A motion was made by Ed Honea, seconded by Betty Horrigan and carded unanimously to approve the minutes of Special
meeting, August 1, Special Meeting August 2, Regular Meeting August 2, Special Meeting August 12', and Regular Meeting
August 16.
VII. PETITIONS AND COMMENTS.
Thomas A. Clark, 11599 W. Bamett, Marena: speaking as a citizen and as a Council member, he urged the Coundl te
vote to protest the significant land use change by MTC (Management & Treining Corp.) in order to have a Public Headng
on the Community Treatment Facility.

VIlli. ANNOUNCEMENTS.
A. Introduction of New Employees.
Police Chief Dave Smith introduced his new porice officers: Larry Ybarm, DARE officer, Terry Evans, Andy Lopez,
Margie Lusk, Lupe Baviche, Richard Salazar and Richard Vidaurri.
Lan'y Ybarra spoke on the DARE program, handed out gifts.
Town Manager Hurvie Davis noted public comments praising the Marana P.D.
B. Marana Founders Day.
Ed Honea stated that the Founders Day Committee needs a lot of volunteers.
C. Presentation Of Flaq To The Town Of Marana By Ray Guitard - Representinq Woodman Of The World.
Ray Guitard, Woodman of the Wodd: He introduced his organization and presented a flag to the Town.

IX. GENERAL ORDER OF BUSINESS
A. Public Headn,q And Council Action - it Is Proposed To The Council By Staff That A New Title 22 Be Added To The
Marana Land Development Code, Settinq Forth Wall And Barrier Heiqhts And Requirements Surroundinq
Swimminq Pools And Spas. Discussion/Action
Town Manager Hurvie Davis gave an overview of this Item, stated that the Town Attorney is preparing the new Title 22 in
order to address residential swimming pool safety issues. He suggested that the Council defer this Item until there is a
comprete swimming pool ordinance in place, in the meantime, the State of Arizona code for swimming poor wall height,
which sets the height at five feet, is a good guideline to follow. Surrounding communities in Pima County tend to follow the
five foot restriction anyway.
Helen Key asked if the State cede referred to walls, literally, or does it include fences. Dan Hochuli answered that State
law requires a five-foot wall, fence or other barder. Ed Honea asked if State law requires a five-foot wall, then how con a
town require anything less. Dan Hochuli answered that there are situations where walls less than five feet tall are
possible.
1. Lonnie Sharp, 5294 W. Hematite Pl.: He asked if the Council could approve four-foot walls. Dan Hochuli answered that
the Town could make its own pool code, however the Town connot require less than what State law allows.
Tom Clark asked about fence rails and posts and how children could fit between the separations. Dan Hochuli
answered that State law requires separations of four inches or less.
_B. Crime Prevention Leaque - Unda Morse Of The Crime Prevention Leaque Will Be Givin,q A Presentation On What
The Crime Prevention League Does And How Citizens Can Help The Leaq,-~
Linda Morse, acting on an invitation by Police Chief Dave Smith, addressed the Council and described the Cdme
Prevention League and explained what the League does. One creation by the League is the Graffiti Abatement Program.
The Program collects used latex water-based paint and uses the paint to cover up graffiti. The Program in Tucson hired
homeress people to help remove graffiti. The Program can be mobilized through the Graffiti Hotline [624-7833, 8 A.M - 5
P.M.] and a clean-up team quickly dispatched. The Graffiti Abatement Program will clean up overpasses and bddges,
birlboards and posts. The Program also gets the assistance of juveniles, who may be former graffiti artists themselves.
The Program encourages neighborhood groups to participate in graffiti removal in their own neighborhoods. The Program
welcomes donations.
Helen Key asked about the most useful method for crime prevention. Linda Morse answered that building censortiums of
many organizations and agencies is the best method.

C. Resolution No. 94-23 & Ordinance 94.12 - Staff Is Proposin,q Passage Of Both Resolution 94-23 And Ordinance
94.'12 Which Creates A Parking Ordinance Requlatin,q The Parkinq Of Vehicles Within The Town Emits Of The
Town Of Marana, Includin.q The Reflulation Of Handicapped Parkinq. The Ordinance Also Deals With Civil
Penalties For Violations, To Be Prosecuted And Adjudicated In The Marana Municipal Court.
Dan Hochuli addressed the Council, gave an overview of the parking Ordinance, stated that vafious codes from nearby
jurisdictions have been adapted. Parking enforcement has become a problem in the Ina-Thomydale annexation area.
and the Marana Porice Department has requested something be done.
Tom Clark noted in the Parking Ordinance on page Two of Three, Section 5 item B, the word "prosection" and inquired if
that was a word, or was it supposed to be "prosecution". Dan Hochuli answered that his office's Word Perfect spell-
checking software did not note the word "prosection" as a misspelling, however, the Town Attorney humbly admitted that
"prosecution" was the correct word. Tom Clark noted on page Three of Three, item F that allowed the Police Chief to
delegate parking enforcement officers from the general public, such as senior citizen volunteers.
A motion was made by Herb Kal, seconded by Betty Horrtgan and camed unanimously to approve Resolution 94-23
and Ordinance 94.12 creating Parking Regulations in the Town of Marana.
Executive Session - Pursuant To A.R.S Section 38-431.03(A)(7) And 38-431.03(A)(4) For Discussion And
Consultation With The Town Attorney And Designated Representatives In Order To Consider Its Position And
Instruct Its Representatives And Attomeys Regardin.q Ne.qotiations And/Or Condemnation Of Real Property
Near The Intersection Of Thomydale Road And Horizon Hills Construction Of Roadway And Traffic Liqht.
A motion was made by Ed Honea, seconded by Tom Clark and carded unanimously to enter into Executive Session -
Pursuant To A.R.S Section 38-431.03(A)(7) And 38-431.03(A)(4) For Discussion And Consultation With The Town
Attomey And Designated Representatives In Order To Consider Its Position And Instruct Its Representatives And
Attorneys Regarding Negotiations And/Or Condemnation Of Real Property Near The Intersection Of Thomydale Road
And Hodzon Hills Construction Of Roadway And Traffic Light. Time: 8:05 P.M.

E. Tanqedne Road Improvement~ Interstate '10 To Breakers Road~ Desi,qn, Ri.qhts Of Way And Construction, Status
Of Project. Discussion/Action.
Hurvle Davis addressed the Council, gave an overview of the Item, He noted that the length of the project would be 1.75
mires and the cost of the project would be $758,000. However, obtaining a right-of-way would be necessary.
Council and Staff discussed the details of the project.
A motion was made by Helen Key, seconded by Tom Clark and carded to authorize Staff to acquire the needed fight of
way for Tangerine Road by purchase, gift, donation, trade or condemnation as shown on the roadway plans.
F. Extension Of Horizon Hills Drive - Desiqn, Rights Of Way And Construction Of Extension Of Horizon Hills Drive At
Thomydale Road - Presentation On Status Of The Proiect And Authorization To Proceed. Discussion/Action.
Hurvie Davis gave an overview of the item.
A motion was made by Ed Honea, seconded by Helen Key and carded unanimously for the Town Council to authorize
Staff to proceed with the design, dght of way acquisition (by pumhase, donation, gift or condemnation) and construction of
the Hodzon Hills Dfive/Loop Roadway as identified in the approved Pre-Annexation and Development Agreement.

_G. Abandonment Of Wade Road - Because Of The Reali_~nment Of Wade Road. Several Of The Abu~incj Property
Owners Have Asked That The Town Abandon Wade Road Between The New Wade Road Alinnment And
Silverbell Road.
Hurvie Davis gave an overview of the item and Town Engineer Mick Mathieu gave additional information.
A motion was made by Tom Clark, seconded by Betty Horrigan and carried unanimously that Wade Road between the
new Wade Road alignment and Sirverbell Road is no longer needed and that Staff is authorized to post notices that an
application for abandonment of the right-of-way has been submitted and notices posted along the subject right-of-way for
sixty (60) days,
H. Marana Fraternal Order Of Police Request For Monthly Meetings - Marana Fraternal Order Of Police {FOP) Lodge
65 Is Requestinq The Town Council Authorize Regular Monthly Meetings With The Town To Establish A Line Of
Communication Between The Town Council. Town Manauer. Police Chief And Officers Of The Marana Fraternal
Order Of Police.
A motion was made by Ed Honea, seconded by Betty Horrigan and carried unanimously to send a letter stating that
the [Town of Marana does not recognize the FOP as a bdefing entity and it would be in direct opposition of the Towns
Personnel Policy]
!. Lease Of Soace For Town Hall Annex/Police Substation - Request For Council Approval To Authorize The Town
Manager To Execute A Lease For Space At The Oranae Grove Mercado For The Town Hall Annex/Police
Substation. Discussion/Action.
A motion was made by Helen Key, seconded by Herb Kal and carried unanimously to authorize the Town Manager to
execute a [ease for space at the Orange Grove Mercado for $6.50 per square foot or the lowest agreeable price to be
occupied by the Police Department for a substation and a Town Hall Annex.
A motion was made by Ed Honea, seconded by Betty Horrigan and carried unanimously to amend the previous motion
to read "or up to 5% escallator l'

_Pride In Its Communitv- Mayor Ora Harn Will Be Presenting Her Ideas At The Town's Booth. Discussion/Action.
A motion was made by Ed Honea, seconded by Betty Horrigan and carried unanimously to approve a booth, a banner
with the Town logo at $100.00, and 1995 Pocket Pal Organizers not to exceed $800.00.
_K. Co-Sponsorship Of Resolution - The Town of Fountain Hills And City_ Of Sedona Are Snonsoring A Resolution To
Urge The Legislature To Consider Chanues To The Recall Process Dealinu With Signature Requirements.
A motion was made by Helen Key, seconded by Ed Honea and failed 3 to 3 to co-sponsor Resolution #11 supporting
the Town of Fountain Hills and the City of Sedona urging the Legislature to consider changes to the recall process
dealing with signature requirements.

_Amendment To The Town Personnel Policy Which Would Add Family Medical Leave To The Town Personnel
Policy. Discussion/Action - Resolution No. 94-24 And Ordinance No. 94.13.
A motion was made by Tom Clark, seconded by Ed Honea and carried unanimously to approve the Family and Medical
Leave ^ct Po[icy and that it be added to the Town of Marana Personnel Policy Manual and that copies of the policy be
distributed to all employees or Ordinance 94.13 and Resolution 94-24 adopting Family Medical Leave ACt to the Town of
Marana Personnel Policy Manual.
