APPROVAL OF AGENDA A motion was made by Ed Honea, seconded by Betty Horrigan and carried unanimously to approve the agenda with the change that Public Hearings Items X-A and B and Order of Business Items XI-B and C to follow Order of Business Item XI-G. VI. APPROVAL OF MINUTES A. Regular Minutes. May 3. 1994. A motion was made by Herb Kai, seconded by Tom Clark and carried unanimously to approve the minutes of May 3, 1994~ VII. PETITIONS AND COMMENTS 1. Alan Lathrem, 1750 W. Tangerine, Pima Co.: He spoke on Open Meeting law and Planning & Zoning meetings. 2. Roger Cordts, 2440 W. Glover Rd.: On development encroachment into the NW Tucson area. 3. Kitty Wong, 11600 N Sanders, PO Box 463, Marana: On the MTC prison and on important items that appear without VIII. Valley Of The Sun - Request For Extension Gerald Todd, 13377 N. Sandario Rd., representing Jack White, Owner: He asked for an extension to the waiver to use mobile home lots to park RV's in. A motion was made by Ed Honea, seconded by Betty Horrigan and carried 5 to 1, with Tom Clark voting no, to direct Staff to process the request for an extension of time for the use of RV's in the Valley of the Sun Mobile Home Park forward fi.om June 1, 1994, to December 31, 1995, conditional to a new Significant Land Use Change. D_D_. General Plan Update Gerald Flannery gave a summary, said that revising the plan is a high-priority item. Helen Key inquired about using a professional service to prepare the General Plan. Gerald Flannery answered that it is a possibility. Staffwill gather and present information for producing a revised General Plan with other plans at a future Council Meeting. E. Fire Protection Alternatives For Town Of Marana - Status / Discussion Hurvie Davis gave a summary, said that there are two proposals for providing fire service. This was discussed at the last Retreat. Mayor Harn stated that Avra Valley provided a third proposal. Staffwill gather and present information for fire protection alternatives at a future Council Meeting. F. Space Needs For Town Hall And Other Town Activities Hurvie Davis gave a summary of the status of the Town's need for additional office space in all departments. Tom Clark suggested that a modular building be put up next to the Town Hall. State Of Arizona / MTC Community_ Treatment Facility Undate / Intergovernmental Agreement With Arizona Department Of Corrections Dan Hochuli gave a summary of the agreement that he is preparing for a future Council Meeting. Ed Honea stated his objection to the revised proposed name of the facility. Helen Key acknowledged that the sign on the building should state that the facility is a Dept. of Corrections (DOC) facility. Tom Clark supported the original name for the facility. Dan Hochuli agreed to take the Agreement and the statements of the Council to the DOC. X. PUBLI H S _A. Proposal For A Variance To Marana's Village Commercial (VCI Zone As It Relates To Minimum Lot Size. Located At The Northwest Corner Of Ina Road And Meredith Blvd. A motion was made by Ed Honea, seconded by Tom Clark and carried unanimously to go into Public Hearing. Time: 8:21 P.M. Carl Winters, representing the developer, 270 N. Church: He stated he would like this item continued until the zoning matter comes to the Council due to a petition from area residents. He provided a summary. 1. Paula Baca, 3645 W. Gailey Dr., Tucson: Stated that traffic is a big problem in the area. 2. Elaine de Lucia, 3640 W. Rudolf Dr.: Stated that traffic has grown to a big problem. 3. DeborahButtram, 3701 W. RudolfDr.: Stated that traffic in the area is bad and is disturbing. Accidant danger is high. 4. Maureen Figueredo, 3671 W. Galley Dr.: The proposed development and zoning is wrong for the area. 5. Brenda Johnson: 3630 W, Rudolf Dr.: Traffic in the area should be better controlled. 6. John Moore, 3649 W. Rudolf Dr.: Stated that the Council should consider safety, security and traffic concerns. 7. Robert Catrambone, 3605 W. Rudolf Dr.: Traffic is a danger and will get worse. 8. Mark Shupe, 3601 W. Rudolf Dr,: The development will create more traffic hazards. 9. Jana Read, Director, Kindemare, 8146 N. Wheaffield Dr., Tucson: Stated that the situation should be studied further. A motion was made by Ed Honea, seconded by Helen Key and carried unanimously to come out of Public Hearing on Item X- A. B. Proposal To Rezone Annroximatelv 344 Acres To R-6 (Residential. 6000 Sq. Ft.), 10 Acres To MR-I (Multi-family Residential). 31 Acres To VC (Village Commercial) Zones. Located At The Southwest Corner Of Tangerine Road And Thornydale Road A motion was made by Tom Clark, seconded by Betty Horrigan and carried unanimously to go into Public Hearing on Item Recess. Time: 8:50 P.M. Back in session. All Council Members present. Time: 9:10P.M. Carl Winters, representlng owner, New World Homes: He summarized the Item and addressed past concerns. 1. Tate Wyly, 4847 W. Can~ino de Maaana: Supported 1-RAC with 50' setback and stated animals and vegetation should be protected. 2. Larry O'Day, 4761 W. Camino de Manana: Supported 1-RAC with a buffer zone and 50' setback with mainta'med roads. 3. Ron Olding, wildlife biologist, 10651 N. Oldfather Rd.: Supported the protection of native wildlife. There should be further study before a decision is made. 4. Tim Blowers, 13951 N. Como: He conducted a survey of the audience. The Council should respond to the will of the people. Mayor Harn noted that there were five or six Marana residents in the audience. 5. Pennie Gillette, 13425 N. Lindberg Dr.: She had concerns about police, crime and population density. 6. Pat Murray, 3230 W. Hardy Rd.: She had concerns about plans for a school site in the development. 7. Scott Mundell, 7733 Redwing Cir., representing Marana Unified School District: He responded to a question from Ms. Murray. 8. Lisa Logan, 4661 W. Camino de Manana: Development should be reconsidered, that wildlife should be considered, 9. LyallPacheco, ll000N. GilaRd.: High density will destroy the quality oflife in the area. 10. Neale Allen, 3530 W. Saguaro Divide: High density will impact on the environment. 11. Kathy Temple, 9811 Stone Creek PI: Slow down growth. 12. Donna Pacheco, 11000 N. Gila Rd.: Plan carefully, slow down growth. 13. Barbara Craig, 2600 W. Limewood Rd: There should be a comprehensive plan for the area. 14. Joan Eerkes, 12651 N. Como Dr.: High density development causes problems and impacts on children. 15. Daniel P. Dolata, President, Lambert - Naranja Homeowners Association, 10500 N. Oldfather: Marana should plan. 16. Lan Lester, 12951 N. King Air: High density means the need for schools and other services that all cost money. 17. Maria Iannone, 10707 N. Camino Central: Grading and revegetation cannot preserve the desert environment. 18. Mary Mundahl-New, 10650 N. Oldfather: Preserve the unique Sonoran Desert, 19. Lily Tea Bash, 327 E. Mabel St,: Don't destroy the desert. 20. Patrick Wallinger, 13579 N. Como Dr.: Approval will open the door to other developers. 21. David Sugar, 35515 S. Estancia, Marana: Preserve the desert before it is gone. 22. Billy W. Schisler, 12561 N. White: Marana does have a plan. 23. Run Wyckmans, 3680 W. Potvin Ln.: The rezone will impact on everyone in and near it. 24. Georgia Acker, 11471 W. Grier Rd.: Aga'mst rezone. 25. Jeff New, 10650 N. Oldfather: This development will increase flooding danger. 26. Don Froning, 10888 N. Paisano: The development is not good for the area. 27. Karen Swarthout, 2756 W. St. TropazAve.: Con. 28. Loren Loftin, 4747 Camino de Manana: Higher density should be phased in gradually. 29. Alan Lathrem, 1750 W. Tangerine Rd.: The development is bad for the area. 30. Joe Lachowicz, 5000 Camino de Manana: Con. 31. Dorita Brady, 1885 W. Limewood: Con. 32. Mary Ann Redmond, 10981 N. Camino de Oeste: Con. 33. Lisa Cheekon, 2246 E. Grant Rd.: Con. A motion was made by Helen Key, seconded by Betty Horrigan and carried unanimously to come out of Public Hearing on Item X-B. X~I. - B. Proposal For A Variance To Marana's Village Commercial (VC) Zone AS It Relates To Minimum Lot Size. Located At The Northwest Corner Of Ina Road And Meredith Blvd. Jerry Flannery stated that the Applicant wants this Item to be continued. Carl Winters, representing the Applicant, concurred. X._!I. - C. Pronosal To Rezone Approximately 344 Acres To R-6 (Residential. 6000 Sa_. Ft.), 10 Acres To MR-I (Multi-family Residential). 31 Acres To V~ (Village CommerciaB Zones. Located At The Southwest Corner Of Tangerine Road And Thornvdale Road Carl Winters responded to the comments of the Public Hearing on this Item. Jerry Flannery read the Planning Commission's recommendations on this Item from P&Z Resolution 94-09. Ed Honea suggested a 600' zone around the property line R-36 with 1-2 RAC to act as a buffer. R-6 is not acceptable, nor is 3.3 Ranch (1 house for 3.3 acres). MR-I should be R-8 with no apartments. The VC zone should be R-8. That would cut down on the housing density and population. Tom Clark inquired about hydrology studies and sheet flooding. Carl Winters responded. Betty Horrigan asked about the water system. Carl Winters stated that water will come from Tucson Water. Herb Kai asked about Mr. Hunea's proposed R-8 zoning. The Council discussed the Item and questioned Carl Winters and Staff. Terry Klinger, 5055 E. Broadway: He commented on the proposed buffer, had no objections. He suggested variable lot sizes, R-6 to R-8, or more. Loren Loftin (speaker #28, above): He responded to Mr. Klinger on the zoning of the buffer. Lisa Logan (speaker #8, above): She responded to Mr. Klinger, stated large lots (greater than R-8) are preferable and practical. A motion was made by Ed Honea, seconded by Betty Horrigan that there be a 600 ff parallel R-36 zoning on del Norte and De Oeste (600 ft from the property line) the west and south side. The COMMERCIAL ZONING south of Marana be R-8 and MR-i APARTMENT ZONING be changed to R-8 and all the R-6 ZONING be changed to R-8. Basically we have COMMERCIAL north of Maraga, balance of property be R-8 with the exception of 600 ff parallel corridors on the south and west side. Mandated at least 10 acres be given to the Marana School District for an elementhry school and that property be signed over prior to any building permits being issued. R-8 ZONING should be listed as 3 Rack and be part of the Ordinance Recess for the Town Attorney to prepare the Ordinance for the Council to vote on. Time: 12:07 A.M. Back in session. All Council Members present. Time: 12:20 A.M. Ed Honea rescinded his motion, seconded by Betty Horrigan and carried unanimously. A motion was made by Ed Honea, seconded by Betty Horrigan and carried 4 - 2 with Helen Key and Tom Clark voting No, to adopt Ordinance 94.07. Dan Hoehuli read the revised Ordinance in full.
