V. APPROVAL OF AGENDA
A motion was made by Bobby Sutton, seconded by Tom Clark and carried unanimously to
approve the Agenda as written.
VI. ACCEPTANCE OF MINUTES
A motion was made by Ora Harn, seconded by Bobby Sutton, Jr. And carried unanimously to
approve the minutes of the Regular Council Meeting of August 6, 1996 and the Special Council
Meeting of August 13, 1996.
VII. CALL TO THE PUBLIC/ANNOUNCEMENTS
Steve Paschal, 7360 W Beryllium Ln.: He lives in Parcel 27A and is currently the owner of Parcel 26.
Coventry Homes is in the process of developing that parcel. He has concerns on how he is
approaching it. The residents down the street as well as Mr. Paschal are concerned about the
evaluation and grading on the lots. We were told at the Planning and Zoning meeting that behind his
house there would be four feet of dirt placed up from his ground floor and then a retaining wail put in
and then a five to six foot fence on top of that. That would make about a nine to ten foot wall behind
his house. He is not getting consistent responses from different parties. His other concern is the
placement and the height of the wall. He would also like to meet with Coventry and hopefully a
representative from the Town Building Department so that we get corect information.
Billy W. Schisler, 12561 N. White Ave.: He went to the last Planning and Zoning Commission
meeting and Southwest Value Partners presented a Specific Plan Amendment. This amendment in
general he likes and he feels it would be good for Marana. However, there is one concern that should
be looked at; the signage. What they have presented for signs at Cortaro Road and 1-10 are attractive
but they are kind of like billboards.
VIII. STAFF REPORTS

GENERAL ORDER OF BUSINESS
A. Consent Agenda
1. Ordinance No. 96.33 - Consideration for adoption of an amendment to Chapter 12 of the
Marana Town Code adding regulations for the use of bicycle helmets by minors within the
Town limits.
2. Appointment of Town Public Safety Retirement System {PSPRS} - Board citizen members
and clarification of their term limits.
A motion was made by Bobby Sutton, Jr., seconded by Tom Clark and carried unanimously to
approve the Consent Agenda as written.
B. Public Hearing; Oidfather Road/Joyce Lane Annexation - Consideration and approval of an
annexation of a portion of the Southeast quarter of Section 31 in Township 12 South~ Range
13 East; Gila & Salt River Meridlan~ Pima County~ Arizona.
Jerry Flannery: This is a Public Hearing. The Council was asked to conduct a Public Hearing; they
don't necessarily need to act on it tonight. If they choose to give direction to Staff then they may.
Staff has had a couple of calls from citizens in the area within the annexation itself that have
expressed some opposition to it. Those individuals are here tonight so they may wish to come before
Council and express their concerns. The annexation consists of 6.5 acres, we were approached by
one of the property owners that owns a subdivision within this area.
Donald Pierson, 7305 N. Juniper Rd.: He received a letter last week; he hadn't seen any notices
posted that this annexation was even proposed. He's lived in the area for over twenty years and he
has no desire to be annexed into Marana.
Arnold Belasco, 7325 N. Juniper Rd.: He basically received the letter and went out looking for the
posted sign. He sees no benefit of this annexation to himself and he would like to know what benefit
it is to Marana to have this parcel. He firmly objects to the annexation. He doesn't see anything that
Marana can do for him.
Larry Festian, 4141 W. Gilbert St.: He was not, aware of the annexation, he doesn't know what the
advantages or disadvantages are. He was just notified like everyone else on August 27, 1996. Right
now he is not in favor of it at all, unless there is a good reason why we would be annexed.
Ora Harn: She was wondering if these people would be interested in talldng with the Town as to why
it might be to their advantage to be annexed into the Town.
Larry Festian: He has no reason not to, but at this point he's not interested unless there are some
real good reasons why he should be. Three of the five people that own property in the area are in
disagreement with the annexation; is that enough to stop it?
Mayor Honea: We could actually split it, take the one parcel and not take the other parcels.
Larry Festian: He has no objection to having some members of the Council talk with him. He thinks
all of us together would like to find out what advantages and disadvantages there are.
Mayor Honea: Primarily one of the prime advantages is the police protection. We have a large
substation right in that neighborhood. There have been some pretty high visibility crimes in that
area. The response time of the Marana Police Department in that area would be very quick, that is a
tremendous advantage. There would be a higher visibility and more police protection.
Larry Festian: Is there anything else.
Mayor Honea: Marana doesn't have a property tax so we don't make any money having this
property in Town.
Ora Harn: There has been a lot of clean up in the area since Marana annexed the business area.
Larry Festian: He agrees. He thinks that the advantage has already been there because of the high
visibility of the police along Ina Road, In thirty days or so a petition will be sent out that needs to be
signed and if we decide not to sign it, then it will not be annexed, is that correct?
Hurvie Davis: After a Public Hearing such as tonight and thirty days have passed, we can go out
and start collecting signatures. We have not met with residents yet but staff plans to go out and
meet with each of the residents and explain to them about annexation. We have one year in which to
get the required signatures of the property owners that are legally on the recorder's list. We have to
get at least 50% of the assessed valuation.
Mayor Honea: We have to get over 50% of the assessed valuation and 51% or over of the property
owners to sign.
Hurvie Davis: We could probably scale this annexation back and do just the property on the west
side of the block. His understanding is that we can change the map up until we have obtained the
first signature.
Joyce Oldfather, 2064 E 4th Street: She thinks it is an honor to be annexed into the Town. She did
request it last summer. She is going to be very happy if she is annexed into Marana. Anyone that
turns it down is not being very wise in the future. The future of development will be with Marana
and not with Pima County.
Herb Kal: Does Mrs. Oldfather have any future plans for her property.
Joyce Oldfather: Right now it is all developed on the books, it will be a thirty unit townhouse
development.
Bobby Sutton~ Jr.: If the people don't want to come in we don't really force anybody, but when
people do want to come in, the arms are usually wide open.
Mayor Honea declared Council out of Public Hearing.
Ora Harn: She would like to not act on this tonight; she would like an opportunity to talk with some
of the property owners.
C. Floodplain Management Board - Appeal for a variance to Title 21, Floodplain and Erosion
Hazard Management Code, by Valentine and Mary Vel~a.
Hurvie Davis: Mr. And Mrs. Vega want to put some housing on their property which is located in
the floodway. They have filed a request to the Flood Plain Administrator; he has denied that request.
The process is that the property owner then appeals to the Council sitting as Flood Plain
Management Board.

Dave Atler: We have a family that would like to place a modular home on their propecty. They are
well within the designated floodway that Pima County came up with. Mr. And Mrs. Vega are here
this evening to address Council. This property has never had a structure on it.
Mayor Honea: The new adjusted Pima County map that was received a couple weeks ago, were
there any adjustments made in this area.
Dave Atler: It was specifically on the Honea Heights area. We haven't gotten anything on this area
that would show anything otherwise.
Herb Kal: Once we get Phase II initiated, will the property be taken out of the flood plain where they
could do something?
Dave Atler: It should take them out of the floodway at least. The issue isn't so much the flood plain
as the floodway; the floodway has much stricter guidelines. This should help the whole area once the
levee is in.
Ora Harn: This is of great concern that these maps have changed, when you start saying someone is
in the floodway you virtually say that their property is worthless.
Dave Atler: As an enigneer it scares him to think of having people out there in the floodway.
Valentine Vega, 15109 N. Wentz Rd.: The map shows where his proerty is. Back in 1983 when the
flood hit an uncle of his lived southeast of him; there was no water up there. He talked to people in
the neighborhood and there was no water up there either. After he found out that he was in the
floodway they closed the door on him, said they didn't want to talk about it. He is trying to set a
trailer on the acre that be bought and he needs help, but nobody wants to come up and help. He
doesn't see any danger; there are a lot of trailers already in the area. He worked hard for this
property and now he can't put his home on it and move in. All he wants is to have this considered.
Mayor Honea: Has Mr. Vega inquired on insurance.
Valentine Vega: He has not done anything. He had to come to Council first to get a decision on
whether it could be done or not.
Mayor Honea: If you're in a floodway he doesn't know if Mr. Vega could get flood insurance on a
house; that is of concern to him. He also has property in Marana that is listed as being in the
floodway.
Bobby Sutton, Jr.: If we allow people to build in the floodway we are jeopardizing losing FEMA
Funding. If he had his money in 1994 the trailer would be on the property; because he had to wait a
couple years to save his money he can't do it. Morally he has a big problem with that. Is there a way
that we could look at the process Honea Heights went through that did move land from the floodway.
Mr. Vega is right on the outer edge.
Dave Atler: We could look at that, there's a huge didfference between the two. Honea Heights is
significantly higher above the flow line of the River. In this case you can look right across from Mr.
Vega's property in the area that did receive the flow and you can see where sandbars have deposited
over the years. He is not as hopeful on this one as he was on Honea Heights, because of the
differential between the property and the River.
Mayor Honea: We have two options. One is we can grant Mr. Vega a variance with the requirement
that he have proof of flood insurance prior to placing his home, or two, Mr. Vega is going to have to
wait.
Valentine Vega: He has a manufatured home waiting for him right now.
Dave Atler: We have given variances in the past with other conditions other than getting insurance.
The third option is in the Ordinance, that is for the Town to purchase the property.

Dan Hochuli: He wanted the Town Clerk to read back the conditions of the motion.
Sandy Groseclose: To allow a variance for Mr. Vega with proof of flood insurance and Hold
Harmless Agreement along with an elevation certificate.
A motion was made by Ora Harn, seconded by Bobby Sntton, Jr. and carried with Council Member
Herb Kal voting Nay to allow a variance with proof of flood insurance, a Hold Harmless Agreement
and an elevation certificate.
Council agreed to move Item F to follow recess.
RECESS
F. Executive Session - Pursuant to ARS Section 38-431.03 (A) ~4~ for discussion and
consultation with Town Attorneys in order to consider its position and instruct its attorneys
reKardinK Marana's position in the tax case of Marana v. Li'l Abner's Ltd.
Executive Session has started. TIME: 8:21 p.m.
Council back in session at 9:45 p.m. Council Member Herb Kal was excused at this time.
D. Marana Park Master Plan Update
Dave Atler: Mr. Atler hired Don McGann and Associates a few months ago to look at the Park's
Master Plan. The main purpose for being here this evening is principally tied to the March Founder's
Day, and the 20th Anniversary.
Don McC-ann: Mr. McGann went over the Master Plan for long range improvement of the Marana
Park. The existing softball fields would remain with some improvements. The pool complex would
remain with the swimming pool and wading pool. We are looking at an expanded deck area. The
tennis courts would also remain and be resurfaced over time, additional lighting would also be
constructed. A couple of new basketball courts are proposed as well as a second softball field and a
new maintenance yard for security of equipment that the Town purchases to maintain the Park. In
terms of new facilities, we are proposing that a big ramada be developed which can be used for many
different purposes. Other new facilities would include a handicapped playground, scattered
equipment would be relocated and newer pieces would be added; these would be handicap
accessible. The area to the west of the swimming pool, with selective clearing, would create a multi-
purpose field that could be used for soccer and football leagues. Depending on the number of trees
the Town is willing to move, we could have a fairly large field.
Mayor Honea: Underground infrastructure, wiring, water, irrigation was that drawn up in part of
the Plan as well?
Don McGann: It is part of the work that we are doing.
Ora Harn: How many parking spaces will there be?
Don McGann: The current Plan shown tonight incorporates 200 parking spaces on site.
Dave Atler: The only times that we have found that there have been problems with park/ng is on
opening and closing days with Little League.
Tom Clark: Have we discussed about the roadway on the other side of the pump between the Park
and the canal?
Dave Atler: We haven't discussed that yet. We really haven't considered taking down the cables and
the posts, primarily for security reasons.
A motion was made by Bobby Sutton, Jr., seconded by Ora Harn and carried unanimously to
accept the Park Master Plan as presented.
E. Update on Internet
Hurvie Davis: We have been working on this for quite a while.
Roy Cuaron: In Council's packet tonight there is a printed copy of what Virtual Showcase has
developed and is currently on the Internet. A live demonstration is available tonight if Council is
interested,
Joe Kohler: He would like to know if there are any changes that Council would like to see made. We
left the economic development page blank, the reason for that is the information he has gotten from
the Town on economic development is identical to information that is on the Ar/zona Department of
Commerce's service as a community profile of the Town. He thought maybe the Town would like to
provide some additional information for this page, maybe something more dynamic and current than
what's already out there. Mr. Kohler went over how it works and how it displays.
Ora Harn: Are there plans for any type of advertisements.
Joe Kohler: He had no plans for any type of advertisements on the page. Anything that's affiliated
with the Town of Marana that Staff wants added to the site.
Bobby Sutton, Jr.: Is there a list of things that we can choose from as to what we want to have on
there. What do other communities have? It might be interesting to see what they have.
Mayor Houea: We could set up a committee to get some direction on what Council would like to see
on the Internet.
Roy Cuaron: He can be the contact person that Council can give information to so that it can be
given to Joe.
Hurvie Davis: He will also get together with Staff for additional suggestions on what they would like
tO see.
G. Mayor and Council's Report
Mayor Houea: There was another meeting of the Water Committee. Hopefully, within the next 30
days or so we will be able to bring the final draft before Council.
H. Manager's Report
X. FUTURE AGENDA ITEMS
Tom Clark: tle attended a Chamber of Commerce meeting the other day and there was discussion in
reference to political signs and what we were going to do about them. They still feel that there is a need
to have a meeting with the Development Center. He doesn't know if it's worthy of an agenda item or
not. He does know that there is still some concerns from people outside the Chamber of Commerce
within the last two weeks again concerning the Development Center and how things have slowed down
and arenk getting done in the proper order. He talked to Dave After and Jerry Flannery in reference to
this. They ail say they are doing what they need to be doing.
Mayor Honea: There has been talk about forming a committee to look at some of these problems if
they do exist. We do anticipate working on it internally and if we perceive any large problems we can
do something.
