APPROVAL OF AGENDA
A motion was made by Bobby Sutton, Jr. to amend the agenda by moving item C under
the general order of business be first, before item A, seconded by Ora Ham to and
carried unanimously to approve the agenda with the amendment.
ACCEPTANCE OF MINUTES
A motion was made by Sherry Millner, to approve the Minutes of the Regular Council
Meeting for May 6, 1997. The Minutes for the Retreat of May 2 and 3, 1997 need to
have changes made. The motion was seconded by Ora Harn and carried unanimously.

VII. CALL TO THE PUBLIC/ANNOUNCEMENTS
Tom Clark: Talked about the expansion of the Marana Correctional Facility. Advised
he received a letter, from Warden Lewis, reference the prison wishing to expand it's
men's unit by 60 additional beds. Councilman Clark is against this and strongly urges
the Town to oppose this addition. He also commented to the Council that when he first
came on the Council, he fought hard to get Public Hearings and to bring this to a vote of
the people.
Mayor Honea: Presented a plaque to Vice Mayor Sharon Price for many years of
dedicated service to the Marana Town Council.
Bobby Sutton, Jr.: Presented a plaque to Council Member Tom Clark for many years
of dedicated service to the Marana Town Council.
STAFF REPORTS
GENERAL ORDER OF BUSINESS
C. Discussion and Action - Marana Health Center Funding Request
Council Member Harn declared a conflict of interest on this item. She left the dais and
the Council chambers at 7:17 P.M.
Hurvie Davis: Advised this is a request from the Marana Health Center for assistance
on an emergency basis -- to allow the clinic to continue operating. He advised the
Council, the center has gone through some hard times, the clinic has lost its primary
physician in which they lost their certification in order to be eligible for the HMO
Programs. As a result of being de-certified, the clinic lost the HMO's and about 70
clients who belong to the HMO's. The clinic has requested the Town participate in
funding the clinic. This is an emergency situation until the clinic can get more patients.
The clinic needs approximately $50,000 in emergency funds to keep the center viable.
Mr. Davis stated no money has been budgeted for this item. If the Council chooses to
fund all or a portion of that, it would have to come from the contingency fund.
Chris Winters, 6611 N. Paseo de Angel: Spoke on behalf of Berry Gerber, Board of
Directors President. She shared a brief history of Marana's Health Center. She advised
the clinic provided 2 sliding fee scales to provide primary health care to residents in the
community who are from low to moderate income households. Over 250 patients were
enrolled in Tobacco Tax Sliding Fee Program. This program was funded by the Pima
County Board of Supervisors, with Tobacco Tax dollars from the AZ Department of
Health Services. The Marana Health Center was supposed to get a specific amount of
money - this money is being shared with other health care providers within the
community. She advised Kino hospital used up all of the money - they were
administering the funds. The clinic is requesting a one time grant of $50,000. She
thanked the Council for allowing her to come forward and speak on behalf of the Board
of Directors.

Mayor Honea: How many full time employees are at the clinic now?
Chris Winters: Approximately 19 employees.
Mayor Honea: Advised the Town has put 2 programs for the clinic at the top of the
CDBG allotment for this year, which totals $26,650.
Chris Winters: Commented, she was aware of this. Her understanding was that those
are for specific obligations.
Mayor Honea: Stated $20,000 of that is for administration and $6,600 is for purchasing
new equipment. He advised, if the Town were to grant $50,000 it would have an
investment of $76,000 in the clinic. He feels we can still get this County money.
Chris Winters: Stated the clinic has been putting pressure on the County to get those
funds, including the hiring of an attorney to deal with County directly. County is not
releasing those funds. She also mentioned that the office manager compiles data so the
clinic can evaluate their programs and how they're doing. The clinic provides $35,000
worth of free health care. That's not including what is received from the tobacco tax
sliding fee scale. She advised the clinic has not received supplemental funding from any
source since 1990. She commented that the $76,000 the Mayor talked about is a small
price to pay to keep the clinic operational and keep the doors open to provide all the
services it does for this community.
Mayor Honea: Do you feel that, if the Town were to allocate this money to the clinic,
then it would put you on a solid financial ground - that' you'll be able to operate for
years to come?
Chris Winters: I believe this would get us over the hump. The director went to the
clinics independent auditors to find out the Marana health center and how the clinic
stands financially. He was advised if there was some supplemental funding in the
amount of $50,000 at least, that would get the clinic through. The contract comes back
into effect on July 1. The clinic is working aggressively to have the terms of the contract
stated differently.
Tom Clark: Stated a couple of weeks ago, an employee on his farm had an accident and
he, without thinking twice about it, drove the employee to the clinic to have the wound
checked. He commented it's nice to know that when you're in a position like that, you
can go down the street a ~A mile to the clinic where there is trained staff to see you.
Vice Mayor Price: She wanted to say the clinic is a direct benefit to the citizens of the
northern part of Marana. She hopes the Council will consider the entire $50,000 to help
keep the clinic open.
Bobby Sutton, Jr.: Stated he is in favor of helping the clinic. He feels the Council's
main concern is if this money will help sustain the clinic and will the clinic be able to
support itself.

Chris Winters: She stated the staff is extremely excited right now. Also stated the staff
is looking at possibly extending hours to help the community.
Roxanae Ziegler, Council Elect: Spoke briefly about the bond elections and wanted to
thank Raul Pina and his group "Citizens for a Better Community" who went out and
pushed the bonds for this year. She strongly urged the Council to approve the interim
funding for the Clinic because of the various services it provides not only for the people
in Marana but also neighboring communities. She feels the Town owes this to
Councilwoman Harn who has been working at the center for 35 years and also the
volunteers that have given graciously of their time over all of these years. She feels
Marana as a Town is responsible to keep this center open.
Berry Gerber: Advised that $50,000 is mom than adequate to cover the costs and he
hopes the Council will keep the clinic open for many more years to come.
A motion was made by Vice Mayor Price, seconded by Tom Clark and carried
unanimously to grant $50,000 to the Marana Health Clinic from the Contingency Fund
effective immediately.
Vice Mayor Price asked to be excused due to a prior commitment at 7:46 P.M.
Ora Harn: Thanked the Mayor and Council for their support of the Health Center.
A. PUBLIC HEARING~ Ina Road/La Cholla Road Annexation District -
Consideration of an Annexation of that Portion of Sections 32, 33 and 34,
Township 12 South, Range 13 East; and Sections 3, 4, 5 and 6, Township 13
South, Range 13 East, of the Gila & Salt River Base & Meridian, Pima County,
Arizona. Lying within the General Boundaries of Ina Road on the South, La
Cholla Road on the East, Magee Road on the North, and the Canada Del Oro
Drainageway on the West
Hurvie Davis: Advised this is an advertised Public Hearing for public input on the
possible annexation of basically I square mile east of our existing boundaries of Ina and
Canada Del Om Wash. He asked Jerry Flannery and Jack Neubeck to go over the
process for annexation. Tonight's hearing is to receive public input and no action will be
taken unless Council chooses to direct staff.
Jack Neubeck, 450 W. Paseo Redondo, Tucson, AZ 85701: Advised there are several
misconceptions people have when there is an annexation. One being the addresses will
not change, if your address says Tucson, Arizona - it will stay Tucson, Arizona. He
advised the annexation process is set up by State Statute. He spoke briefly on the
process of getting an annexation started. There are several steps to take prior to
annexation taking place. 1) Petition needs to be filed 2)Within 30 days information
needs to be received from County Assessor & State Dept. of Revenue 3) Notification to
all involved needs to be sent out by 1st class mail 4) Within 6 days prior to the hearing,
notification has to go out to people in the area. 5) Public Hearing is held. 6) There is a
12 month period to collect signatures to make the annexation occur. He advised that

there are some safeguards: you need to get more than half of the full cash value of the
real and personal property and you must get more than half of the owners of real or
personal property in the ama. Everyone who has been notified, has a say. Upon getting
the appropriate signature of real property or personal property owners, then those
petitions and signatures are presented to the Mayor and Council. At which time Council
can adopt an ordinance to annex that area. If them are significant signatures. If an
ordinance is passed, annexation becomes official 30 days after that period.
Jerry Flannery: He advised the map and legal for this was recorded April 21, 1997.
Property ownership's from Pima County and State Dept. of Revenue were requested that
same day. This annexation is 642 acres of land. The area is bounded by Ina Road on the
south, La Cholla on the east, Magee on the north and the CDO Wash on the west. There
are 339 real and personal property owners within this area, with a total assessed value of
just under $100,000,000. There are 2 single family subdivisions within this proposed
annexation. 104 units are within the Golden Heritage subdivision. 21 units are with the
Shalimar Gardens subdivision. There are a total of 8 apartment complexes containing
1,522 dwelling units. This annexation may include up to 4,500 new residences if
annexed. On the commercial side, this area contains the Foothills Mall, it contains the
Albertsons Shopping Center, the Smith's Shopping Center and another commercial
center located on the northeast corner of Ina and Shannon. This area will bring in
approximately 1.8 miles of Ina Road, 1.3 miles of Magee Road, .7 Miles of La Cholla
Road and .5 miles of Shannon Road. The area is anticipated to generate approximately
$48,000,000 of revenue over the next 10 years. The services and improvement costs will
approach approximately $25,000,000 in that same time period. Staff will be meeting
with each property owner in the near future to discuss any issue that they feel is
important for the Town to address.
Joe Murray, 3230 W. Hardy: Advised them is a committee forming to incorporate a
Casas Adobes Town. He asked Council to allow this Committee 2 months to try and
form their own Town. He asked for Council's cooperation.
Mayor Honea: Do you live in the proposed annexation area?
Joe Murray: No, 1 do not.
Katherine Temple, 9811 Stone Creek: Agrees with Mr. Murray. She lives in the area
that is between Oro Valley and Marana. She asked Council to please consider the people
who live in the middle to try and form their own Town. If it doesn't work, then go for it.
Peter Vokac, 7835 N. Avenida de Carlotta: Also is with the committee to incorporate.
He is requesting Council to hold off until September 21, giving the committee time from
July 21 to prove the viability of this action that is being taken. He read a letter to Mayor
and Council: "To control our local destiny and to keep our state tax dollars in our
neighborhoods, we propose to incorporate the Town of Casas Adobes. On behalf of the
60,000 citizens who live in the presently un-incorporated ama, we respectfully request
that the Marana Mayor and Council give us the opportunity to incorporate before
proceeding with the Foothills Mall annexation. Our incorporation is primarily for the
benefit of people in the neighborhoods who will be citizens of the new Town. Our

boundaries will be compact and free of commercial gerrymanders. Based on data from
the Arizona League of Cities and Towns, each City and Town receives $263 per resident,
per year. For 60,000 people that would be nearly $16,000,000 a year State Tax to share
to support the new community. $16,000,000 in new money will reduce the operating
expenses of Pima County and will ease the tax burden of all County residents including
residents of Marana. We have been granted a 2 year window by the State Legislature to
bring our tax dollars back home. Our response to this grant is entirely up to us to take it
or to leave it. We've been told that by Legislators in Phoenix who know. Incorporation
of the Town of Casas Adobe's would end the annexation wars now going on between
Tucson, Marana and Oro Valley. It would bring tranquillity and stability to the
northwest region. The loss of Foothills Mall, Smith's, and Albertson's and the others
east of the Canada Del Oro, extending into the commercial heart of our compact region -
would be a severe handicap to the viability of our community. The tax losses to our
neighborhoods from that area would amount to many millions a year that we could other
wise spend right here for transportation improvements, law enforcement and other
needed people oriented services. If we are not successful in our endeavor to incorporate
the Town of Casas Adobes, then Marana could readily pursue its annexation later. We
therefore request that Marana delay its annexation efforts until September 21, 1997. We
look forward to working with Marana as a friendly neighbor to resolve future regional
issues. Your neighbors to the east, Committee to Incorporate Casas Adobe's Spokesman
Peter Vokac."
Mayor Honea: Who are the members of your committee?
Peter Vokac: Our committee has gone through 2 meetings. Our committee president is
ad-hawk, we only have names of activists. Our committee is made up of mostly
neighborhood activists. Right now we're too early on to do this.
Ora Harn: What kind of boundaries are you proposing at this point, or have you gotten
to that point?
Peter Volmc: He stated a soft boundary possibility is Shannon to First and River to
Lambert. He further commented there are people outside the area that seriously would
like to join them. He requested the Council allow this committee to show that they're
real.
Sherry Millner: Do you live in the annexation area?
Peter Vokac: No. 1 live 2 blocks east of it.
Sherry Millner: Is them anyone here in the room that does live in this proposed
annexation ama? There's no one from that area that we've heard from and I'd like to
know some of their feelings. That are going to be in this proposed annexation area.
Peter Vokac: I can't speak to that, is there any other questions for me?
Ora Harn: How many people are on your ad-hawk committee now?

Peter Vokac: They're all leaders of neighborhood associations.
Ora Harn: How many people involved in your process right now?
Peter Vokac: About 50. And each one of them represents neighborhood associations in
the neighborhoods of hundreds.
Duane McDermott, 2573 Crown King Dr.: There are about 6 or 7 of us here, just
basically on a fact finding commission. I was inadvertently kind of appointed to find out
what's going on with this annexation. I think in the general consensus of our
community, which we have 104 - 105 residents - it's probably about a 90 to 95% denial
of annexation of Marana. A lot of it is due the fact that we have no knowledge of what
you could do for us. We've heard of meetings with commercial people from Albertsons
and all the benefits that you can get with them. We've also heard that you have a 4%
sales tax on all utilities. No one, as far as I know, from Marana has contacted any of our
people with the association to even bother to set up a meeting. I've heard of the fact that
there's been several people who are knowledgeable of the people on the board that have
had phone calls saying what's the blood pressure and the temperature of the people at
Golden Heritage. Nothing has ever been publicly announced, and so consequently we'd
just like to hear and have you come down to us - set up a meeting - but nothing has been
publicly announced. We'd like to hear what you've got.
Mayor Honea: We have a meeting set up for Tuesday night at Casas Adobes Baptist
Church. One of the things that Mr. Neubeck has made quite clear - we cannot annex an
area without the peoples signatures. You and your neighbors are not going to sign a
petition unless we can satisfactorily give you an explanation why and what benefits we
can give you and vice versa. We're not trying to sneak anything. Basically what we're
doing right now, is the preliminaries that the state requires us to do. We have to have a
public hearing, we have to file certain papers and notify certain people. I can assure you
that everybody will be made aware of what we want to do and will be invited to many
meetings. We'll have a meeting at the church on Tuesday at 7:00. We'll be more than
happy to meet with neighborhood associations, groups of people, clubs or whatever. We
have nothing to hide, we're not trying to sneak anything.
Duane McDermott: I didn't incur that, but nothing has been announced to us as to what
the intentions were going to be.
Mayor Honea: Right now we're just doing the legal maneuvering.
Bobby Sutton, Jr.: 1 think what we're asking, if you could put up with the process that
we also have to go through, we're going to answer any of your questions. We'll meet
with you at any time. lt's just getting through the red tape or whatever that's thrown in
front of us as a Town, to do something like this, you're also feeling some of that because
you're waiting for us to reply to you or get with you to set something up. What we're
asking is just allow us to get through the process -
Duane McDermott: We can get through the process, we live in the area - you don't.
We just want to be informed.

Mayor Honea: You will sir, I can assure you of that.
Duane McDermott: Thank you for your time.
Pete Schlegel, 758 W. Sunlight Lane: I would like to answer the concern that I hear
from the Council tonight as far as they wish the feelings from people who live within the
boundaries as you have described them. I'm here to let you know that the feelings about
this issue go beyond those boundaries. The excitement of that group, I assure you that it
is really strong. This is an opportunity for 60 + thousand people between 1st and
Shannon to have their own rule for the very first time. To have true representation, to set
their own zoning ordinances, curfews for their children, etc .... However, that dream
will not come fruition if it is financially or economically not likely to work. By Marana
taking the Foothills area and annexing it, you basically are taking the fuel or the gasoline
away from our car - we will not be able to drive that car down the road without the
revenue that comes from this area. People might not live in the boundary, but without
the gasoline, fuel or revenue that's generated from that area, it then becomes a lot more
difficult to have that dream come to reality. So, these people are going to rally - they are
concerned because you're taking their; basically their food away from their dream.
Please keep that in mind. The idea is that we all need to bond together to meet the future
problems of our great community out here. We're looking forward to working with you
and not against you.
Ora Harn: l have to say that the first time I heard the group talking about incorporation
was like in the last couple of days. I don't know how other members of the staff or the
Town was made aware - ! wonder why your committee did not come and incur support
from us earlier. I'm not being negative or argumentative at all, I'm just saying, that i've
talked to members of the Council and I've talked to a number of people and one of the
things that you and I both know, and I know you
Pete Schlegel: We worked together on a lot of committees
Ora Harn: Great concern that our tax dollars are going to take care of Maricopa County
and not coming back to Pima County. We have talked, and I've been out - and you
know - and talked to many people and said yes you say you just want to stay in Pima
County. But you stay in Pima County and that keeps us from bringing tax dollars back
into our community. I think most of the people I've talked to would help you
incorporate, not - but none of us knew that was coming up when we started this
mlnexation.
Pete Schlegel: Your concerns are very important to us as well. I just want to assure you
that the state legislation that allows this to happen, came in literally at the 12th hour, it
was something that had been proposed 2 years ago, did not pass. There was basically
one man championing the cause - he submitted the bill, he took it all the way through
and had very little help until like the last day. Once it was passed, then the community
leaders had to take a deep breath and start to mobilize and a week ago Tuesday was the
first meeting. A week later - last night was the second meeting. The first meeting was -
do you think this is something we should support. The people there were primarily the

heads of homeox~ ncrs associations, so there was standing room only in a large room bnt
they represented hundreds of people that weren't even there. The consensus was, yes,
this is something worth fighting for. It will be difficult, you know, you've been down
the path - we're going to rely on some of the experiences that you've had of forming and
growing and meeting the regulations. Not only of today but of tomorrow. So, that's
why some of the things that perhaps you would like to have the group do, haven't
happened yet. I can assure you that the lines of communications will be open and the
direction will be to work together for the betterment of the community as a whole.
Mayor Honea: I agree with Council Member Ham. If you folks want to incorporate,
I'll be the first one to come and help you. I think it's a gmat idea. If you want us to drop
back on this proposal - I'm not willing to do that personally, but I'm only one vote. I
will tell you if you choose to annex those 60,000 people over there, I believe almost
every member of this Council will help you. I think it's a good idea. 1 think it'll bring
millions of dollars to our community from the state. There's also a lot more business in
that area that you're talking, there am a lot of retail where you can generate tax revenue
and things of that nature. We certainly, I know sometimes newspapers try to cause
conflict - that sells papers. We have no problem with you folks trying to annex, even if
there wasn't a state law that said that there was a 6 mile boundary. I personally wouldn't
have had a problem with it to begin with. We've invested a lot of money and time into
this project and I don't think in all honesty that we could back off on the project.
Pete Schlegel: We can appreciate that. But I want you to realize that this is something
that we're not just dragging our feet - we are almost in the point position. Them am
several other similar movements. We're all in the exploratory feasibility stage because
we have to be practical and look at the dollars and sense. Can you afford to do this?
Ora Harn: I just wanted to make a statement - we didn't generally run up the road and
decide to do this. We were encouraged by the businesses that were there, to come and
work on this annexation. It's a little frustrating to sit up here - trying to work with
people, trying to be good neighbors and all and when people think that you're just trying
to go in their neighborhood and steal something. We go through this a little bit when we
go and we talk to people about annexation. It's always what do you want from us and -
you know. So one of the reasons we don't get excited about taking in large populations,
which we'd love to do because of our tax situation. It's very hard to convince people to
get involved in a municipality and participate in the system. They tell us "we're in Pima
County, nobody's bothering us, we're not going to bother them - get out of here and
leave us alone". You and I both know that that is prime piece of property and they have
3 ways to go and they asked Marana to come in. It's a little bit offensive when people
kind of act like we're doing that.
Pete Sehlegel: It's unfortunate, but in politics we often have to deal with perception as
well as reality. This is important - it's what the people perceive. I know that as one of
the founders and forn~er chairman of Metro Water, we at Metro Water are concerned as
are some of the other utilities in the region with perhaps the additional tax burden that
we will have to put on and pass on to our customers because we can't eat those costs.
Ora Harn: Is this area part of your water district?

Pete Schlegel: Yes ma'am. We serve the water at the Foothills Mall.
Mayor Honea: No all of it - a large portion is City of Tucson.
Mark Stratton, General Manager for Metro Water: Everything within this area is
served by Metro Water, there is no City of Tucson in this area.
Tom Clark: There's a lot of people in northwest Marana that feel exactly like Joe
Parsons. It's not a consensus by any means of the Council to go in there and annex that
area. It's certainly not my consensus to go up there and annex that area. I want all you
guys to know, more power to you. If you guys can do it, can put it together and form a
Town, I hope you'll come to Marana and try to avoid some of the mistakes we've made
along the way. I hope you can form your community ofCasas Adobe's.
Pete Schlegel: I was excited to see the desire of the people of the community and we
took a good barometer. There are a group of people - almost north of Tangerine to
attend the meeting and they said no, this isn't for us. Which is fine, so that's the stage
where we're at - who wants to play. Those of you that want to play, do you want to go
through the exercise and take the knocks and the bruises to make it happen. Thus far the
answer has been you bethca. The preliminary numbers look good - so it's not an
impossible dream. We again would like to assure you we really want to work with you.
Ora Harn: If Marana were to decide to withdraw its annexation of that area, what
would keep someone else from stepping in the next day?
Pete Schlegel: Contiguous is the answer. I don't know who can, as 1 look at the maps in
my mind.
Mayor Honea: I can answer that for you, and I don't mean to interrupt you. The Oro
Valley elected officials have been talking to individuals in that neighborhood as well. In
fact they did prior to us. For them to make it contiguous, they just annex the area in
between. It's the same principal that we have, but Oro Valley does have - it would be
legal for them to file a blank petition and take that area in as well.
Pete Schlegel: Oro Valley is struggling with "some other perception of their
leadership". They did fail with their last major annexation on north Oracle. There is a
movement as we sit here to recall the current Mayor and Council. Financially they don't
have the extra money to spend on something like this. I don't know if the desire is there.
I attend all kinds of Oro Valley meetings and I have not picked that up, that that's
something they really want to run out and do.
Oro Valley: I don't know if you know it or not, but Tucson has annexed right up to the
southern border of Marana.
Pete Schlegel: That's what precipitated all of this the great fear of falling under the
rule of Tucson. That's what drove us to form Metro Water, that's what's driving us now.
There is virtually uniform concern among the area, that they do not want to be governed

MARANA TOWN COUNCIL

by the people who currently sit and govern the City of Tucson. That's why this effort
has been started. People are here today fighting for this cause instead of being at home.
Herb Kai: Questioned Mr. Schlegel if any projections have been done to see if their
proposed Town could exist on the Revenues.
Peter Schlegel: Advised that's why they're in the feasibility study now. Commented
there are people outside of the area are wanting to be included in this incorporation,
therefore more explorations need to be done to see where the boundaries should go and
take a head count. Once the total is added up and we look at the financial
responsibilities of roads and Town Halls etc. Then we will know whether or not this will
be done.
Mary Cooper, 2588 W. Crown King Dr.: 1 own property in the area where you want to
annex. Stated no one to her knowledge has come to talk about the annexation. Is
concerned about what Marana has to offer. Is looking forward to next weeks meeting to
see what will happen.
Tim Brown, 1220 W. Maximillian Way: Residence is just east of the area of proposed
annexation. Is also with the group to incorporate Casas Adobe's.
Ora Harn: Advised when you want to do an annexation of this magnitude, you don't
publish it too much, or else when you go to file the papers - someone else has already
filed on that area.
Mayor Honea: Made a correlation between this incorporation effort and the
Ina/Thornydale incorporation effort. Advised when Marana went in there, the store
fronts ~vere leased at about 60%, there were transients and youth gangs in the parking
lots. There were people that were apprehensive about this - asking how could Marana
help out. Today, the stores are leased at about 95%, there are no youth gangs, vagrants
and transients begging in every store front. The area has been cleaned up. We did what
we said we would do.

B. Resolution 97-42 - Adopting Marana Policy Guidelines and Application
Procedures for the Establishment of Community Facilities Districts
Hurvie Davis: Advised a year or two ago we established 2 CFD's in the Town of
Marana - in the RedHawk community area. At that time there were draft guidelines -
Dan Hochuli has added to those guidelines. Staff recommends adoption of these
guidelines.
Dan Hoehuli: There are 2 purposes behind these policies and procedures: 1) an
application procedure which tells a developer what needs to be done if they want to form
a CFD in the Town. The developer needs to apply, pay the Towns expenses in advance,

the Town needs to know what is going to be done and how it's going to be done, what
bonds will be sold. 2) The structure which the Town will expect in a CFD. To say, if
one is going to be formed - the Town wants the developer to know up-front if the bonds
are going to be publicly offered there'll be a certain ratio of debt protection. If they're
going to be privately offered, they must be insured. The Town Council will work as the
Board of Directors unless Council chooses not to. It puts the developer on notice up
front.
Tom Clark: Asked if these are retroactive to the RedHawk's?
Dan Hochuli: Advised no, each time a CFD is formed there will be a development
agreement that will specify all of these rules.
A motion was made by Bobby Sutton, Jr. Seconded by Tom Clark and carried
unanimously to approve Resolution No. 97-42.
E. First Reading - Amending the Town of Marana Personnel Policies by Deleting
Appendix V: Salary Structure
Hurvie Davis: We are recommending that we amend the personnel policies - there are
some old salary structures in the personnel policy manual.
Jane Johnson: Appendix V has old information on salary schedules for the Town and
specifically for the Police Department. Those are more appropriate in the actual
classification and compensation plan. In terms of an appendix, they are no longer
needed in personnel policy.

F. First Reading - Amending the Town of Marana Personnel Policies by Adding
Article 01.02, Code of Conduct
Jane Johnson: This is a new policy. Most municipalities and public sector entities have
such a code. Sometimes it's called a Code of Ethics.

G. First Reading - Amending the Town of Marana Personnel Policies by Adding
Article 02.06, Classification and Compensation
Jane Johnson: There is one provision that has not been found in other portions of the
existing personnel policy and that has to do with the date upon which an employee
would he evaluated. In the past, when employees were hired, the hire date was their
anniversary date. Now that we have more employees, as employees are promoted - it is
more typical to have an evaluation anniversary date moved to the date of promotion.
The way it stands in our current policy, it wouldn't make any difference when you got
promoted, your anniversary hire anniversary date is your evaluation date. This
classification policy does have the new provision.

H. Pima Association of Governments Regional Council Meetin~ A~,enda - Review
for discussion and Direction
Hurvie Davis: We have not as of yet received the agenda for the PAG Regional
Council. What we have before you is the Management Committee agenda which we met
and acted on, on May 14. Most of the items on the Management Committee agenda will
be coming to the PAG Regional Council with the exception of item 5 as shown on the
Management agenda - the MPS 208 plan amendment expiration. Mr. Palkowitsh has
asked the Management Committee for a 5 year extension. The Management Committee
agreed to continue this item until next month. If this item is on the PAG Regional
Council agenda, it will be just to reflect the action of the Management Committee.
Ora Harn: Does Mr. Davis know about any agreements that Mr. Palkowitsh might have
already made concerning the treatment, as far as effluent water or any of that. Has he
already signed agreements?
Hurvie Davis: I am not aware of any there's been nothing brought to my attention. I
am having a meeting with Mr. Palkowitsh next week on this issue.

I. Mayor and Council's Report
Sherry Millner: Attended the alternative school graduation on Monday night, along
with Mayor and Council Member Clark. This morning, had breakfast with Hurvie Davis
for the United Way. Mayor Miller would like to get together with Council for dinner.
There are several dates to chose from: May 28, 29, June 5, 11 and 12. It will be at the
Ye Olde Lantern, if we can pick a date then we can get things set up because his date
book gets filled up quickly.
Mayor Honea: June 5 seems like a date that everybody can do.
Bobby Sutton, Jr.: I met with Mr. Mike Rossi, the major topic of discussion was the
interchange. I would like him to be a part of this, because of the extreme contacts he
has. He's going to try and give us some ideas on how to form this group or what it's
going to be. We also talked about the locating of a new Town Hall, he believes there
may be some funding for that.
Herb Kai: No Report.
Ora Harn: No Report.
Tom Clark: Ora and 1 met last Monday morning with the teacher that was going to run
the program that Don Hawkins came before us. We talked with her for about an hour.
This is only the second year that the program has been tried for. She seems like a

competent teacher. She is enthusiastic about the program and thinks it's a benefit for the
students that are in it. Ora wanted to know what the criteria was for picking the students.
Ora has a second party trying to find more information on it. Thursday night, my son
and I went to Continental Ranch to the Fire Station for the bond information meeting.
There was one couple from the Continental Ranch there, Roxanne and Carl & I. There
was no one there.
Ora Itarn: Advised when she and Tom Clark met with the teacher, she didn't get too
excited with her answers about how the students are selected. Ora asked Linda Morse to
evaluate the program and bring back some kind of evaluation. She advised Roy and
Hurvie have agreed to put on the agenda on June 3 funding for children and youth
programs. Basically we can look at next years agenda and say this is what we're going
to do, and these are the programs we're going to fund. She commented about the bond
issue, to inform people - was very embarrassed because no one showed up. The other
thing, I went to the Chamber of Commerce lunch today and was pleased, it was one of
the best turn outs for the Chamber.
Mayor Honea: I signed off on the Crackle Barrel to be built in Continental Ranch.
Construction should be done within 2 months. Tomorrow, some of us will be going to
Del Webb for their senior project. Yesterday, Councilman Kal, Mr. Davis and I met
with Mark Stratton with Metro Water and one of their Board Members - in regard to our
annexation. From what I gathered from that meeting, Metro doesn't have any problem
with us going into that area. Mayor asked if a special meeting should be set for the
budget.
It was decided to have a meeting at about 5:30 P.M. before the Regular Council Meeting.
Sandy Groseclose: Asked if any food should be served.
Mayor Honea: Had one other item, Vice Mayor had to leave due to a conflicting
meeting. He wanted to thank Tom Clark for his service to the community.
J. Manager's Report
Hurvie Davis: Last Thursday evening I attended a going away reception in honor of Dr.
Pacheco at the University of Arizona. 1 was one of two municipal manager types there,
the other was Mike Hein from Nogales. There were a number of elected officials there
from various jurisdictions. I wanted to inform the Council that we've had some
meetings with a representative of Diamond Ventures in relative to annexing some
property at Sunset Road. They have been negotiating working with the National Parks
Service for part of that. Yesterday I attended a luncheon at the Arizona Inn put on by the
GTEC at which time we heard Mr. Mike Edwards, the facility coordinator for the Intel
corporation talking about looking at the Tucson area for possible sights for an Intel plant.
Employing anywhere from 1000 to 2500 employees, needing about 3 to 500 acres of
land. There is a sister plant in Chandler. Mr. Flannery and I met yesterday with the
Orange Grove apartment people relative to signing a petition for the Orange
Grove/Camino de la Tierra annexation and it looks pretty positive on that. Advised he
has enjoyed working with Council Member Clark and Vice Mayor Price. He appreciates

the forthright honesty that Mr. Clark has shown, you knew where he was coming from.
He's a man of his word and a man of integrity.
Tom Clark: 1 didn't plan on this being my retirement speech or anything, but I'd like to
thank Sandy for her graciousness to me all this time that I've been on the Council. I
have enjoyed working with the rest of Council as well.
