OF PAGES: SEQUENCE: PICKUP AMOUNT PAID $ 7.00 MARANA RESOLUTION NO. 2006-02 RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING A RELEASE OF ASSURANCES FOR CONTINENTAL RESERVE - PHASE I & II -- AND ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR MAINTENANCE. WHEREAS, Continental Reserve is a 597.75 acre subdivision located northwest of Wade Road and south of Silverbell Road, containing Blocks 1 through 20, common areas A, B & C, and is recorded at the Pima County Recorder's Office in Book 53 of Maps and Plats, Page 35; and WHEREAS, the Town has previously entered into an Assurance Agreement with Continental Reserve II, an Arizona Limited Liability Company, (beneficiary) under Trust No. 30,121 (subdivider) and Fidelity National Title Agency, Inc., (trustee), recorded at the Pima County Recorder's Office at Docket 11441, Page 1504, assuring the completion of public improvements; and WHEREAS, Continental Reserve II, LLC, has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Continental Reserve Loop - Phase I & II. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Continental Reserve, Blocks 1 through 20 are hereby released from the Assurance Agreement with Continental Reserve II, LLC. under Trust No. 30,121, and Fidelity National Title Agency, Inc. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 2.50 miles of paved streets for the following appurtenances, as depicted on Exhibit A: a. b.
