A motion was made by Ed Honea, seconded by Tom Clark and can'ied unanimously to approve

A motion was made by Ed Honea, seconded by Betty Horrigan and carried unanimously to
amend the Agenda motion, by moving Public Hearing Item IX-D to come before IX-A, to drop
Public Hearing Item IX-C as it is inappropriate and move Item XI-F to follow IX-D.

Marana.

Mayor Ora Ham presented a Certificate of Appreciation to Mr. & Mrs. Kelly for their donation to

l~. Rezoning Of Property. Located South Of Tangerine Road. East Of I-!0 And West Of

Family Residential.
A motion was made by Ed Honea, seconded by Tom Clark and carried unanimously to enter into
Public Hearing on Item IX-A Rezoning of Property Located South Of Tangerine Road, East Of 1-
10 And West Of Thomydale From "C" to "VC" Village Commercial, MF~I Multi-Family and R-6
Single Family Residential.
Gerald Flannery gave summary, noted that Staff received several calls of objection to the proposal
and residents and project representatives are present.
(#1) Carl Winters, Winters & Associates, 270 N. Church Ave. Tucson, representing New
World Development: Referred to map, pointed out the 511 acres of the Tangerine - Thornydale
area and the zoning for that 511 acres. One part is for commercial, another is for apartments, and
the rest is for housing. He spoke of past and present Marana zoning schemes. Explained what a
"significant land use change" is, that New World is asking for a rezone and not a land use change.
Said the Zoning Conunission would allow no more than 4 units per acre (4-RAC). He compared
local and regional General Plans for the area to the New World proposal. There is a 15" sewer line
down Camino de Oeste to the treatment plant; it has the capacity for the development. Everyone
within 600' of the proposed development area was notified.
A member of the audience complained that Mr. Winters has exceeded his 5 minutes. Mayor Ora
Ham explained that Mr, Winters is making a presentation and not expressing an opinion.
Mr. Winters concluded, explaining that Marana has strict landscape regulations and New World
would comply with them.

(#2) Joe Lachowicz, 5000 Camino de Manana, Tucson, AZ 85741: He lives near the proposed
development area and said that he is concemed that the lush desert vegetation will be destroyed like
a previous New World Homes development on Thomydale. This is a matter of quality of life. The
housing density of the area affects that quality. The proposed development is not appropriate.
(#3) Janice Mitich, 11115 W. Anthony Dr., Tucson, AZ 85743, on Marana Governing Board:
She said that if the proposed development goes through, the increase in population would require
an additional four elementary schools and one junior high school. Currently, there are only funds
for one elementary school. Funding is based on the previous year*s attendance. She suggested that
the sites for the schools be donated by New World. Mayor Ora Harn wondered whether Ms.
Mitich was speaking for the Board or as an individual, Ms. Mitich said she was speaking as an
individual Board Member.
(g4) Tim Blowers, 15951 N. Como Rd., Tortolita Mountain Homeowners Association: Lives
two miles from proposed development area. He said that he is for larger lots with more
preservation of natural vegetation. He suggested that the proposal go back the Zoning Commission
or even that the proposal be withdrawn. He is not sure that there is sufficient sewer capacity.
(#5) Paul Larson, 8750 N. Moison Dr.: As a resident near the proposed development, he said
that he did a plant count of the area and calculated the total population there to be 281,000. 21,000
were greater than 4" in diameter and 9000 mesquites, 8400 ironwoods, 23,000 palo verdes, 12,700
saguaros. Given the plant diversity and density in the Tangerine - Thomydale area, 4-RAC on the
511 acres would make it impossible to preserve or relocate such a large quantity of vegetation.
(#6) Dave Wibel, 11071 N. Paisano: Lives near the proposed development. Said that when he
moved onto his property, housing density was at a minimum 0.303-RAC, or one house for every
3.3 acres. 4-RAC is incomprehensible. Development housing is bad for property values; there is
crime. He said that he would support any recall effort in order to stop the New World development.

(#7) Daniel P. Dolata, 10500 N. Oldfather, Tucson, AZ 85741, President, Lambert - Naranja
Homeowners Association: Said that the Association voted to request that thc New World
proposal be sent back to the Planning Commission because there was insufficient public input. Not
everyone in the proposed development area was notified. Also, he said that "leapfrog"
development was taking place, where entire chunks of undeveloped land near past developments
were bypassed, sometimes by several miles, and isolated undeveloped land, such as the Tangerine -
Thomydale area, was targeted for construction. The proposal is contrary to the development style
of the area (0.303-RAC), and it is in violation of Title 20 of the Marana Native Plant Code. And on
a more practical level, it would place a huge financial burden on Marana to provide public services
to such a large development. Also, the State of Arizona does not plan to substantially improve the
Tangerine and Thomydale transportation corridors for about 20 years, so about 8000 people packed
into the proposed development would have to travel on roads that are already at capacity. Because
local and state governments are not yet ready to do the road improvements, bonds and taxes would
have to be raised. New World, Mr. Dolata said, should place its development closer to 1-10 where
transportation corridors already exist.
(#8) Doug Koppinger, Conservation Chairman, Tucson Audubon Society, 6737 E. Opatas,
Tucson, AZ: He said that several homeowner's groups asked him to attend this meeting and
provide comments on wildlife and habitat issues. He agreed with past speakers, thought it would
be difficult if not impossible for New World to relocate the established vegetation, and
recommended that thc proposal be sent back to the Planning Commission, or rejected.
(#9) Bill Schisler, 12561 N. White Ave, Marana: He said that he recognized that the country
lifestyle of this area would make way for development in the future, the Westinghouse sewer
system is inadequate. Septic systems in the area would contribute to nitrates in groundwater.
Gerald Flannery said that one-acre lots would have to have a septic system.
(#10) Myra Tuggle, 3731 W. Flying Diamond: She lives near the proposed development, said
that Thornydale area is already at capacity. Also, the quality of life for past residents as well as
future ones will be impacted. She asked how wildlife and the environment would be protected, and
how the zoning process works.
Gerald Flannery explained the zoning process, said that the New World proposal is only a
rezoning and not a significant land use change. State statute on notification by property owner and
public hearing is in Title 9-462.04. That Title sets 300' as the notification range where residents
adjacent to the potentially rezoned property have to be informed. New World notified residents
within a 600' range, well within Title 9 requirements. The Planning Administrator went on to state
that all nearby residents had been sent notices, contrary to Mr. Dolata's statements. He has a
mailing list at his office. Also, by law, of residents within 150', if 20% or more object to the zoning
or rezoning, then a 3/4 affirmative vote by the Council would be required to approve the zoning.
However, most of the objections to the New World proposal are beyond the 150'.
Ms. Tnggle asked if there was some sort of plan of intent that the public could look at to get the
information that they needed. Mayor Ora Itarn responded, saying that people could come to the
Town and request to see the plans. In Marana, the plans are required to be specific and detailed.
Gerald Flannery clarified his previous statement on the 20% objection, saying the 20% objection
protest should be filed in writing against the proposed amendment, and the amendment will not
become effective unless 3/4 of the Council vote to pass it. Ms. Tuggle asked whether there is a
specific plan, and Gerald Flannery said that there is one on public record.
(#11) Mary Ann Redmond, 10981 N. Camino de Oeste, Tucson, AZ 85741: She lives near the
proposed development, and corrected Mr. Winters' statement about Westinghouse. She mentioned
that desert wildlife frequently visits her property. She hoped that the desert would be preserved.
(#12) Eve Ladd, 3100 W. Lynne Pl., Tucson, AZ 85741: She said that schools in the area are
already overcrowded. She came to the area for its desert ranch lifestyle and opposes the proposed
development,
(#13) Jeff New, 10650 N. Oldfather, of the Lambert - Naranja Homeowners Association: He
expressed his concern on the proposed New World development's effects on flooding. Said that
water flow in the area washes would increase over 200% after the area is developed. He
recommended that the proposal be postponed until all flood concerns have been dealt with.
(#14) Loren Loftin, 4747 Camino de Manana, Tucson, AZ: Said that he lives near but not close
to the proposed development. He prefers the country lifestyle but recognized that development
would occur. Had concerns about sewer capacity and fresh groundwater. He recommended that
the proposal go back to the Zoning Commission.
(#15) Tom Harding, 1501 Comanche Way, Tucson, AZ, of Tortolita Mountain Homeowners
Association: He spoke about taxes and the cost to residents: police, schools, road maintenance.
(#16) Ted J. Widger, Sr., owner of Arbor Tree & Cactus Nursery, PO Box 1090, Marana, AZ
85653-1090: He returned to say that he has done plant salvage for New World, that there is not the
budget to do the salvage and relocation of all the native plants in the proposed development area.
(#17) Marti Magarian Dolata, 10500 N. Oldfather Dr., Tucson, AZ 85741: She commented on
zoning, said that the 150' notification range for rezoning (see statements of #10 Myra Tuggle and
Gerald F!annery, above) is too small for such a rural area. She does not see why such a high
density urban~style development is doing out in the country. The people who want a country
lifestyle should be taken into consideration, too. The 0.303-RAC rural style should be maintained.
Ms. Dolata polled the Council members on whether they lived in high-density housing areas and
the Council indicated that they did not.
(#18) Lan Lester, President, Tortolita Mountain Homeowner's Association, 4003 W. Turkey
Ln,, Tucson, AZ 85741: He said that the local residents were not sufficiently notified of the
rezoning proposal by New World Homes, reiterated that "leapfrog" development was occurring.
(See comments of #7 Daniel P. D01ata, above.) He said the cost of infrastructure upgrades would
stress the taxpayer. Mr. Lester said that with the proposed development, all that land will be
covered by streets, houses, and buildings. If all those structures cover the land, then rainwater will
have to go elsewhere, into the washes. The washes would have to be reinforced to handle the
increased nmoff. (See comments of JetYNew, above.)
(#19) Paul Hall, 3641 W. Potvin Ln., Tucson, AZ 85741: Said that it is ironic that an award was
given at the start of the meeting to people who donated trees to the Town when many thousands of
native plants on the 511 acres of the proposed development are at risk for destruction. He doubted
that the rezoning was not a significant land use change. (See statements of #10 Myra Tuggle and
Gerald Flannery, above.) He said that he is representing about 40 people and hopes to represent
many more to oppose the rezoning. He promised to fight the Council legally. He realized that his
statement is aggressive, but thought it was necessary. He encouraged the Council to send the
proposal back to the Zoning Commission.
(#20) Ray Honea, 12540 N. White, Marana, AZ 85653: He returned to speak, saying there have
been inaccuracies in previous statements, that he has been in Marana for many years, was on the
first Council and was Chairman of the Planning Commission, was on Board of Directors Trico
Electric Co-op, and he owned a water company, so he knows about water issues, nitrates and septic
tanks in the Marana area. He said that the water table is over 300' down in Honea Heights, far
below septic tanks. The nitrates come from Santa Cruz effluent from Tucson. On taxes, he said it
was mobile home density that caused problems. They do not provide a good tax base. It was the
lower class mobile homes in one area that enabled the more affluent people to have their country
ranch homes on one house per 3.3 acres or better. The Thomydale area has been and still is
somewhat of a slum area with no good tax base of taxpaying property owners, A good tax base
will pay for the infrastructure improvements and public services. Mr. Honea said that development
will help wildlife such as at the Arthur Pack Golf Course because of all the irrigation watering.
(#21) Neale Allen, 3530 Sahuaro Divide, Tucson, AZ 85741: Lives near the development area,
said that they moved there for the desert environment. He would prefer lots of 1 to 3.3 acres.
(#22) Joyce Minatra, 3801 W. Oasis Dr., Tucson, AZ: Lives one mile south of the New World
property. Said that she has lived in the L.A. area and has seen high density areas. She has seen the
1993 Marana Flood and washes filled with rainwater runoff. She wants development to use larger
lot sizes like ones already in the area.
(#23) Maria Iannone, 10707 N. Camino Central, Tucson, AZ 85741: Opposes the proposed
development. Compared Long Island, NY, to Marana, where high density development occurred in
a rural area, said that the problems of urban areas will happen here.
(#24) Manny Simoes, 7312 N. Oleander Vista, Tucson, AZ 85704: He said that he and his
family own collectively about 40 acres near thc development, and he hopes that the Council makes
the right decision.
(#25) Ron Wyckmans, 3680 W. Potvin Ln., Tucson, AZ 85741: Lives about a mile from the
development. He said that the 300' notification distance is much too small for this type of
development. It should be more like a mile to a mile and a half. He said that New World is doing
the development purely for profit to the detriment of the community, and that Marana should
maintain its rural quality.
(#26) John Welty, 11020 N. Camino de Oeste, Tucson, AZ 85741: He said that the New World
development stemmed from the previous Hartman Hills development and rezoning, that a similar
situation occurred, where the Council sent the Hartman proposal back to the Zoning Commission
then the Council later approved the mzoning. County and Marana land use plans do not consider
present land use. The Council should send the rezone request back to the Planning Commission.

the Planning Commission for further public hearing at their February 23, 1994 meeting Item XI-F

From "C" To "VC" Village Commercial, MF-1 Multi-Family And R-6 Single Family Residential.
Ed Honea commented on the conduct of the guest speakers, said he did not approve of threats
made.
Mayor Ora Harn concurred with Ed Honea's statement.
Jeff New of the Lambert Naranja Homeowner's Association said that the people who made threats
did so out of fear rather than malice.
Paul Hall apologized for his conduct.

XI. ORDER OF BUSINESS
A. Request For Financial Assistance - United States Parachute Team
Hurvie Davis gave summary, said the request was to promote tourism and help the community,
and introduced Ms. Tee Brydon.
Tee Brydon introduced herself, said that among various civic charities and organizations, she is a
grandmother and a skydiver. She is the head of a competition team to go to China in May. The
Marana area is a good place for skydiving practice and competitions. She is seeking financial
assistance to cover travel expenses to India and China.

Hurvie Davis said that no money was allocated for this request, and there is no budget surplus.
The Ina - Thomydale annexation is not yet resolved and the funds derived from sales tax are or may
not be available. He is for promoting Marana, however.
Mayor Ora Ham asked whether CDBG (Community Developoment Block Grant) funds can be
used. Hurvie Davis said that the CDBG situation must be examined to see whether funds can be
obtained.
A motion was made by Ed Honea, seconded by Betty Horrigan and carried 6-0 to delay a
decision to the next Council Meeting until the Town Accountant can determine whether funds are
available.
B, Proposal For Legislative Representation - Mr. Scott Alexander
Scott Alexander, introduced himself, said he was a long-time area resident, and has served 6 years
in the Arizona House of Represeutatives and chaired the State Government Committee, and 4 years
in the State Senate where he chaired the State County Municipal Affairs Committee. He has been a
professional lobbyist since 1974. He said Marana should do something to protect itself from
Tucson, to help with sewers, flood control. Gave a description of lobbyists, said that if Marana is
represented by a lobbyist in the State Legislature, the legislators would have to take Marana into
consideration when considering a bill or an amendment. Getting access to the legislators is
important. Credibility is essential. With the client, goals are defined, an action plan is made. His
office has detailed information on legislatures; their schedules are in his computer system. Mr.
Alexander stays connected to his clients with a pager and a cellular telephone, and a laptop
computer with fax and modem. He works at all government levels from state to local.
Herb Kai asked about Mr. Alexander's fee schedule. Mr. Alexander said his fee is usually
$150/hr.; however, he prefers annual contracts.
Mr. Alexander recommended that Marana subscribe to the "Arizona Capitol Times" in order to
better informed on State government.

C. Appeal By Nate Newberry_, Representing PuRe Homes. Of A Planning Commission's
Decision On December 10. 1993. Denying A Request For Front Yard Setback Reductions
Gerald Flannery gave summary, said there are two issues: the setbacks, and the setbacks' effects
on parked automobiles in regards to blocking pedestrian traffic.
Nate Newberry restated that PuRe is asking for a reduction of setbacks from 20' to 17'. The other
~ssue is the exact placement of the sidewalk in relation to a lot and the street. PuRe has two
proposals. Proposal A allows for a setback of 17' from the right-of-way, with the house being
moved 3' closer to the street. In the original plan, there is a 4' sidewalk that is 3' from the angled
curb. Pulte wants to eliminate the 3' separation of curb from sidewalk so that the front yard is not
reduced in size while the backyard is enlarged by 3'. The purpose is to meet the demand of
consumers for a larger backyard that arose after the Continental Ranch Specific Plan was devised.
Proposal B leaves the separation between curb and sidewalk, but reduces it by one foot. Nr.
Newberry stated that the amendment to the Specific Plan would apply only to Pulte's part of
Continental Ranch, Parcels 18 and 12-B. He addressed the issue of parked vehicles, stating that
Proposal A retains the original 20' driveway. Proposal B leaves an 18' driveway (17' setback + the
one foot taken from the sidewalk and curb separation). An extended length private vehicle can still
fit in the driveway.
Ed Honea said that he examined Pulte's development, said that 20' is essential for parking a vehicle
in a driveway. He also looked atNew World's houses and their 15' driveways, and said that even
compact cars stick into the sidewalk. He has no objection to moving the sidewalk to the curb,
however that would be unique to Continental Ranch. Proposal B would be unacceptable.
Sharon Price said that she talked with homeowners in the area, and the people said that sidewalks
joined with the curbs are preferable to shorter driveways. Proposal B would be unacceptable.
Tom Clark said that he toured the Pulte area, compared the sidewalks/curbs to other developments
where angled curbs that are joined to sidewalks invite motorists to park their cars partially in the
street and partially on the curb and sidewalk, which is illegal. Also, children bicycle and skate on
the sidewalks, although that, too, is not allowed.
Mr. Newberry suggested that Pulte could make the sidewalks 5' wide, leaving a one foot
separation from the curb.

Mick Mathieu, Town Eng'meer, said that a 5' sidewalk with a curb separation could be done
where, at driveways, the sidewalk joins the curb and then returns to the separation after the
driveway. This method is a compromise between Pulte's need and the need for safe streets and
sidewalks. There is still the shortened driveway, but separations of sidewalk from curb are
maintained except at the driveways, to give the driveways a little bit more room.
Tom Clark lamented that the Zoning Commission was not present to explain their reasoning for
denying Pulte's request. Mick Mathieu said that the Commission did not like the request because
of the setback variance. The Specific Plan called for 20' and that is how it should remain. Gerald
Flannery pointed out the Commission's Resolution 93-05 which contains the reasons for their
decision.
Tom Clark questioned reason #3 of Zoning Resolution 93-05 that stated granting the revision
would create an adverse environmental effect, generally, on Continental Ranch. Gerald Flannery
replied, saying that the quality of life would be impacted.
Sharon Price said that she has a problem with Mick Mathieu's compromise; it makes for winding
twisting sidewalks instead of straight ones and the sidewalks could be dangerous for small children
at play.
A motion was made by Ed Honea, seconded by Tom Clark and carried 6-0 to move the sidewalks
to the curb and to make the sidewalks 5' wide, allowing for a 20' driveway.
Tom Clark wondered whether changing the sidewalk width to 5' would detract f¥om the house.
Mr. Newberry replied that the elimination of the separation between sidewalk and curb will
enhance the house's appearance because the separation would have to be maintained by the
homeowner.
D. Rezoning Of Property Located South Of Linda Vista. East Of 1-10 And West Of Hartman
Lane From E To R-6 Single Family Residential
A motion was made by Ed Honea, seconded by Herb Kal and carried 5-I with Sharon Price
voting n__Q, to approve the rezoning of property located south of Linda Vista, east of 1-10 and west of
Hartman Lane from E to R-6 Single Family Residential.
Dan ltochuli said that a typographical error made Ordinance 94.02 look like the zoning change
was from E to R-l_6. A "1" was accidentally added. He recommended that Ed Honea amend his
motion to include the correction to Ordinance 94.02.
E__. Consideration Of Proposed Annexation To The Town Of Marana Known As The Exeter
II Annexation Thornydale Road South of Tangerine Road
A motion was made by Ed Honea, seconded by Betty Horrigan and carried 6-0 to direct Staff to
file a blank annexation petition for Exeter II.
Mayor Ora Ham explained that the petition must be filed before the matter can be brought to

Betty Horrigan said she is asking for $25,000 in CDBG funds. Last year's program lost money
because it was not a free program. If it cannot be a free program this year, there should not be a
swim program.
Mayor Ora Ham said she supports the progran~ and would like it to continue.
