BUILDING GENERAL OFFICE • Pool & Spa Code Committee in Building Safety is reviewing and updating Marana's existing code. • Inspection staff has been working on Ritz Carlton projects/several commercial projects and new home construction. RITZ CARLTON RESORT DOVE MOUNTAIN • Construction is in steady progress. • Attending regular meetings at the job site bi-weekly on Wednesdays. Sumt~~~n-y of Consh~uction Activity ~prcadsheet attached -2- B. CAPITAL IMPROVEMENT PROJECTS SILVERBELL ROAD INTERCEPTOR PROJECT: 1999-050 • Asphalt on Silverbell. Rd., south of Ina Rd. has been placed. Work continues on the south side of Ina Rd. west of Silverbell Rd. • The box culvert #7 extension, under Ina Rd., has been poured with backfilling in progress. • Water and sewer lines are being installed in the SW corner of the Silverbell/Ina Rd intersection. • Landscaping work is continuing along Silverbell Rd. Fill and pad excavation for the art features are in progress. • The sidewalk has been completed. • Phase I work in the District Park has commenced with utility installations. • At the end of November, 86% of the completed construction contract work based on total cost has been spent and total project elapsed time is at 65%. With the opening of Silverbell Rd. to traffic, Phase I has been completed. • Value engineering, environmental concern monitoring, testing, quality control and assurance are on-going daily. The project has had no reported safety issues. THORNYDALE ROAD PROJECT: • The ribbon cutting took place on Saturday, November 22nd at the North Pointe Shopping Center in conjunction with an area business fair. • Some punchlist work is still underway. The project has entered the landscape establishment period. THORNYDALE RD. /TANGERINE RD. INTERSECTION IMPROVEMENTS: • Town staff met with the developer to revise the construction plans. The Developer's revised plans should be completed and reviewed by end of October. The Town will then finalize its plans by October. • Estimated to begin construction: December 2008. TWIN PEAKS PROJECT: • Conditional cultural clearance obtained, there are areas of further recovery that will need to be cordoned off from construction initially. • 404 permit at corps, Robert Dummer new reviewer believes permit will be in hand by Thanksgiving 08. Conditional environmental clearance obtained. • Conditional right of way clearance obtained • UPRR C&M agreement signed. Meeting before ACC set for Camino De Manana closure. Conditional railroad clearance obtained • Qwest and ADOT have agreed to disagree on prior rights of their utilities at this time. Twin Peaks contractor will perform work while continuing to sort out who pays. With that, conditional utility clearance obtained. • Demolition ongoing and almost complete. Well removal to commence shortly. Working on water service to Pioneer Landscaping • Advertisement date will be November 28, 2008. -3- TANGERINE FARMS LOOP ROAD: • Punch list, site cleanup work, and project closeout continuing • Drainage along Street A into Cemex pit design work begun based on latest topographical map supplied by Cemex • Signalization of the I-10/Tangerine Road intersection: Poles delivered and installation begun September 22, completion scheduled for late October HONEA HEIGHTS WATER, SEWER AND PAVING PROJECT: Paving work was completed at the end of September; final negotiations on extra work underway for final paving project close out in November 2008; sewer as-builts under review prior to submittal to PCWMD • NAC Construction completed water improvement installation prior to July, system tied over to new service and site cleanup was completed mid July. • Paving was completed in July, utility adjustments and site cleanup is in progress • Two additional sewer manholes, sewer main and service connections installed for low income housing project on town owned property on Whitney Lane, in new road alignment for Sydney Place • Sanitary sewer as-built information is being compiled for submittal to PCWMD and ADEQ for final Approval to Discharge, to be submitted after final manhole rims adjusted to new street pavement elevations and final survey information and post paving inspections completed • Connection of homes to new sewer main to begin after Approval to Discharge issued by ADEQ, program currently calls for approximately 200 homes to be connected over a three year period. Bid documents are in the process of being developed for the first phase of this work. • Sidewalk construction planned once all homes are connected to the sanitary sewer system CAMINO DE MANANA PROJECT: • 404 permit applications have been submitted to the Army Corp. The Corps is waiting for a concurrence letter from Fish and Wildlife. Town staff is expecting to have apermit bymid- October. • The contractor will be selected prior to December 2008 for the Construction Manager At- Risk delivery method. • A submittal meeting was held on October 20, 2008, and the final submittals will be October 30, 2008. • Construction is estimated to start April/May 2009. BARNETT LINEAR CHANNEL: • Environmental investigations have begun for utility pot-hole locations. Revised 60% plans are estimated to be completed by end of December 2008 PAVEMENT REHABILITATION PROGRAM: • Resurfacing of roads within Sunflower Village has been completed as part of the 2008-2009 pavement rehabilitation. program. Final striping of the resurfaced roads. will be completed in early December. -4- C. LEGAL, WASTEWATER LITIGATION • On November 6, the Town filed its motion to dismiss Pima County's "notice of claim" affirmative defense and "competing utility enterprise" counter-claim. Pima County is scheduled to file a response on December 5. WASTEWATER TRANSITION • On November 13 and 19, Frank Cassidy attended PAG Scope of Work Committee meetings, concerning Marana's 208 Plan Amendment seeking to be identified as the designated management agency (DMA) for Marana. • Legal staff is participating in regular wastewater staff meetings to address ongoing transition issues, including the preparation of new draft Town Code provisions addressing wastewater. CMID IGA NEGOTIATIONS • On November 14, CMID submitted a claim against the Town in the amount of $3,353,963.28. • Outside counsel Rita Maguire is negotiating a joint dissolution agreement, to dissolve the 1997 IGA. DEANZA REFERENDUM LITIGATION • Cedric Hay submitted and argued cross-motions for summary judgment, in coordination with intervenor's counsel, Joy Herr-Cardillo. • On November 28, Pima County Superior Court Judge John Davis issued a ruling granting Marana's motion for summary judgment and denying DeAnza's motion for summary judgment, clearing the way for the DeAnza referendum to appear on the March 2009 ballot. POLICE DEPARTMENT PERSONNEL MATTERS • Jane continues to provide coordination and oversight with respect to the Barbara Harris PARB hearing, which is expected to conclude in the next two weeks. • On November 17, a lawsuit alleging hostile work environment was filed in the United States. District Court on behalf of Barbara Harris, Michelle Ochoa and Lanell Garbini. PUBLIC WORKS PROJECT PROPERTY ACQUISITIONS • There are ten pending condemnation cases for the acquisition of Twin Peaks/Linda Vista interchange right-of--way. These cases are being handled by the law firm Miller/Kramer, and overseen by Cedric Hay. • Cedric Hay is leading the effort to coordinate appraisals and property acquisition negotiations to obtain right-of--way needed for the Camino de Marana project. At this time, it appears that ten condemnation cases will be filed as soon as the next two weeks, and will be handled in- house by Frank Cassidy and Cedric Hay. • A proposal to address the narrow strip of "no man's land" behind the Thornydale sound walls is anticipated to be presented to the Town Council on December 16. OTHER NOTABLE CIVIL MATTERS • Cedric Hay has been meeting and working with lending institutions and the Planning Department to address illegal lot splitting in the Camino de Marana area. • Jane Fairall has been working with the Human Resources Department on revisions to the Town's personnel policies. -5- • The Legal Department held Camille DeSimone's retirement dinner at Heritage Highlands on November 15. • Cedric Hay participated in Airport Land Acquisition & Relocation Consultant interviews on November 5. PROSECUTION ACTIVITIES AND STATISTICS: • In November, the Legal Department prosecuted and closed 140 criminal cases in Marana Municipal Court, accepted 106 new cases from Marana Police Department and other state agencies for future prosecution, and handled one jury trial and two petitions to revoke probation. D.11/IARANA REGIONAL AIRPORT FIRE PROTECTION WATER LINE • Under contact to Sundt Construction There have been no major issues with construction Construction is 97% complete SEWER LINE • Under contact to Sundt Construction There have been no major issues with construction Construction is 97% complete SEPTIC TANK • Design is under contact to Westland Resources • Design is 75% complete • Field samples were taken to be analyzed BY-PASS APRON • Design is complete • Construction bids were opened on 8/11/2008 • Apparent low bidder is Borderland Construction - $763,435 • Award for construction is on hold waiting for ADOT Aeronautics Approval SECURITY FENCE • Design is complete • Low bidder was Orta Fence - $246,877 • Construction began on 10/20/08 • Construction is 30% complete AIRPORT ACCESS ROAD • Design is complete • Low bidder was Borderland Construction - $1,717,555 • Construction began on 10/20/08 • Construction is 30% complete -6- AIRPORT TERMINAL • Under design to Jacobs Carter Burgess • Schematic design is 61% complete • Schematic design will be transferred to DWL AIRPORT CONTROL TOWER • Site Study is under contract with the FAA • FAA draft study and AFTIL visit on 11/17/2008 • Continuing to work with Gabrielle Giffords for construction funding • FAA completed on-site- study of building heights • Marana attended the FAA AFTIL lab on 11/17 AIRPORT OPEN TIEDOWNS • The Town is taking over the management of the open aircraft tiedowns at the Airport • Billing methods are being established • Open tiedown permits have been sent out aircraft owners • A process and system to take credit cards is being worked on STATE LAND - ACQUIRE RIGHT OF WAY • The Airport has submitted an application to State Land to acquire utility and roadway right of way to the west of the airport. • State Land has received the application and it is being processed. • The airport has selected W.D. Schock to help with land issues around the airport. PAG -AVIATION THINKTANK • PAG will host a ThinkTank for the aviation community on Tuesday, January 6th HARLEY-DAVIDSON • The airport is currently working with the Marana Harley-Davidson dealer to partner together to provide motorcycle safety training at the Airport. They will use a portion of the airport for a fee. E. OPERATIONS AND MAINTENANCE UPDATES FLEET SERVICES • Vehicle preparation for auction (date to be determined) • Meeting to award contract for emergency lighting (December 1, 2008). TRAFFIC SIGNALS: • Responded to Thornydale/Orange Grove signal malfunction on Sunday, November 30, 2008, situation was resolved and passed over to the Contractor for final resolution. • Working with ADOT to resolve problems at I-10/Tangerine before launch date. STREETS: • Sunflower chip sealing project complete. • Crack sealing project to begin this week in Silverbell Estates and Sombrero Peaks. -7- F. PARKS AND RECREATION MARANA CULTURAL AND HERITAGE PARK • Construction is substantially complete • Staff is working with PCNRPR to complete art component. • Contractor is fencing farm perimeter. • Mobile office and storage moved to site. SILVERBELL-CORTARO DISTRICT PARK • Water system is complete. • Sewer installation underway, traffic circle in front of Abbett Library will be disrupted during construction. • Construction documents for Phase II park construction complete; anticipate bid date mid December. CONTINENTAL RESERVE BALL FIELD LIGHTING • Lighting design in Complete. • Estimate for installation $191 K. TORTOLITA MOUNTAIN TRAILS WILD BURRO TRAILHEAD • Engineering plans have been approved. • Ritz Carlton development is using the trail head location as a holding area for salvaged plant material. • Anticipate clearance for trail head development summer of 2009. ORA MAE HARN PARK IMPROVEMENTS • Restroom under construction. PARKS AND RECREATION COMPREHENSIVE MASTER PLAN UPDATE • Planning efforts continue. RE CREATION • Tortolita Mountain Guided Hike, October 20 & November 15, approximately 26 participants. • Heritage Festival, Heritage Park, October 25, approximately 600 participants. • Spooktacular, Ora Mae Harn Park, October 31 approximately 2500 participants. • Ring of Fire Skate Tournament, Continental Ranch Neighborhood Park, 85 participants. G. POLICE EL TOUR DE TUCSON BIKE RACE • El Tour de Tucson is the largest "perimeter" cycling event in the country with over 6000 participants and has distances for all riding levels. • This year Marana Police Department was requested for point control coverage, which resulted in staffing forty-one positions, which we did successfully with the help from other agencies like Eloy PD, Pinal County Sheriff's Office, PCC PD, South Tucson PD and AZ Rangers. • There were seven .accidents throughout Marana involving cyclists during the race. No one was seriously injured. STUDENT RESOURCE OFFICERS • Officer Geri Tinsley escorted 5 Middle School Students to the Arizona Promise Goal 1 Summit at Sunnyside High School • This event was an initiative to help kids stay in school through peer support and mentoring. COMMUNITY RELATIONS • Safe Routes to School Program has been completed and awaiting a summary report. • Dianne Van Horn presented community programs and crime prevention for the Citizens Police Advisory Commission. I. TECHNOLOGY SERVICES SERVER ROOM RELIABILITY & REDUNDANCY • In discussions with IBM. and other vendors for design and implementation of effective disaster recovery and redundant data storage capability. • Reviewing server room fire suppression system to ensure that it meets operational requirements. • Implementing automated server shutdown software to improve the use of battery backup capacity. -9- SOFTWARE APPLICATIONS • Planning for upgrade of CRW permitting software and expanding use to include scheduling inspections with the CodeTrak module. • Building a Development Services web site that provides a dynamic interactive map. COMMUNICATIONS • 7.4 Radio Upgrade is 95% complete and on track to cutover on Dec 11. • Alltel wireless communication design of antenna additions to the Marana wireless tower located at the Parks and Rec. facility is in progress. GIS • Expanding coverage on town GIS systems for Pinal/Red Rock area. • Cultural Heritage map in progress. • GIS maps, calculations and' analysis provided for Habitat Conservation Plan November submittal to Arizona Game and Fish. Have been completed. J. UTILITIES DISCONNECTS FOR NONPAYMENT: • November 2008 - 33; November 2007 - 31 • October 2008 - 27; October 2007 - 38 LATE CHARGES BILLED: • October 2008 - $7440 (496 customers); October 2007 - $2655 (531 customers). Late charge increased from $5 to $15 January 1, 2008. ACTIVE ACCOUNTS WITH ZERO USAGE: • October 2008 - 105; October 2007 - 114 REPAIRED MANIFOLD AT CONTINENTAL RESERVE WELL SITE. POWER OUTAGE • Attended to power outages at Palo Verde and North Marana. • As a result of redundancy in our water system as well as having backup generators, only 50 water services were temporarily out of water service in the Palo Verde system. • Without the redundancy and generators more than 2,050 water services would have experienced a water outage. -10-
