I represent Mrs. Mary DeConcini, Trustee of the Mary.
DeConcini Trust. The Trust is the owner of a 32 acre parcel
of land identified by Arizona Property Tax Parcel No. 217-
33-OOlF (referred to as the "DeConcini property") The
DeConcini property adjoins the Mandarina property that is
the subject of the proposed Mandarina Specific Plan.
Mrs. DeConcini requests that if the Mayor and Council
approve the Mandarina Specific Plan this evening that the
approval be conditioned on:
1) adequate access through the Mandarina property to and
from the DeConcini property from Tangerine Road and
2) any drainage solution constructed within the Mandarina
property not impose upon or burden the DeConcini
property.

Regarding Mandarina Plan Hearing Continuation
Dear Marc,
At your request, l have reviewed the drainage plan related comments on pages 2 and 3 of the
above referenced letter and. offer the fallowing comments.
The drainage concept that t depicted an the exhibit referenced in Mr. O'Hares letter is in my
opinion the best solution for all of the affected properties because it gains control of the storm
water at the outlet of the CAP overchute structure and fully contains the flow within a concrete
lined channel to it's terminus at the proposed regional drainage channel adjacent to thetJnion
Pacific Railroad. The CAP overchute is located adjoining the DeConcini property a few hundred
feet north of Mandarina, therefore the need to align the channel as shown on the concept plan.
The concrete lined channel does not have to be constructed on the DeConcini property in order
for Mandarina to be developed. It can be entirely constructed within and along the north boundary
of Mandaria if needed, and serve the same purpose. If it is constructed that way, 4.6 acres of land
at the southeast corner of the DeConcini property will remain in the ffoodplain and the
engineering solutions for reducing the extent of that ffoodplain will be limited, as they are under
existing conditions. The concept plan we offered, reduces the area of the DeConcini property that
is within a ffoodplain from roughly 4.6 acres to roughly 1.0 acres.
The statement (last sentence in first paragraph on page 2) that "Mandarina does not contribute
any of it's property fn this proposed drainage solution" is incorrect. The concept plan prepared by
CMG drainage Engineering, Inc. shows the channel to split the boundary between DeConcini and
Mandarina with 31-feet of the needed right of way on each property. The channel is located
entirety on the DeConcini property only where needed to connect to the CAP overchute.
The concrete lined channel does not interfere with the conveyance of storm water drainage from
the DeConcini property to Mandarina as stated in the third paragraph on page 2 of Mr. O'Hares
letter. The channel fully accepts 100°/0 of the storm water as under existing conditions a?~d in no
way adversely affects the DeConcini property. The channel does not "bring drainage water that
belongs to Mandarina back onto Mrs. DeConcini's prnperty which adversely impacts Mrs.
DeConcini's property", nor does it violate Section 05.05.05 of the Land Development Gode. In
fact, it does the exact apposite, that being to convey existing storm water flows away from the
DeConcini property.
