V. APPROVAL OF AGENDA
Upon motion by Council Member Blake, seconded by Council Member Honea,
the agenda was unanimously approved as amended, with the change being to
continue items IX. B. 3 and 4 under Council Action.

Upon motion by Council Member Honea, and seconded by Council Member
Blake, the minutes of the regular Council meeting of April 3, 2001, and the
minutes of the study sessions on March 27, 2001 and March 29, 2001 and April 3,
2001 were approved.

There were no requests from the public to speak.

There were no questions regarding the staff reports.
IX. GENERAL ORDER OF BUSINESS
A. CONSENT AGENDA
1. Resolution No. 2001-43: Intergovernmental Agreement between Pima
County and the Town of Marana Police Department, a member agency
of the High Intensity Drug Trafficking Area (H.I.D.T.A.) Program Drug
Grant Agreement (Dave Smith)
2. Resolution No. 2001-45: Appointment to the Town of Marana Business
Advisory Committee (BAC) (Roy Cuaron)
3. Child Abuse Prevention Proclamation (Mayor Sutton)

4. Community Development Block Grant Proclamation (Mike Reuwsaat)
The Consent Agenda was unanimously approved upon motion by Council
Member Blake and seconded by Council Member McGorray.
B. COUNCIL ACTION
1. Financial Assistance for Marana-Based Schools (Roy Cuaron~
Per Mr. Hein, this item was continued from a previous meeting and is an
equity issue dealing with residual funds. Mr. Hein stated that Hendricks
Elementary School would receive $1,500 and that the Superintendent for
the Marana Unified School District, Dr. Wade McLean, would receive
$1,500 on behalf of MUSD for disbursement to various schools within the
town limits. School funding will be addressed as a line item in Council's
budget for the upcoming fiscal year.
Upon motion by Council Member Honea, seconded by Council Member
Blake, the Council unanimously approved the funding of $1,500 to
°~° Hendricks Elementary School for art supplies and $1,500 to MUSD for
disbursement to various schools within the town limits.
2. Ordinance No. 2001.07 -amending Chapter 12 ("Traffic") of the Marana
Town Code, regulating the stopping of vehicles at railroad crossings,
and imposing criminal penalties (Dan Hochuli)
Mayor Sutton expressed his concern regarding people stopping on
railroad tracks and how, in addition to imposing higher fines on those
who do, the Town needs to help educate citizens about how to prevent
stopping on railroad tracks and to avoid accidents.
Mr. Hein responded that a number of interventions were being
established, including additional signage at both Ina and Cortaro Roads,
assistance from Union Pacific with this hazardous situation, and
additional police presence in the areas of concern. He noted that this
ordinance did not enact new law but that it merely created stiffer penalties
for infractions.

Council Member Honea noted that he had received a complaint from a
citizen who related that the signal light was too close to the tracks and
created problems for motorists attempting to stop soon enough. He
further stated that the intersection's heavy volume of traffic added to the
difficulty in stopping appropriately. The Mayor responded that while this
was a concern, the objective of this ordinance was not to punish people
unnecessarily but to raise public awareness of the problem through the
media and other efforts.
Upon motion by Council Member Blake, and seconded by Council
Member McGorray, Ordinance No. 2001.07 was unanimously approved.
5. Legislative Update (Mike Hein)
Mr. Hein briefly noted that most of the legislative focus was on the
budget, but that Mr. Racy was also watching legislation potentially
affecting the Town, including a measure allowing jurisdictions to acquire
state land through assumption of a default lease. He added that other
legislation of interest to Marana included the issue of the State imposing
~° its will over local municipalities and counties that may wish to enter into
federal agreements, and legislation relating to retirement plans for law
enforcement.
C. MAYOR AND COUNCIL'S REPORT
Council Member McGorray reported that she had firsthand experience with
being stopped on the Ina Road railroad tracks because of another motorist's
unpredicted stop. She noted that the situation was frightening. She concluded
by voicing her pleasure in helping to pass an ordinance that would promote
public awareness of this hazard.
D. MANAGERS' REPORT
The managers had no report.

XI. ADJOURNMENT
Upon motion by Council Member Honea and seconded by Council Member
Blake, the Council voted unanimously to adjourn the meeting at 7:16 p.m.
