Leilani Schisler announced that the Traveling Art show exhibits
will be on display at the Marana Town Hall and the Marana Library
until February 21, 1993.

A. TO Add Section 9 To The Marana Zoning Of Newly Annexed
From Pima County Zoning To Town of Marana Zoning
Areas
A motion was made by Bill Schisler, seconded by Sharon Price and
carried unanimously to go into Public Hearing to add Section 9
to the Marana Zoning of newly annexed areas from Pima County
Zoning to Town of Marana Zoning. Time: 7:16 P.M.

carried unanimously to come out of the Public Hearing. Time:

Hurvie Davis stated that RoD Caviglia was not present for to-
nights meetinQ and that Zo~inQ was the first issue and the Plan-
ning and Zoning Commission have recommended approval of the
proposed Zoning ChanQes which will make the proposed annexation
compatible to the Pima County Zoning which will not change or
increase zoning in this area but will just move laterally and
they will not be required to go through a Land Use process.

A motion was made by Eddie Honea, seconded by Bill Schisler and
carried unanimously to adopt the Position Paper relating to
Arizona Oepartment of Water Resources Proposed Assured Water
Supply Rules aod authorize staff to forward same to the Arizona
Department of Water Resources and other interested parties.
Bill Schisler suggested we sent copies to Congressman Jim Kolbe
and Pima County Board of Supervisors Ed Moore.

A motion was made by Helen Key, seconded by Eddie Honea and
carried unaRimously to adopt the 3oint Resolution and designate
Bill Schisler to participate on behalf of the Town in the al-
liance's activities.

A motion was made by Eddie Honea, seconded by Bill Schisler and
carried unanimously to send a letter of support to Pima County
and Cortaro Marana Irrigation District and that the Town of
Marana supports the Cortaro Marana Irrigation District Bank
Protection On The Santa Cruz River.

A motion was made by Bill Schisler, seconded by Betty Horrigan
and carried unanimously to set up a schedule for a Newsletter.
It was also suggested we provide articles to both newspapers in
the community.

Dick Kelly expressed his opposition to the business license.
A motion was made by Bill Schisler, seconded by Eddie Honea and
carried unanimously to approve the business license regulations
and adopt Ordinance 93.02 and Resolution 93-02 Adopting an amend-
ment to the Town Code Entitled Business Regulation.

carried unanimously to cancel the contract with Business Develop-
ment. Finance Corporation as soon es possible and all future
revolvin~ loans are to be administered through t~e Greater Mare-
ne/Aura Valley Chamber of Commerce.

A motion was made by Eddie Honea, seconded by Bill Schisler and
carried unanimously to change the 1991 Economic Development's
project description. "The primary objective of the Town of Marana
COBG Economic Development Program is to provide financial assist-
ance to an independent economic development entity. Such entity
shall assist in the creation of job Opportunities in the Greater
Marana Area by attracting new business and the expansion of
existing businesses.
A motion was made by Eddie Honea, seconded by Bill Schisler and
carried unanimously to require that all past and current CDBG
projects submit billings through the Greater Marana/Avra Valley
Chamber of Commerce effective immediately.
A motion was made by Eddie Honea, seconded by Betty Horrigan and
carried unanimously to approve the Town of Marana's Community
Development Block Grant Program Regulations. (See Attachment to
these minutes)
~. ~993 ~looding Problems - Estimated amp_~ and Solution~
John Lynch, of GLHN, 2980 N. Campbell Ave, Tucson
John Lynch addressed the Council identifying damages to the Town
of Marana roadway system caused by the January 1993 flooding.
GLNN sent a letter to the Arizona Department of Transportation
identifying the Marana roads on the Federal Highway Aids System
that will be covered through federal aid funds for reconstruction
work on those roads.

A motion was made by Doug Mostyn, seconded by Bill Schisler and
carried unanimously to approve the termination agreement pertain-
ing to the Intergovernmental Agreement between the Town of Otc
Valley and the Town of Marana providing Police Communication
Service.
~ Animal Control - Discussion
Council Member Sharon Price recommended that a committee be
formed and this committee would address the animal control issue
and recommend ways to fund it.
Mayor Ora Harn asked Sharon Price to organize this committee and
bring back to the Council the names of the committee members.

The Council discussed concerns regarding the lack of a Summer
Youth Program but would work with other youth programs in the
area and the major effort is towards keeping the pool open.

carried unanimously to approve Resolution 93-03 providing Notice
of the Regular Primary Election; Establishing Polling Places and

Purpose.
This Dart describes policies and procedures applicable to the
Town of Marana Community Development Block Grant Programs as
authorized by the Town of Marana, in compliance with Pima
County and the Department of Housing and Urban Development.
Such regulations may be greater than program requirements
placed by Plma County and Hud, but under no condition shall
these regulations reduce the obligations imposed upon the Town
of Marana by contractual agreement with Pima County nor Pima
County's obligation imposed by Hud.
Primary Objective.
The primary objective of the Town of Marana CDBG Programs is to
provide decent housing and a suitable living environment and
expanding economic opportunities, principally for persons of
low and moderate income.
Definitions.
(a) "Agency" means any entity authorized by the Town of Marana
to carry out any program activities.
(b) "CDBG Funds" means Community Development Block Grant funds.
"Family" mean all the persons who occupy a housing unit.
The occupants may be a single family, one person living
alone, two or more families living together, or any other
group of related or unrelated persons who share living ar-
rangements.
d)
"Household" means all the persons who occupy a housing
unit. The occupants may be a single family, one person
living alone, two or more families living together, or any
other group of related or unrelated persons who share liv-
ing arrangements.

"Low income household" means a household having an income
equal to or less than 50% of the median income established
by Pima County.

"Moderate income household"

AGENCY RESPONSIBILITIES
Agency(s) authorized by Town to implement each program are re-
quired to adhere to the regulations established by Town includ-
ing the following types of assignments:
(a) Providing local citizens with information about the pro-
gram.
(b) Preparing program budgets and schedules.
(c) Developing agreements with contractors to carry out pro-
gram activities.
(d) Monitoring program activities for progress and compliance
with program requirements.
(e) Preparing reports and other documents

Agency accepts the same responsiblities that the Town has in
relation to contracts between the Town and Pima County. To in-
sure that all expenditures of CDBG Program funds are in con-
formance with Pima County and Hud standards. Agency shall be
responsible to insure that all applicants have met the minimum
requirements established for this program.
Town shall be responsible to insure that Agency meets the obli-
gations established in these regulations. Town shall also in-
sure that all requests for disbursments of funds is processed
to Pima County in a timely manner. Town shall be responsible
for all inquiries and negotiations with Pima County.

PROGRAM ADMINISTRATION COSTS
Payment of reasonable administrative costs and carrying charges
related to the planning and execution of CDBG Programs. No
more than 20 percent of the sum of any grant plus program in-
come received during the program year (or the grant period for
grants), shall be expended for planning and program administra-
tive costs.
(a) Salaries, wages and related costs of the agency's staff
relating to program.

(b
Travel costs incurred for official business in carrying
out the program.
(c
Administrative services performed under third party con-
tracts or agreements, including such services as general
legal services, accounting services, and audit services.
(d
Other costs for goods and services required for adminis-
tration of the program, including such goods and services
as rental or purchase of equipment, insurance, utilities,
office supplies, and rental and maintenance (but not pur-
chase) of office space, utilized for program.
AGENCY EMPLOYMENT AND CONTRACTING OPPORTUNITIES
Agency shall comply with Federal Equal Employment Opportuni-
ties, which provide that no person shall be discriminated
against on the basis of race, color, religion, sex or national
origin in all phases of employment during the performance of
the Town of Marana CDBG Programs and insure that all contrac-
tors and subcontractors take affirmative action to ensure fair
treatment in employment, upgrading, demotion or transfer, re-
cruitment or recruitment advertising, layoff or termination,
rates of pay or other forms of compensation and selection for
training and apprenticeship.
CONFLICT OF INTEREST
Except for the use of CDBG funds to pay salaries and other re-
lated administrative or personnel costs, no person who is an
employee, agent, consultant, officer, or elected official or
appointed official of the agency may obtain a personal or fi-
nancial interest or benefit from a CDBG assisted activity, or
have an interest in any contract, subcontract or agreement with
respect thereto, or the proceeds thereunder, either for them-
selves or those with whom they have family or business ties,
during their tenure or for one year thereafter.
REVERSION OF ASSETS
Upon termination of agency administering any CDBG Program, such
aqency shall transfer to the Town, any CDBG funds on hand at
the time of expiration and any accounts receivable attributable
to the use of CDBG funds. It shall also transfer to the Town
any real property, including equipment that was acquired or im-
proved in whole or in part with CDBG funds, or that such prop-
erty is disposed of in a manner that results in the Town being
reimbursed in the amount of the current fair market value of
the property. Reimbursement is not required after utilization
of property for a period in excess of five (5) years.

Agency, upon requesting disbursement of funds from Town, shall
utilize "Town of Marana Request for Community Development Block
Grant funds" form. This form shall be filled out completely
and accompanied by supporting receipts and documentation to
support request for disbursement of funds.
RECORDS TO BE MAINTAINED
Each agency shall establish and maintain sufficient records to
enable the Town to determine whether the agency has met the re-
quirements of the CDBG Program. Specific Program records will
be listed in each Program regulation. At a minimum, the fol-
lowing records are needed:
(a)
Description of the specific conditions detrimental to
health and safety which were identified and the details
and scope of the CDBG Program assistance.
(b)
Data on the extent to which each racial and ethnic group
and single-headed households (by gender of household head)
have applied for, participated in, or benefited from, this
program.
(c)
Data on employment of agency with such data maintained in
the categories prescribed on the Equal Employment Opportu-
nity Commission's EEO-4 form; and documentation of any ac-
tions undertaken to assure equal employment opportunities
to all persons regardless of race, color, national origin,
sex or handicap.
(d) Agency financial records to support total expenditure of
CDBG funds.
(e) When agreement is completed, or is terminated with Agency,
all records concerning program are to be returned to Town.
REPORTING TO TOWN
Agency shall be responsible to submit sufficient reports to the
Town on a quarterly basis to insure that the objectives of the
program are being met and to satisfy Town that continued use of
agency is justified.
AGENCY ACCOUNTING
Costs incurred, whether charged on a direct or an indirect ba-
sis, must be in conformance with the requirements of OMB Circu-
lar A-122, "Cost Principles for Non-Profit Organizations".

professional services, shall be done through an open selection
process which shall be in conformance with the procedures and
requirements of Pima County.
