IV. APPROVAL OF AGENDA Upon motion by Council Member Ziegler, seconded by Council Member Blake, the agenda was unanimously approved. CALL TO THE PUBLIC/ANNOUNCEMENTS Ms. Entz announced the hiring of a new employee in her department. Lori Mendibles will be working at the front reception area and would be present at the October 17, 2000 meeting for a formal introduction to the Council. MINUTES OF SPECIAL CoUNciL MEETING ~ MARANA TOWN HALL SEPTEMBER 26, 2000 .. VI. GENERAL ORDER OF BUSINESS A. COUNCIL ACTION 1. Resolution No. 2000-107 - Consideration of request from the area known as the Village of Casas Adobes to incorporate (Mike Hein) Mr. Hein explained that several conditions previously set by the City of Tucson, the Town of Oro Valley and the Town of Marana were not adhered to by Casas Adobes and, as a result, had voided their second incorporation attempt. He stated that the Ca. sas Adobes Incorporation Committee had requested a new resolution of consent by the Town of Marana, notwithstanding the earlier appeal. Scott Nelson, representing Casas Adobes, spoke before the Council and thanked the Town for its support. He reported that half of the required 2,400 signatures had been collected and that he felt confident that the necessary number would be reached by the November 13, 2000 deadline. He reported that an election regarding the incorporation issue was tentatively scheduled for March 2001. Upon motion by Council Member Honea, seconded by Council Member Kal, Resolution No. 2000-107 was approved by a 4 to 1 vote. The dissenting vote was made by Council Member Ziegler. Council Member Ziegler read a statement into the record explaining her dissenting vote. This statement is a permanent part of the record. She said that two individuals from the Casas Adobes Incorporation Committee had appealed an earlier ruling made regarding the 1961 incorporation law. This objection was in direct violation of a specific condition placed in resolutions of approval by Tucson, Oro Valley and Marana. Council Member Ziegler stated that this act had violated the agreements with these three surrounding murdcipalities and signaled that the Committee would seek a legal decision to incorporation if the election was lost through its own residents' dissent. She continued by stating that she believed this type of legal action would be in direct conflict with the "will of the people' i/an election returned a negative response for incorporation. Mayor Sutton stated that the purpose of the Council's approval vote was as a show of regional cooperation not only for Casas Adobes but also in support of the Town's relationship with Tucson and Oro Valley. He said that he had been troubled by the appeal also but that he approved of the methods being taken to acquire the necessary signatures and to hold an election for community approval of the incorporation process. He ended his comments by wishing Casas Adobes success in their efforts. MINUTES OF SPECIAL COUNCIL MEETING MARANA TOWN HALL SEPTEMBER 26, 2000 Council Member Blake stated that he too had come close to voting against the approval but had not. He said that he voted yes in a show of support for Marana not for Casas Adobes. He wished them success in their incorporation efforts but hoped that this success would come through the ballot box and not through the court system. 2. Resolution No. 2000-108 - consideration of request from the area known as the Town of Tortolita to incorporate (Mike Hein) Mr. t-lein said that pending litigation against Marana by Tortolita, the fact that they already consider themselves a town, and multiple conditions were among various issues of consideration for the Council before granting incorporation approval to Tortolita. He said that Tortolita had not answered a letter containing questions regarding these points. He concluded by saying that Marana had not had the opportunity to consult with Oro Valley on this matter. Upon motion by Council Member Ziegler, seconded by Council Member Blake, a continuance for the approval of Resolution No. 2000-108 was unanimously approved. XI. ADJOURNMENT Upon motion by Council Member Blake, seconded by Council Member Honea, adjournment was unanimously approved.
