the plan, submit it for review and approval and then coordinate with the contractor to implement it by the end of January. Vice Mayor Kal asked whether the contractors had informed the businesses affected of the plan. Mr. Moghimi replied that since the start of the construction, staff and others had formed a traffic systems management committee consisting of representations of businesses in the area, as well as the fire district, police department, neighborhood associations and representatives from the school district and the media. During the last scheduled meeting, a detour plan was presented to the committee and they appeared to be very supportive of the plan. In addition to that, we have implemented a plan to coordinate with all of the business and media to ensure that the public is well irrformed about the plan. Council Members Blake and Escobedo talked about some problems they had heard of or experienced regarding off ramps and merging traffic from one to two lanes. Their concern was primarily that discourteous drivers would be competing for the merged lane by speeding and causing possible danger and creating safety issues for other drivers. Mr. Moghimi responded that the detour plan would provide opportunity for the merge lane to shift further west on Cortaro Road, and that would give additional capacity to allow for the merging. He indicated that he hoped drivers would be more cautious and courteous during this construction to minimize the difficulties created by merging. Mayor Sutton asked about the detour plan jogging 45 degrees to get to new lanes. Mr. Moghimi responded that the plan will be designed and field verified to detour based on the speed limits within the construction zone. Mayor and Council direction to staff was to obtain clear timeframes for construction phasing to minimize the impact of construction costs for any future traffic change. Specifically, their concerns were about the engineer's change of traffic control. Mayor Sutton encouraged staff not to approve any change unless there was significant support and justification for the change. 4 MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN HALL JANUARY 2, 2002 PUBLIC HEARING on the Large State Land Annexatio,.~ Consideration of the Town of Marana's desire to annex approximately 21,500 acres located in all or portions of 46 sections of land in Township 11 South, Ranges 11 and 12 East. This annexation includes the bulk of the State land north of Tangerine Road and south of the Pinal County border (Dick Gear) Motion was made to go into Public Hearing by Council Member Jim Blake, seconded by Council Member Escobedo. The motion passed unanimously. Jenny Neeley, 302 S. Convent Avenue, Tucson 85701, representing Defenders of Wildlife, addressed the Council regarding concerns that despite any language in the agreement with State Land, Marana would be able to develop this property at about 1 house per acre. Mr. Hein addressed Ms. Neeley's concern, and noted that he had met with another representative from Defender's of Wildlife, who apparently is Ms. Neeley's employer. She agreed, after listening to Mr. Hein describe the conditions under which the state land would be annexed, that perhaps she had received erroneous information regarding the ability to develop the land within the proposed annexation. Mr. Hein described the potential uses of the state land once it is inside Marana's boundaries. Primarily, it will be used to mitigate developable property within the designated CFPO, as a set aside for open space, and nature trails in conjunction with Pima County's Trail System. Next, Mr. Hector Conde, 14040 N. Lobelia, Oro Valley, addressed the Council regarding aquifers and water usage, expressing his concern that the Council keep in mind that water tables drop considerably each year, and that to maintain Marana as a sustainable community, its leaders must work hard to plan for a reliable source of water. Mayor Sutton thanked Mr. Conde for his presentation, and suggested that he might want to confer with Brad DeSpain, the Town's Utility Director, and perhaps the most knowledgeable person in Southern Arizona regarding water issues. There being no further discussion on this item, Council Member Blake moved to come out of Public Hearing, which was seconded by Council Member McGorray and passed unanimously. 5 XI. MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN HALL JANUARY 2, 2002 C. MAYOR AND COUNCIL'S REPORT Council Member Escobedo reported on the Miracle on 34th Street event held December 24, 2001 in front of the Marana High School on Emigh Road. Mayor Sutton reported that he would be out of town on business on January 2th and that Vice Mayor Kai would be chairing that Council Meeting. D. MANAGERS' REPORT There were no reports at this time. FUTURE AGENDA ITEMS There were no topics suggested for future agenda items at this time. ADJOURNMENT Upon motion by Council Member Escobedo and seconded by Mayor Sutton, unanimous approval to adjourn was given.
