PAPERWORK AND TAKE ALL ACTIONS NECESSARY TO MOVE THE TOWN'S
WATER UTILITY FROM THE ARIZONA DEPARTMENT OF WATER RESOURCES
GALLONS PER CAPITA PER DAY PROGRAM TO THE NON-PER CAPITA
CONSERVATION PROGRAM
WHEREAS the Town of Marana recognizes the importance of providing safe quality
water to its residents and complying with all rules and regulations promulgated by the Arizona
Department of Water Resources (ADWR); and
WHEREAS the Town of Marana is currently participating in the gallons per capita per
day program administered and enforced by ADWR; and
WHEREAS the Town of Marana desires to move from the gallons per capita per day
program to the non-per capita conservation program; and
WHEREAS the Town Council finds that participation in the non-per capita conservation
program is in the best interests of the Town of Marana and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, ARIZONA, that the Utilities Director is hereby authorized to submit all
paperwork and to undertake all other actions necessary for the Town to participate in ADWR's
non-per capita conservation program, including without limitation developing a conservation
program in compliance with the non-per capita program and implementing the conservation
program after it is approved by ADWR.

This is an OFFICIAL NOTICE that the Director of the Arizona Department of Water Resources
("Department") has approved the Provider Profile submitted by the Town of Marana on June 18, 2009.
Effective January 1, 2010 and continuing until the effective date of any substitute conservation
requirements established in the Fourth Management Plan, the Town of Marana shall be continuously
enrolled and regulated under the Modified Non-Per Capita Conservation Program ("MNPCCP"). Please
carefully review this notice regarding the MNPCCP requirements established in the Third Management
Plan ("TMP") Section 5-104 and all other applicable TMP requirements, including the individual user
requirements in Section 5-11 1, the distribution system requirements in Section 5-112 and the monitoring
and reporting requirements in Section 5-113.
Based on the total number of residential and non-residential service connections in your distribution
system, you are regulated as a tier II municipal provider. A tier II municipal provider is required to
implement a public education program and five additional water conservation measure(s) ("Best
Management PracticesBMPs") selected from TMP Appendix 5-M and identified in your approved
Provider Profile. The Department has approved the implementation of the following BMPs as selected in
your Provider Profile.
• BMP Category #2: New Homeowner Landscape Information
• BMP Category #3: Residential Interior Retrofit Programs
Customer High Water Use Inquiry Resolution
Customer High Water Use Notification
• BMP Category #7: Development of Industry Partnerships
A municipal provider regulated under the MNPCCP may substitute an approved BMP, other than the
public education BMP, during a calendar year with one or more BMPs listed in Appendix 5-M. A
substitute BMP must be reasonably relevant to your existing service area characteristics or water use
patterns. If you substitute an approved BMP, you must notify the Department of the substitution in your
next Conservation Efforts Report. The Department recommends that municipal providers submit an
updated Provider Profile when substituting a BMP or if three years have elapsed since the Provider
Profile was last updated.
If the total number of service connections in your water distribution system increases to a higher tier
level, as described in TMP 5-104(D)(3), you must submit to the Director a new Provider Profile that
includes the required number of BMPs for the higher tier level within sixty days after you become aware
of the tier increase. In that event, you must continue implementing the BMPs as described in your
previously approved Provider Profile until receiving approval of the newly submitted Provider Profile
from the Director.
You must submit a Conservation Efforts Report with your Annual Water Use and Withdrawal Report by
March 315` of each calendar year (See TMP 5-104(E)). The Conservation Efforts Report is used to
determine your compliance with the MNPCCP. The Conservation Efforts Report must include the
following components:
• Description of the Public Education Program and other BMPs implemented during the previous
calendar year, including the efforts made to implement the BMPs.
• Assessment of the results of the implemented BMPs.
• Plans for implementing BMPs during the current year.
• A copy of your current rate structure, if a rate change has occurred during the previous calendar
year.
• If a new BMP was substituted for an approved BMP during the previous calendar year, a
description of the substitute BMP and an explanation of how it is relevant to your existing service
area characteristics or water use patterns.

Second Notification of 2000 through 2006 Gallons per Capita per Day (GPCD)
and Lost and Unaccounted (L&U) for Water Percentages
Dear Ms. O'Brien:
The Tucson AMA has completed a second review of your 2000 through 2006 Annual Water Withdrawal
and Use Reports. Based on updated 2000 census data which provided a more accurate accounting of
population, the Department has recalculated both the Annual Total GPCD Requirement and the Annual
Total GPCD rate and has adjusted your flexibility account balance accordingly. The total Lost and
Unaccounted for water percentage for your system in those years did not change from the original
notification. Please retain this second notification letter andassociated attachments for your records as
they replace the original notification you received in 2008.
The recalculations used to determine the Annual Total GPCD Requirement, Annual Total GPCD rate,
total Lost and Unaccounted for water percentage and flexibility account balance for your system for each
year are included in the enclosed attachments.
The Department will continue to calculate the Annual Total GPCD rates for all water providers regardless
of their municipal conservation program enrollment. Annual Total GPCD rates for water providers
enrolled in the Modified Non-Per Capita Conservation Program (`MNPCCP'), will be calculated as one
measure of MNPCCP effectiveness and not for compliance and enforcement purposes. Water providers
enrolled in conservation programs other than the MNPCCP will continue to be regulated by the
requirements of their current conservation program, including Annual Total GPCD rates, if applicable.

The Tucson AMA has completed a review of your 2007 and 2008 Annual Water Withdrawal and Use
Reports. Based on the reported water use and the service area population estimate for your system for those
years, the Department has calculated both the Annual Total GPCD Requirement and the Annual Total GPCD
rate and has adjusted your flexibility account balance accordingly. The Department has also calculated the
total Lost and Unaccounted for water percentage for your system in those years.
The calculations used to determine the Annual Total GPCD Requirement, Annual Total GPCD rate, total
Lost and Unaccounted for water percentage and flexibility account balance for your system for the years
2007 and 2008 are included in the enclosed attachments. Please retain this 2007 and 2008 notification letter
and associated attachments for your records.
The Department will continue to calculate the Annual Total GPCD rates for all water providers regardless of
their municipal conservation program enrollment. Annual Total GPCD rates for water providers enrolled in
the Modified Non-Per Capita Conservation Program (`MNPCCP'), will be calculated as one measure of
MNPCCP effectiveness and not for compliance and enforcement purposes. Water providers enrolled in
conservation programs other than the MNPCCP will continue to be regulated by the requirements of their
current conservation program, including, if applicable, Annual Total GPCD rates.
Lost and Unaccounted for water is water that is lost from the system during the transportation or distribution
due to seepage, evaporation, leaks, phreatophyte use or other causes. It is calculated by subtracting metered
or estimated water deliveries from the total water withdrawn, diverted or received during the year. Deliveries
of effluent directly from awastewater treatment facility arenot included in the calculation. Water providers,
regardless of the conservation program enrolled in are required by the management plan to limit their annual
Lost and Unaccounted for Water to ten percent of the total amount of water withdrawn, diverted or received
during the year.
