APPROVAL OF AGENDA A motion was made by Ora Harn, seconded by Sherry Millner and carried unanimously to approve the Agenda as written. VI. ACCEPTANCE OF MINUTES VII. CALL TO THE PUBLIC/ANNOUNCEMENTS Dan Hochuli: Mr. Hochuli introduced two new employees with his firm. Thomas Benavidez, has taken the Arizona Bar Exam and is currently working as a clerk and will join the firm as an associate attorney once he passes the exam. Allison Serrante will be taking the Arizona Bar Exam early next year. She has joined the staff as a clerk and hopefully will also join the firm as an associate attorney. Dennis Harrison is no longer with Hochuli and Associates. Both of these new employees will be putting in a lot of work with the Town of Marana. Dave Atler: Mr. After introduced a new employee from his Department, Pauline Nunez the new Parks and Recreation Coordinator. Sandy Oroseclose: Mrs. Groseclose wanted to recogn/ze a Scout group that was in the audience tonight working on a badge. Mayor Hones: At the last Council Meeting a Town Motto was selected from the entries received. We had three individuals that submitted basically the same winning slogan. We took the earliest entry for the winner. We will be awarding the two other entries that did not get the grand pff~ze a $100.00 certificate to the Westward Look for a nice dinner, Mayor Honea recognized these two people. The grand prize winner, David Hays, was also awarded a plaque of appreciation in addition to the trip to Disneyland. VIII. STAFF REPORTS Staff Reports on file at Town Hall IX. GENERAL ORDER OF BUSINESS A. Consent Agenda 1. Chief Fiscal Officer - Appointment of Town Manager, Hurvie Davis, as the Chief Fiscal Officer of the Town of Marana. 2. Resolution No. 96-75 - Review and approval of an Assurance Agreement for completion of Subdivision Improvements IThlrd Party Trust] Trust No. 10,783 between Richmond American Homes~ Inc. and Old Republic Title Insurance Agencv, Inc. assuring the completion of public improvements in Continental Rancht Parcel 4. 3. Resolution No. 96-73; Preliminary Plat by El Dorado Holdings - An application for review and approval of a Preliminary Plat for a single family detached home subdivision and commercial development. The proposed site is located at the Northwest corner of Cortaro Farms Road and Interstate 10 in a portion of the North half of Section 26, T12St R12E~ 4. Resolution No. 96-741 Continental Ranch Parcel 23 - Request for approval ora single family detached subdivision Preliminary Plat located at E 1/2 of Section 20 and W 1/2 of Section 21 Township 12 South, Range 12 East, Continental Ranch Parcel 23. Property owner is Del Webb's Coventry Homes of Tucson, Inc., 8973 E. Sugar Sumac Street, Tucson, Arizona. Ora Ham: Council Member Harn wanted to pull Item #2 from the Consent Agenda. A motion was made by Ora Harn, seconded by Herb Kai and carried unanimously to approve the Consent Agenda with the exception of Item #2 being pulled for discussion. Mayor Honea asked to have Item #2 pulled from the Consent Agenda. We have had some indepth discussions over the last couple of meetings in reference to the linear park in Continents1 Ranch that is required by the Specific Plan. A lot of this has slipped through the cracks because in previous years we have not had the staffing to keep up with it. He is wondering if R/chmond American intends to build the linear park as it is drawn out in the Specific Plan. Rick Snodgrass, Richmond American: The best way to answer that question is that he can state that when we purchased the property there was never any representation to them as thc buyer that an obligation to complete a linear park was part of the responsiblity as purchasor, lie would like to know if the Town has had any success in determining who in fact in the past should have been responsible for those. It would be simple for him to say that it had to have been the original developer, but we ail know where he is. With regards to reality he would like to have some assurance that the Town has researched this and is just not taking the easy way out. We certainly wouId be more than happy to participate in whatever way was deemed fair. He honestly does not know where that responsibility is and should be. Mayor Honea: Richmond American had a copy of the Continental Ranch Specific Plan from day one, did they not? 2 Rick Snodgrass: Yes, they did. Mayor Honea: And in the Specific Plan it calls for a linear park, bike ways and things of that nature. Rick Snodgrass: In the parcels that it applies to, yes. We will be happy to comply with the items of the Specific Plan. But he is wondering how this whole thing got to where it is today. Thc requirements to meet those parts of the Specific Plan were not the requirements given to the original developer who may or may not have passed them along. Mayor Honea: If you buy the property which is ali inclusive in thc Specific Plan you arc bound by the covenants of that Plan. Rick Snodgrass: He doesn't argue with that at ail. Mayor Honea: He is looking for primarily the linear park. The problem may be determining who the responsible party is. Under the Specific Plan it says that the responsible party is the prime developer. When we talked to the individuals from Coventry after they purchased the total remainder of the vacant property, they stated that they were going to build a linear park on their property. According to the Specific Plan that becomes part of the Homeowner's Association ownership. What concerns him is that in the Coventry section of the Continental Ranch Specific Plan as a whole they're going to have a linear park, pathways and all the things that were called for in the Specific Plan because they have already consented to do that. What's going to happen is all of the people that buy into Continental Ranch are going to be paying Homeowner's dues to help with the maintenance for the linear park everything else. The problem is that some of the people are not going to have any linear park or bikeways. The people in Coventry Park will have the amenities but all will be paying for it. He doesn't believe that is necessarily fair to the people in the community. Rick Snodgrass: It seems to him that it is a totally encompassing kind of issue than just Richmond American. If it's an amenity for the entire area then it should be addressed that way. Sharon Price: She is concerned that if this linear park goes in it will put a burden on the homeowners. What about the safety issues that are involved with the drainage channels and who would be responsible with getting the linear park across the channels. The channels belong to the Town; do they have a responsibility as well? Dave Atler: He doesn't believe that all the drainage channels have been dedicated to the Town yet. He would have to look into it. A motion was made by Sharon Price, seconded by Tom Clark and carried with Mayor Honea voting Nay to adopt Resolution No. 96-75, Richmond American Homes Assuarance Agreement, the completion of public improvements in Continental Ranch, Parcel 4. B. Public Hearing; Resolution No. 96-76 - Consideration of an appeal of a denial by the Marana Planning Commission of a Conditional Use Permit for a telecommunications tower and site to be located at 8740 West Tangerine Road submitted by TMSI on behalf of AT&T Wireless PC2S~ Hurvie Davis: This is an appeal of the decision of the Planning Commission for a request for a Conditional Use Permit by AT&T Wireless in order to install a communication site, including an unmanned building and 250 foot tower located at 8740 T. Tangerine Road. This issue went before the Planning Commission on July 31, 199fi arid they voted 3 to 2 to deny the applicant's request. The applicant is appealing to the Town Council on that issue. Jerry Flannery: This appeal, at the applicant's request, has been withdrawn indefinitely. It has been advertised as a Public Hearing so one should be conducted if there is any one here to speak on this issue. Mayor Honea declared Council out of Public Hearing. C. Resolution No. 96-70; CR Parcel 3 Preliminary Platt Coscan Arizona Inc. - Request for approval of a single family detached home subdivision Preliminar~ Plat located within a portion of the NE 1/4 of Section 34 T12S~ R12E~ Continental Ranch 3. Property owner is Ranch Holdinl~st 8160 N. Hayden Road Building J~ Suite 208t Phoenix~ Arizona. {Continued from August 6~ 1996 Council Meeting]. Hurvie Davis: This is a request for approval of a single family detached home subdivison Preliminary Plat located in Continental Ranch. The property owner is Ranch Holdings. This item was continued from the August 6, 1996 Council Meeting due to issues concerning the linear park which was just discussed on an earlier item. Staff has recommended that no action be taken on this item, however in talking with Mr. Flannery, there have been some new late developments. Jerry Flannery: This issue is pretty complex. The Specific Plan talks that the linear park is at the cost to the master developer. It is operated and maintained by the master Homeowner's Association. The common area that is in the rear of the parcels that are being subdivided was dedicated to the Association; it continues to be in their ownership. Where do we go from here? We either say these issues have to be stopped until these park situations are cleared up and, he's not sure if anybody wants that. The other option is that we get recreational facilities as they are implemented. If it's adjacent to a school a linear park is required. After 50% of the development within that parcel occurs, then the linear park is required to be constructed. Maybe we can all get together with the Board of the Association which basically is all the primary developers in Continental Ranch and sit down with them and work out a strategic plan to maybe have some commitments made. If we can possibly get the linear parks that we can now and if there is commitment to do that, he thinks it's good progress. Jim DeGrood, WLB Group: He is here this evening on behalf of Coscan Arizona, the developer of this project. Continental Ranch Parcel 3 is situated on the southern end of the development. Currently Southwest Value Partners controls Parcel 3, Parcel 2 and Parcel 57, those are the only properties that they currently have ownership of on the western bank of the Santa Cruz River. On behalf of Southwest Value Partners and Coscan we're here this evening to propose to construct linear park improvements on Parcel 3. Parcel 3 with the project, Parcel 2 when that parcel is also developed. At the very western portion of the site we currently have a 50 foot common area. We also have an additional approximately 50 feet of flood control district land that's up against the bank protection. As it exists today we're looking at nearly vertical bank protection in this reach and once we pass over drainage way #9 there's a split in the channel. The embankment adjacent to the development portion of Continental Ranch lays back to about a 4 to 1 slope, whereas the primary channel pulls away from that embankment. The concept that we are proposing is similar to what Coventry Homes is proposing. Basically, a two-way paved bicycle path and a decomposed walking path. Additionally, we would have one landscaped, either a sports type of node, activity node or a picnic node at this location. The biggest expense on this linear park and the various maintenance items on the park are going to be bascially the railing that will need to be constructed along the top of the bank. We do need to put some kind of protective barrier adjacent. It would be similar to what's done on the Rillito River Park currently. Then we would need to transition down into the wash bottoms on the two channels that are adjacent to the site. Currently, drainageways 10, 9, 8,7, 6, 5, 4 and portions of drainway 3 are owned by the Town of Marana. They were either dedicated with the plats of the adjacent subdivisions or they were dedicated by separate instrument. Probably the biggest cost item on the linear park is going to be the transitions into and out of the wash. We haven't really even priced what type of treatment we would be looking at. We will need to construct ADA accessable ramps into and out of the site, so we're looking at a ramp that would probably be cut into the soil cement approximately 90 to 100 feet. Many times you will hear discussion on linear parks with the bike trail versus the walking path. In this case we believe that we need to keep the bicyclists and the pedestrians separate and that's what we're proposing. Tom Clark: Do we want people going in and out of the drainages? Mayor Honea: We've had proposals submitted to build a golf course in them. If we could build a golf course in them we could certainly build a linear park through there. Tom Clark: The bike paths and walkways would go right into the drainages and right out the other side. How deep are they? Jim DeGrood: The Santa Cruz River proper is 15 feet deep. The deepest channel of the side channels has been nine feet deep. Sharon Price: If we put that linear park in does it have to be ADA accesible, correct? Jim DeGrood: That is unclear, however, he believes that they would design it as such. Sharon Price: She is not certain how the homeowners out there really feel about this and whether they want to pay for the expense. Would the Town be responsible for maintaining the drainage ways. Jim DeGrood: He can't really speak to the responsibility, that would need to be looked at with legal staff. Certainly the Town does own the drainage ways and the Homeowner's Association would retain the 50 foot linear park from the edges of the dedicated drainage ways. Herb Kal: Will this impact the high flow when we do have a major storm, will the linear parkways impede the flow? Jim DeGrood: He doesn't believe it would compromise the embankment stability at all. What we propose to do is we would be protecting the slopes as they ramp down into the the channel floor. Richard Brown, 7204 W. Odyssey Way: He is currently the Chairperson for the Landscape Committee for the Homeowner's Association. Part of his responsibilities are the common areas that are suppose to be the linear parks in Continental Ranch. Currently the southside of these drainage ditches are also dedicated areas for walking paths. Richmond American has left them impassable, the grade has not been put back flat. Between Richmond American's Parcels 8 and 7, drainage ditch //7, on the south side of that drainge ditch there is suppose to be an access through there. You cannot go down that walking area, it's still full of construction debris had several other problems. He has tried to get Town staff out to look at it, he has never been contacted by them. He did have one Planner one day, but he had only an hour to take a look. Richmond American is sandbagging the Council, as far as letting them not have no responsibilites for these linear parks. When he went to buy in Continental Ranch he read the Specific Plan; he wants to know where these parks are. None of the developers out there have done anything except make it where it is inaccessible, Mayor Honea: What he is attempting to do at this stage is to cut as many of our losses and he can, and as many parcels that have not been built out require them to build a linear park and make it accessible. If we could get two or three pieces put in and Coventry puts their entire piece, that gives us less that we have to look at for the Town or Homeowner's Association to construct. If Coventry is going to put this in, they have about 60% of the linear park, and if we could get pieces, get two and three done to this specification, that leaves a lot less for either the Homeowner's Association or the Town. We will be consistent when we get the pieces tied together to make that a complete parkway ail the way down through. When Parcel 2 is built out will it be connected through the drainage way. Jim DeGrood: He doesn't know if that has really been identified at this point. Mayor Honea: That would consistently be from two through three and through the one drainge channel. Sharon Price: She doesn't object to the linear park going in, she objects to what is left to be maintained. If you get something in there that is more than the homeowners can afford to maintain, they have a cap on what their assessments can be raised each year. This has to be considered on this, there needs to be some input from the Homeowner's Association. Mayor Honea: If the park was built and the Homeowner's Association decided that they wouldn't maintain it, it wouldn't hurt anything, they just wouldn't maintain it. We have the opportunity to get the declarants and the prime developers to put in parcels of this park. Hur~ie Davis: His experience in dealing with parks in washes is if you take the washes and you try to put people in them for activities, and it rains up streams you get water running, how will people 5 get out of the wash if there is a storm; it will happen. Pima County is aware of the requirements in the Continental Ranch Specific Plan that the master developer is required to put in the linear park along the Santa Cruz. Sharon Price: The wash that runs behind her house takes on enough water to cover the vegetation and has white caps. Can we ask for an assurance on this that if the linear park goes in, after the homeowners have reviewed and had input in it, that then the owners be responsible. But at this point she is really hesitant about locking into this. We need to think about what's going in there as far as maintenance, we can't have the assessments going so high that people can't afford them. Ora Harn: She would like to hear what Mr. Flannery has to say on this issue. Jerry Flannery: The blue sheet was written about three weeks ago so obviously a lot of discussion has taken place since then. He has been talking to Mr. After. There may be a clause that we could potentially add to the assurance agreement for the project. It's in the preliminary plat stage and the assurance agreement would come in after that plat process has occurred and the final plat is in and the draft assurance comes in to the staff. We can have a clause added to that that the park will be constructed per the Specific Plan requirements and when 50% of the build out occurs on that property that the park be constructed. That way no final release of assurance could occur until such time as that the assurance agreement would hold those requirements. His recommendation would be that we go ahead and recommend approval for Parcel 3 tonight contingent upon the fact that the assurance agreement provide for the linear park and that it be added to the assurance agreement in the affect that it would comply with the Conhnental Ranch Specific Plan, He would also suggest maybe going and talking to the other individuals along the river, the Asociation Board, as well as the actual developers that have been developing along the river and maybe sit down with them and get some commitments, A motion was made by Ora Harn, seconded by Sharon Price and carried unanimously to approve Resolution No. 96-70 on the contingency that the developer works with Town staff to resolve the issue of the linear park in a way that would be satisfactory to the Town and to the residents of that community. RECESS D. Tangerine Road closure at railroad crossing - Southern Pacific*s request to close Tangerine Road at the Southern Pacific railroad crossing to upgrade the existing crossing. Hurvie Davis: This is a request by Southern Pacific to close Tangerine Road at the crossing of the railroad just east of 1-10. We wanted to bring this request to the Council and see what their desires are. Mr. Atler and his staff have been working with Southern Pacific on this issue. Dave Atler: Harvey Gill and other engineering staff have been working on this issue with Southern Pacific. Fairly recently they have agreed to do the work on the weekend but they would prefer the weekend of September 21st and 22nd. We don't have a problem with them doing it on that weekend. The main reason we want this done on a weekend is we're talking about a fairly major truck route on Tangerine Road. There is approximately a 15 mile detour to get around the closure. Hurvie Davis: He would like to commend Southern Pacific for their cooperation on these issues. A motion was made by Ora Harn, seconded by Tom Clark and carried unanimously to approve the Tangerine Road closure at the Southern Pacific Railroad Crossing on September 21 and 22, 1996 subject to the recommendations listed. E. General Plan Update - Discussion and Direction to CSC/Counts. Hurvie Day/s: We are in the process of updating the General Plan. Town's Planning Consultantt Jerry Flannery: Mr. Counts is here tonight to make a presentation. He is here to solicit comments and give Council some status reports on what has been going on. Rick Counts, CSC/Counts: Tomorrow there is a fairly intense schedule of interviews w/th major land owners, community leaders and staff. We are continuing our field observations. Tomorrow evening we will be with the Planning and Zoning Commission. Since he last reported they have completed a draft of the economic development element to go with the land use and circulation elements. These are now being or will soon be reviewed by the General Plan Advisory Committee. We have prepared an outline of the fourth element which should be completed within the next week or so and that is public facilities and services. Among the input that we have received, the Vice Mayor and other Council Members have attended some of our workshop sessions and given us good ideas. We are here tonight to receive any additional guidance that Council might want to give at this time. Tom Clark: He was called yesterday or the day before by Mr. Counts' associate that is coming down tomorrow. He hasn't had a chance to call him back, but he would like the opportunity to meet with him tomorrow when they are down from Phoenix. Rick Counts: That can be arranged. F. Ordinance No. 96.32; TEP/I-10 Annexation - Consideration for adoption of Ordinance No. 96.32 approving an annexation of an area approximately 70.01 acres and the resulting transition of County Zoning to Marana Zoning on property located near the intersection of Camino de Oeste and Ina Road, including portions of Section 6 of Township 13 South, Range 13 East, Section I in Township 13 South, Range 12 East and Section 36 of Township 12 Southt Range 12 East into the Town Limits. Jerry Flannery: We met with TEP officials and had a very fruitful discussion that had a direct lead to obtaining the signature for the annexation. He is very happy to come before Council with this item. We have worked on it a long time. One of the main goals here is to have a logical extension of the Town boundaries, this is a good extension. It also provides a good basis for future annexations to the north if it is the Town's desire. A motion was made by Ora Haru, seconded by Sharon Price and carried unanimously to approve Ordinance No. 96.32 for the annexation of approximately 70 acres located near the intersection of Camino de Oeste and Ina Road, including portions of Section 6 of Township 13 South, Range 13 East, Section 1 in Township 13 South, Range i2 East and Section 36 in Township 12 South, Range I2 East and the resulting transition of County Zoning to Marana Zoning as follows: 1. GR - 1 {Rural Residential) to R-36 {Residential) 2. SH - {Suburban Homestead) to R-36 {Residential) 3. CB-2 {General Business Zone) to VC {Village Commercial): and 4. CI-2 {General Industrial) to HI (Heavy lndustrial] G. Pima County Charter Government - Discussion Dan Hochuli: He was asked recently to research this item. Thomas Benavidez from his firm is here tonight. He did the research on this and can answer more specific questions. A Charter Government is essentially the constitution for a smaller government. There is the United States Constitution, the Arizona Constitution and then the City of Tucson is a charter city and they have the Tucson City Charter; this is essentially the constitution that rules the City, The City of Tucson can then pass laws but it cannot be in conflict with its City Charter or with the State Constitution or the Federal Constitution. In 1992 Arizona passed legislation that allowed Counties to form a charter if they wanted to. If the County successfully adopts the charter then Pima County would be a charter county, which means there would be a County Constitution that they can then act under. Right now the only powers a county has come from state laws. This November it will be submitted to the voters. The question on the ballot will be do you want to proceed with charter government and who do you want to vote as the charter drafting committee, the people that will draft the charter? If the voters say no we don't, want to proceed with charter, then it's done. If the people want to proceed then which ever of the candidates receives the most number of votes, the fifteen, then those fifteen will be on the drafting committee and they have a period of time to draft the charter. Then that proposed charter is submitted to the voters to see if the voters want to approve that charter. If they don't it goes back. Those fifteen are selected, three from each of the supervisory districts. There will be three people on the charter drafting committee from this district. Those people will be elected from this district. The concern that we had in our research is what effect is has on a municipal government. For the most part we don't know. Right now if the County passes ordinances, most of those ordinances will not affect the Town. A charter government gives a county direct power of taxation; clearly, that power of taxation does cross municipal boundaries. If the charter gives the County the authority to adopt a sales tax and the charter is adopted by the people, that sales tax will apply to the Town. His greater concern is to what extent will all the laws affect the Town; will every law that they pass affect thc residents of Marana. If the County Charter is drafted in a way to give it broad controls, there's a great chance that the County Charter will give the County more authority over local municipalities, especially non-charter municipalities. Mayor Houea: He has a concern with Pima County gaining control over some of the small entities such as annexation or water. He has also heard that Supervisor Grijalva had three people in each district that he was supporting to run. He doesn't want Raul Grijalva telling us what to do in Marana. His first impression about charter government is that it would be a disadvantage to a smaller municipality. There are a lot of serious problems that if this charter is drawn up it gives the County broad-based powers. We need to seriously look at getting someone to run from our community for one of these positions so that we would have someone on the inside. Ora Haru: There are a lot of people out there running for this Charter Government. Most people haven't the foggiest idea when you talk about Charter Government. Mayor Honea: We need to really seriously look at this and hopes everybody will read the information given to them. Dan Hochuli: When he called the League of Cities and Towns to try and get information about what they knew about County Charter Government, they said it hasn't really come up. He found that surprising when everywhere he looks the discussion and what people were talking about was what is its effect on local government. H, Mayor and Council's Report Mayor Honea: Council Member Millner, Mr. Davis, Mr. Hochuli, Sandy Groseclose and Jane Johnson went to the League of Cities and Towns. He thought it was a very rewarding experience, as it always is. We were able to talk to elected and senior officials from other municipalities that offer insight into different problems. Sherry Miilner: Council Member Millner, Council Member Ham, Mayor Honea and Hur'/le Davis had dinner with Mayor Miller, Shirley Scott and Janet Marcus from the Tucson City Council. Council Member Millner has been trying to set up different meetings between different towns and cities to get some communication lines open. She also made a few more contacts of towns that are interested in meeting with the Town of Marana. We had our 20th Anniversary Meeting on August 8, 1996, we had some really good ideas exchanged. Ora Ham: Council Member Harn has been drafted to help with the V.1.P. Breakfast again this year. Mayor Honea: The Chamber of Commerce has taken over Founder's Day. However, the Breakfast has been in the past the Mayor's Breakfast. He would like to expand it to be the Council's Breakfast. This list that is passed out is a list of people that have been invited in the past. We need to upgrade this list. I. Manager's Report Hurvie Davis: Friday August 16, 1996, Mr. Davis and Mr. Atler met with Paul Marsh, Chairman of the Board of Supervisors regarding flood control in the Marana area. When we ar~:lved at the meeting we found out that there were two Pima County Supervisors there with two senior staff members. The essence of the meeting was looking at the flooding problems along the Santa Cruz, particularly the northern end. The Chairman of the Board of Supervisors directed staff to come back to the Committee in December with findings and recommendations. He expressed that we didn't want to forget the section going through Marana with bank protection. We hope that the bank protection would proceed to be put in place and hopefully the river will be cleaned out and maintained. Last Tuesday at Noon he spoke at the Southern Arizona Architects and Engineers Marketing Association meeting. They did a video and Mr. Davis did a promo on thc Town. It will be a good opportunity for the Town to get exposure. Mayor Honea: The Water Committee also met this afternoon. The Board of CMID has passed a Memorandum Of Understanding to the Town. We went through it and he believes we are there, he thinks it will go this time. X. FUTURE AGENDA ITEMS Sherry Millner: She would like to take a look at the Sign Code in reference to political signs. Also with Founder's Day coming up she thought it would be nice to get a status report on how things are going. Back in August of 1993, we asked the Chamber for a quarterly financial report: she has never seen one. She would like to see those turned in so the Council can see how things are coming along. Hurvie Davis: The Chamber sends a report on economic development and so forth, but he has not seen a financial report. XI.
