MARANA TOWN COUNCI~
NOVEMBER 2. 1993
Jerry Flannery, Planning Administrator gave a brief explanation
of the Pulte Homes request.
John Wood, WLB Group, 4444 E. Broadway, Tucson:
Addressed the Council with some additional changes to
obtain the variance.
hopefully
Mick Mathieu, Engineer:
Stated that the sidewalk should still
for purposes of safety.
have a 1' to 3'
separation
Robert McCrea:
Agreed with Mathieu-- for safety, sidewalks should be set back
from the curb, and if changes were approved, Marana could become
legally responsible if accidents occurred.
Anton Krapek, Planning Commission member, 7700 N. Bellwether:
If a setback is granted, a precedent would be set allowing all
other developers to request development changes. He agreed with
Mr. McCrea that Marana could be held liable if a pedestrian got
hurt trying to go around an oversize vehicle that was blocking
the sidewalk.
John Wood:
Responded to the comments, stated that no matter what the set-
back, 20' or 17' homeowners could still park oversized vehicles
that could block sidewalks. And precedent or not, developers
could still make requests for changes.
A motion was made by Sharon Price, seconded by Betty Horrigan and
carried unanimously to close public hearing. Time: 7:32
IX.
ORDER O_~BUSINES$
AL Pulte Homes setback Appeal
Sharon Price stated that she appreciates the Planning Commis-
sion's work, that waiving the 1' to 3' sidewalk setback would not
be a problem because of the small volume of traffic in the devel-
opment. A 15' front yard setback~ however~ is too short to
safely park a vehicle.
Tom Clark:
States that he does not like meandering sidewalks.
John Wood:
Other option is to keep a straight sidewalk with
ration from the curb and a 16' setback.

NOVEMBER 2,, 1993
Bob Kern, Public Works Superintendent, 12755 N. Sanders Rd.,

issue.
