APPROVAL OFAGENDA

ACCEPTANCE OFMINUTES
A motion was made by Herb Kai, seconded by Roxanne Ziegler, to
accept the Minutes of Regular Council Meeting of September 1, 1998.

vii. CALL TO THE PUBLIC/ANNOUNCEMENTS
Mayor Harn introduced and thanked Las Artes and the students for the
work they performed on the Mosaic sign in front of Town Hall. They did an
outstanding job and the Town is very proud to display their work. Mayor
Harn also recognized Sally Jackson and her group of youth for their art
expertise on the Park Buildings, stating that the murals are a wonderful
addition to the improvements to the Marana Park.
Brad DeSpain introduced Dr. Cluff, a representative from Slow Sand
Nano Filtration Pilot Project, was in attendance and encouraged everyone
to sample a bottle of processed water.
Dr. Cluff stated that the project was going exceedingly well. Water
is taken directly from Central Arizona Project Canal (CAP) without any
chemical additive.
Mike Hein stated Slow Sand Nano Filtration Pilot Project technology is
employed in other parts of the world and may have other applications in
water and wastewater. Staff is very excited about working with Dr. Cluff
and this project. This could be a real viable alternative in the future.
Herb Kal inquired if there were a lot of waste products abstracted from the
water.
Dr. Cluff stated that they were getting about half the waste that the City of
Tucson gets through their process, of which there are about 12% rejects in
Tucson and 6% percent rejects in Marana.
Mike Hein announced if anyone had any questions that they could contact
Brad DeSpain with the Water Department for more information.
Ed Honea announced that Wednesday, September 16, 1998, will be the
Chamber luncheon and the speaker will be Vice Mayor Sutton.
Mayor Harn announced there would be a Prayer Around the Flag Poll on
September 16th, at Marana Junior High and Marana Senior High at 7:00
a.m.

A. Consent Agenda
Resolution No. 98.74 - Continental Ranch Parcel 23 Release

2. Adoption of Resolution No. 98~No. 98-94 - Intergovernmental
Agreement (ICA) with City of Tucson for Traffic Signal
Coordination (Dave After)
A motion was made by Ed Honea, and seconded by Vice Mayor
Sutton, to approve the Consent Agenda. The motion carried 6~0.
Resolution No. 98-102 -Approving the Present
Incorporation Effort of the Village of Casas Adobes, with Conditions
(Dan Hochuli) This item is continued.
Proposal to the LeaRue of Cities and Towns Resolution Committee-
Resolution Asking the League to Present and Support Legislation
Changing State Law Relating to (i) the Process for Annexations Into
Existing Cities and Towns, and (ii) the Process for the Incorporation of
New Cities and Towns in Order to Bring Similarity to the Process
(Dan Hochuli)
Mike Hein stated that per Council direction staff has put together a
Resolution to submit to the League of Arizona Cities and Towns for the
Resolution Committee. The processes for annexation are greatly
different from the process for incorporation. Council has previously
collaborated on the possibility of encouraging legislation to make these
processes similar. This Reso(ution will call for more parity and similarity
between these two processes to make it a more leveled, fair and
equitable playing field.
A motion was made by Roxanne Ziegler, and seconded by Vice Mayor
Sutton, that Mayor Ham be directed to sign the proposed Resolution
asking the League of Arizona Cities and Towns to support legislation to
provide uniformity in the process for annexation and incorporation. The
motion carried 6/0.
D, Commencement of Annexation of State Land in the Marana Hi.qh
School (Dick Gear)
Mike Hein stated that in conjunction with the new annexation policy, the
Mayor and Council previously approved directing staff to bring items of
annexation to them prior to committing resources. This is the first item to
be presented under the new process. In December of 1997, the governing
board for the Marana Unified School District respectfully requested that
the Town of Marana engage in a process to annex certain state land
around and including the high school. The current Town boundary cuts
the high school in half. From a cost benefit analysis, this would be
intangible but would increase our ability to provide service to our

residents; and to work with the youth in the community and the
surrounding areas. State Land has already given its consent. Staff is
requesting permission to proceed with this annexation which only involves
the high school property and state land.
A motion was made by Vice Mayor Sutton, seconded by Ed Honea, that
Council authorize commencement of the annexation of the above-referred
State Land adjacent to the Marana High School. The motion carried 6/0.
E. Request to Commence the Annexation of the Avra Valley Airport
(Dick Gear)
Dick Gear informed the Council that staff was in negotiations with Pima
County for the airport, Things are running smoothly. Will be meeting with
the FAA this week. At present, the airport is an island totally surrounded
by Marana.
Mike Hein stated that this does not imply that the Town would be taking
over the airport but will annex the island into the community. This gives
the airport the opportunity to develop appropriately.
A motion was made by Ed Honea, and seconded by Vice Mayor Sutton,
that the Council approve the request to commence the annexation of the
Avra Valley Airport. The motion carried 6/0.
F. Commencement of the Annexation of Seqments of the 1-10 and
Union Pacific Ri,qhts-of. Wa¥ (Dick Gear)
Mike Hein stated that this was an effort to meet the Town objectives and
goals to fill in the islands. There are strips along the Interstate that are not
within the Town boundaries. Staff is asking permission to annex these
areas for several reasons.
· These individual annexations will be to fill in and square off portions of
the Town's boundaries
· For service delivery by creating more easily identifiable Town limits
· Staff believes there is a potential revenue stream in the form of
citations from DPS. These traffic citations will be referred to the
Marana Municipal Court for adjudication and collection
The annexations will involve the railroad, the Interstate and some private
property owners.
A motion was made by Ed Honea, and seconded by Herb Kal, that the
Council approve the annexations along portions of the 1-10 and Union
Pacific Union Pacific Railroad. The motion carried 6/0.
PUBLIC HEARING -Ordinance No. 98.19 { Resolution No. 98-83 -
Proposed Changes to the Marana Town Code, Chapter 14, Entitled Water
(Brad DeSpain)

Brad DeSpain informed the Council that there have been a few changes
that have occurred that need to be amended in the Town Code. As a
result of the growth of the Marana Municipal Water System several issues
need to be amended and/or added to that section of the Town Code
pertaining to Water.
Mayor Ham announced "we are now in public hearing".
Bill Schisler, 12561 North White Avenue announced that this was a
health and safety factor and that he was really in favor. Also, when this
ordinance become effective the public should be notified about backflow
and anti-siphon valves.
Mayor Ham announced "we are now out of Public Hearing".
H. Ordinance No. 98-19; Resolution No. 98-83 - Proposed Changes to
The Marana Town Code, Chapter 14, Entitled Water (Brad DeSpain)
A motion was made by Ed Honea, and seconded by Roxanne Ziegler, to
approve Ordinance No. 98-19 and Resolution No. 98-83 proposed changes
to the Marana Town Code Chapter 14 Entitled Water. The motion carried
6/0.
I. Resolution No. 98-103 - Canvas of Town of Marana Special Election
held September 8, 1998 (Sandy Groseclose)
Sandy Groseclose informed the Council that once this Resolution has
been approved all of the annexation propositions will go into effect
effective,
A motion was made by Ed Honea, and seconded Roxanne Ziegler, to
approve Resolution No. 98-103, adopting and declaring the results of the
Special Election. The motion carried 6/0.
Ordinance No. 98.22, Resolution 98-100 -Amendment to the Marana
Town Code to Designate Town Officials Appointed by Mayor and Council,
Those Appointed by Town Manager and Designation of Appointed Officials
as Unclassified Employees
Mike Hein informed the Council that this implements the direction the
Council gave the staff at the retreat held in June, designating Town
officials, officers and clarifications. A year ago Council submitted to the
League of Cities a Resolution asking that the appointment processes be
changed for unchartered communities. This law was passed on behalf of
all cities and towns. Mr. Hochuli has provided a memorandum, which
outlines the exact changes and structure for the appointment process.

A motion was made by Vice Mayor Sutton, and seconded by Roxanne
Ziegler, to approve Resolution 98-100 and Ordinance 98.22. The motion
carried 6/0.
K. Pima Association of Governments Re.qional Council Meetin.q A.qenda
Review for Discussion and Direction (Mike Hein)
Mike Hein stated that it is customary that Pima Association of
Governments (PAG) Regional Council Meeting is next week. There are
issues relating to transportation and finance, The Mayor and staff have
been attending meetings on these issues. If Council desires any specific
action on any items, it should direct its designee, Mayor Ham,
accordingly.

Explorer regarding the "Hard Hat Zone"

Explorer; attended the open house of Stockmen's Bank
M. ManaRer's Report
Mike Hein - last Tuesday the City of Tucson on their consent
agenda released the easement on the Wong property to Pima
County to finalize bank protection. This was the last contingency
pending; I will be going to L.A. to meet with the Regional Office of
the FAA to get an outline of what steps are necessary to facilitate a
transfer in sponsorship of the airport; will be in Phoenix next week
to discuss financing options of public infrastructure for the potential
athletic stadium,
