APPROVAL OF AGENDA A motion was made by Ed Honea, seconded by Sharon Price and carried unanimously to approve the agenda as read. VI. APPROVAL OF MINUTES Continued until October 4, 1994. VII. PETITIONS AND COMMENTS 1. Shari Kelly, 14299 N. Wentz Rd.: She thanked Council Members Tom Clark and Herb Kal for his effort in trying to bring the MTC issue to a public headng. 2. Phyllis Farenga, 11470 W. Tortolita, Marana: she agreed with Ms. Kelly, called for a public hearing on the MTC treatment center and suggested that most of the Council was not competent. Billy Schisler, 12561 N. White Ave., Marana: He suggested that the Council look into problems on Moore Rd. and hoped that water services could be improved. Mr. Schisler also suggested that the Council make some compromises on the MTC treatment center issue, and he thought that 18-wheel trucks in residential neighborhoods should be prohibited. Dorothy Sharnetsky, Commissioner, Marana Planning and Zoning Commission, 5151 W. Tangerine Rd., Tucson, AZ, 85741: She spoke on Vision Communications, Inc.'s [KOLD-TV channel 13] bid to have the Marana advedising tax removed and suggested that potential business be informed about taxes. _A. Marana Foundem Day. Vice Mayor Sharon Pdce noted that there will be a Founders Day rodeo near the frontage mad between the Avra Valley exit from Interstate 10 and the Co,tam Rd. exit on November 12 and 13, 1994. Celebrations will continue for four days, from November 10-13, 1994, and there will be a parade. She called for volunteers. VII__I. ANNOUNCEMENTS None. IX. GE_NEPAL ORDER OF BUSINESS Public He_a. rin_o And Council Action - The Town Council Will Consider A Reouest To Rezone AnDroximately 24,_2 Acre~ To MR-2 (Multi-Family) And 82.8 Acres To R-6 (Residential. 6.000 Souam Feet Minimum Lot Size). Lo(;ated Generally At The Northwest Corner Of Hartman And Cortaro Roads. Also Known As "Old Shamrock Dairy". Adoetion Of Ordinance #94.14. A motion was made by Ed Honea, seconded by Tom Clark and carded unanimously to go into public hearing. Town Manager Hurvie Davis suggested that Planning Administrator Gerald Flannery speak, followed by the Applicant, Carl Winters. Planning Administrator Gerald Flannery gave a summary, noted that the Planning and Zoning Commission had concerns about soil, archaeology sites, open space and traffic. Carl Winters, Winters & Associates, 220 N. Church, Tucson: He gave a presentation, described the proposed development and the changes that were specified by the Planning Commission. Public Comments: 1. Billy Schisler, 12561 N. White Ave, Marana: He was concerned about the soil clean-up and thought that the traffic improvements should be paid by the developer. 2. Josephine Henry, 8550 N. Hartman Ln., Tucson: She opposed the development and was concerned about police an school services. The density of the development should be lower. 3. Gil Rice, 8940 N. Hartman Ln., Tucson: Opposed to the development. 4. Gayle Tracey-Moroni, 5300 W. Calle Paint, Tucson, 85714: Opposed to the development. 5. Donna Fultz, 5210 W. Calle Appaloosa, Tucson, 85741: Opposed the development. 6. Paul Evan, 5424 W. Calle Maverick, Tucson: Opposed to the development. 7. Jeanelle Milner, 5424 W. Calle Maverick, Tucson: Opposed the development. 8. Kathy Thompson, 5120 W. Calle Appaloosa, Tucson: Opposed the development- drainage problems. 9. Nell McHugh, 8510 N. Freeman, Tucson, 85741: Opposed the development for historical preservation. t0. John Martin, 8301 N. Cerius Straw, Tucson: Opposed the development. Carl Winters responded to the Public Comments and answered questions with contributions by Staff and members of the public. He offered to meet with concerned citizens some time before the second Council meeting A motion was made by Tom Clark, seconded by Helen Key and carded unanimously to come out of public hearing. A motion was made by Helen Key, seconded by Betty Horrigan and carded 8-1 with Mayor Ham voting no, to continue this Item to the second meeting in October. Recess. Time: 8:35 P.M. Back in session. All Council Members present. Time: 8:53 P.M. Public Hearing - The Council Will Hear Public Comments On A Reauest To Annex Three Parcels Of Rep! Property Located At Or Near The Intersection Of Linda Vista Blvd. And Blue Bonnet Rd.. Contained In The Southeastern Quarter Of Section 14. Townshie 12 South. Range 12 East, A motion was made by Tom Clark seconded by Sharon Price and carded unanimously to come into Public Hearing on A Request To Annex Three Pamers Of Real Property Located At Or Near The Intersection Of Linda Vista Blvd. And Blue Bonnet Rd., Contained In The Southeastern Quarter Of Section 14, Township 12 South, Range 12 East. Hurvie Davis introduced the Item. Gerald Flannery addressed the Council and gave an overview. Carl Schroeder, 3036 N Dodge, Tucson, representing the property owners, addressed the Council and explained the reasons for the annex petition. Public Comments: 1. Billy Schisler, 12561 N. White Ave, Marena: The benefits of this annexation should be determined timt. 2. Thorie Rode, 9876 N Langford Dr., Tucson: Opposed the annexation. 3. Katherine Temple, 9811 Stone Creek Pr., Tucson: Opposed the annexation for several reasons. 4. Nancy Jane Henson, 6011 W. Oasis Rd, Tucson: Opposed the annexation. 5. Loren Beatty, 9819 N. Langford Dr., Tucson: Opposed the annexation. 6. Patty Miller, 10255 N. St. Patrick, Tucson: Opposed the annexation. 7. Rand Quimby, 9923 N. Langford St., Tucson: Opposed the annexation. Town Attorney Dan Hochuli answered a question as to when this matter would be put to a vote, stated the order of operations for an annexation. First is the public hearing, then the petition, then the vote. Carl Schroeder stated how the application process was done, including the notification of nearby residents and responded to the public comments, then answered questions from the Council. Ed Honea stated that he saw no benefit to annexation. Tom Clark stated he would not support any annexation. Betty Horrigan, Helen Key and Sharon Price stated that they do not support the annexation. Irving B. Jones, 9836 N. Stone Creek PI., Tucson: He responded to Mr. Schroeder's statements. Nancy Jane Henson, 6011 W. Oasis Rd., Tucson: She thanked Mr. Schroeder for helping bring the community together-- in opposition to the annexation. A motion was made by Herb Kal, seconded by Ed Honea and carried unanimously to come out of public hearing. C. Marana Cotton Rotary Club Is Reouesting The Use Of The Town Of Marana's Logo On Their Banner. Mayor Ham stated that she put this item on the agenda and gave an overview of the request and recommended approval. Dorothy Shametsky, 5151 W. Tangerine Rd., Tucson: She stated that she was speaking for fourteen people and they all decided that if the Town of Marena logo is to be handed out to one organization, it should be handed out to all. The logo should remain for official use only. Sharon Price stated that she did not want the logo to be modified in any way. Ed Honea stated that he supported publicity for the Town and he agreed with Sharon Price. MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL SEPTEMBER 20, 1994 A motion was made by Helen Key, seconded by Ed Honea and carded unanimously to grant Marana Cotton Rotary Club permission to use the Marana Town logo in its pure form on the banner, in colors of copper and turquoise. Northwest Tucson Active Manaaement Area Reelenishment Proaram. Discussion And Adoetion Of Re I 'on #94-2 . Hurvie Davis addressed the Councir and introduced Brad DeSpain. Brad DeSpain introduced Grant Ward, Assistant General Manager of Planning and Environment for the Central Arizona Water Conservation Distnct (CAGRD). Grant Ward addressed the Council and gave a detailed description of the Replenishment Program and answered questions. A motion was made by Helen Key, seconded by Tom Clark and carried unanimously to adopt Resolution 94-25 in support of the replenishment program. E. Title 17 Air Quality Control, Pima County Department Of Environmental Quality Steve Burr addressed the Council and answered questions. Council directed staff to send a letter to Pima County Board of Supervisors in support of Title 17. Modification To The Marana Business License Regulations. Sunqested Bv The Marana Business Advisory Committee. A motion was made by Betty Horrigan, seconded by Helen Key and carried unanimously to reactivate Business License Committee and appoint several members from the Business Advisory Committee to study the issue and report back to the Council. The Greater Marana/Avra Valley Chamber Of Commerce Is Reauestine Aneroval From The Mayor And Council For A Seecial Liquor Permit For The Marana Founders Day Rodeo And Dance To Be Held November 12And 13. 1994, A motion was made by Ed Honea, seconded by Betty Horrigan and carded unanimously to approve the Greater Marana/Avra Valley Chamber of Commerce request for a Special Liquor Permit for November 12 and 13, 1994, at the Marana Founders Day Rodeo and Dance. H. Reschedulinn October 18. 1994. And May 16. 1995. Council Meetines To Another Date Due To Conflicts On Those Dates. A motion was made by Ed Honea, seconded by Betty Horrigan and carded unanimously to reschedule the October 18, 1994 meeting to October 17, 1994, and the May 16, 1995 meeting to May 23, 1995. Intergovernmental Agreement With The Arizona Denartment Of Transoortation On Federally Funded RQ{!d Way Pro_iects. Aeeroval - Adoption Of Resolution 94-26. Action. A motion was made by Sharon Price, seconded by Ed Honea and carried unanimously to approve Resolution 94-26 authorizing ADOT to serve as agent for the Town on Federally funded roadway, bridge and railroad crossing projects. Executive Session Pursuant To A.R.S. §38-431.03~A}~4) For Discussion And Consultation With The Town Attorney. To Consider Its Position And Instruct Its Attorney Regarding Marana's Position In Tax Cases. (t) Lil' Abner's Steakhouse. {2) Miles Label Co.. Inc. A motion was made by Betty Horrigan, seconded by Ed Honea and carried unanimously to enter into executive session Pursuant To AR.S. §38-431.03(A)(4) For Discussion And Consultation With The Town Attomey, To Consider Its Position And Instruct Its Attorney Regarding Marana's Position In Tax Cases, (1) Lil' Abner's Steakhouse, (2) Miles Label Co., Inc.
