PLEDGE OF ALLEGIANCE Led by Mayor Sutton III. INVOCATION[MOMENT OF SILENCE Mayor Sutton asked that a moment of silence be observed for the victims of the shooting at Santana High School in San Diego County. He also asked that the audience remember to cherish the community we live in and to help guide our children to become good citizens. IV. V. APPROVAL OF AGENDA Upon motion by Council Member Harn, seconded by Council Member Blake, the agenda was unanimously approved. VI. ACCEPTANCE OF MINUTES Minutes of Regular Meeting - February 20, 2001 Upon motion by Council Member Kai, and seconded by Council Member Honea, the minutes of the regular Council meeting held on February 20, 2001 were unanimously approved. VII. CALL TO THE PUBLIC/ANNOUNCEMENTS Nicole Pesina addressed the Council. She is looking for sponsors to help her with her campaign to become Miss Teen Arizona. The Mayor asked her to complete the standard funding request for financial aid from the Youth Assistance Fund. VIII. STAFF REPORTS There were no questions regarding the staff reports. IX. GENERAL ORDER OF BUSINESS A. CONSENT AGENDA - There were no items on the Consent Agenda. B. COUNCIL ACTION 1. Report from the Marana Chamber of Commerce on the upcoming Founders' Day celebration (Kelle Maslyn) Kelle Maslyn gave an update on Founders' Day regarding advertising, media representation, and the specific events that will be part of this year's festivities. She stated that events such as the car show and the nm/walk scheduled for Sunday are being repeated again due to their popularity last year. She also stated that the Marana Arts Council is providing a special addition to Founders' Day - The Colors of Marana, with many events being held on Saturday throughout the day. Kelle introduced Steve Vasquez, a member of the Marana Arts Council to speak more about the Colors of Marana. Steve stated that all time slots are filled with events during the Saturday portion of Founders' Day. There will be music from 11 a.m. to 5 p.m. Eleven booths will be set up displaying Native American paintings, watercolor, jewelry and other art forms as well as live demonstrations. There will be special entertainment at the Senior Center including a quartet and a storyteller. Council Member Ham reminded everyone of the Mayor's Breakfast Saturday morning before the parade. This will be held at the Senior Center. 2. Public Hearing - Alternative Expenditure Limitation (Home Rule Option) (Roy Cuaron) Council Member Blake made a motion to go into public hearing, which was seconded by Council Member Ham. Mr. Cuaron informed the Council that this was the first of two public hearings required prior to placing this item on the ballot for the May 15, 2001 General Election. The second hearing will be March 20, and after that hearing, the Council will be asked for their approval of a resolution to place this item before the voters on May 15, 2001. Mr. Cuaron then gave some background information as to how the Home Rule Option came into being. It was basically an outgrowth of Proposition 13 in California in the late 1970s due to voter concerns about increasing property taxes. Once the voters pass the expenditure limitation, it is in effect for four years, at which time the issue must again be placed before the voters. Mr. Cuaron referred to the table at the bottom of the Council information page that shows expenditures and revenues since FY 97-98. While the Town would have been able to collect revenues in the amounts shown, it would not have been able to spend revenues above the state limitation without voter approval. Many services to Marana citizens would have been stopped or severely curtailed without the ability to spend the revenues over the state limit. Mr. Cuaron further explained how the limit is set and how it is adjusted. Using FY 79-80 as the base year, the state provides the limits to jurisdictions accounting for inflation and population growth. Mr. Cuaron said that it was important to note that at that time, the Town was not providing airport services, water, parks and recreation maintenance and road construction. Now that the town has expanded its services, it is even more important to get the ballot measure passed. Mr..Hein stated that it is important to note that the base year was a snapshot and then every year the inflation factor is added. In a sales tax based community, we are still going to collect the revenues and we are still going to spend the revenues. Services would be cut even if the revenues still come in - but the capacity to use those revenues is greatly reduced without the passage of the home role option. Mayor Sutton mentioned how important it was to provide these services. Mr. Hein stated that although we are currently spending in excess of $18 million on services, the town is spending less than it receives in revenues. The Town has taken a fairly conservative approach and noted that the A bond rating last year proves this. Council Member Ham asked how the staff is educating the public on these issues besides holding public hearings. 3 Mr. Hein stated that this is actually the first hearing and that he and Mr. Cuaron will begin making the breakfast circuit in addition to the media coverage that will be occurring between now and the May 15th General Election. 3. Consideration for a mid-year staffing adjustment for Police Department (Dave Smith) Chief Smith introduced his command staff of Lts. Joe Carrasco, Brace Thomas and Dale Bradshaw. He indicated their specific assignments and then proceeded to explain the positions he was requesting to be added. They are a crime scene evidence technician and a records clerk. As the Crime Scene specialist, Mike McLanghlin, is on call 24/7, the evidence technician would be able to assist Mike in that regard and help log in evidence. The Records Clerk position would be assigned to help bring the records up to date, as the volume of work has increased to such an extent that the depaxhnent is six months behind in reports and 3 months behind in citations. Chief Smith also noted that there is money in his depaxh~ent budget for the mid-year increase m staff. Council Mcunber Hart made a motion that Council authorize the Police Department to employ a crime scene technician and a records clerk. The motion was seconded by Council Member Blake and unanimously approved. 4. Resolution No. 2001-24. Substitution of Assurance: Irrevocable Standby Letter of Credit for Canyon Pass at Dove Mountain Phase III-A, Lots 111-150 & 178-181 (Farhad Moghimi) Mr. DeGrood addressed this item with a brief update to Council and stated that it is mostly administrative in nature. Council Member Honea made a motion to approve Resolution No. 2001- 24, and it was seconded by Council Member Kal. The motion passed unanimously. $. Legislative Update (Mike Hein) Mayor Sutton asked Mr. Hein to report on the letter he had received from Dave Harlow at Fish and Wildiife regarding the eminent domain issue that is of great interest to Marana. Mr. Harlow explained how mitigation of this issue would unfold. Mr. Hein said that the bill had received diverse support throughout the community but that there is little activity at the present time. C. Mayor and Council's Report There were no reports from the Council. D. Managers' Reports There were no reports from the Managers. E. FUTURE AGENDA ITEMS There were no items for consideration at this time. F. ADJOURNMENT Upon motion by Council M~mber Blake and seconded by Council Member Honea, the Council voted unanimously to adjourn the meeting at 7:30 p.m. CERTIFICATION I hereby certify that the foregoing are the true and correct minutes of the Marana Town Council meeting held on March 6, 2001.
