Regular Council meetings are usually held the first and third Tuesday of each month. at 7:00 p.m. at the Marana Town Hall, although the date or time may change, or Special Meetings may be called at other times and/or places. Contact Town Hall or watch for posted agendas for other meetings. This agenda may be revised up to 24 hours prior to the meeting. In such a case a new agenda will be posted in place of this agenda. Speaking at Meetings If you are interested in speaking to the Council during Call to the Public, Public Hearings, or other agenda items, you must fill out a speaker card (located in the lobby outside the Council Chambers) and deliver it to the Town Clerk prior to the convening of the meeting. All persons attending the Council meeting, whether speaking to the Council or not, are expected to observe the Council Rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 COUNCIL CHAMBERS, May 12, 2009, 6:00:00 PM To: Mayor and Council From: Erik Montague ,Finance Director Strategic Plan Focus Area: Progress and Innovation Subject: Presentation: Relating to Finance; discussion and consideration of the proposed comprehensive fee schedule and various rate and fee adjustments Item P 1 Discussion: Fees charged to customers for various services and programs make up a small but important portion of the Town's revenue portfolio. Since the Town's incorporation, fees and rates have been adopted as needed to offset the cost of services or programs and reduce dependence on the general fund. Currently, the Town charges over 540 different rates or fees in a wide variety of departments. As part of the FY 2010 budget preparation process, staff initiated an effort to review and update fees in the following ways: 1) Create a comprehensive, centralized schedule of all fees and rates currently being charged to customers across all Town departments. 2) Determine where fees were duplicated or inconsistent and develop a more streamlined and transparent approach to charges. 3) Propose fee increases, decreases, eliminations or additions where appropriate based on surveys of ,other comparable jurisdictions and cost-of-service analysis. The new proposed comprehensive fee schedule includes important changes that will benefit both the Town and its many customers. To promote consistency across all departments, fees for miscellaneous charges (e.g. copies, returned checks, late payments, etc.) have been standardized to a single rate. Additionally, fees which had been adopted but are no longer in use or no longer accurate have been deleted and/or replaced as appropriate. Finally, a small number of new fees and fee increases have been included based on the actual cost of providing the service or program to customers. Staff intends for a comprehensive review of all fees to become an annual exercise as part of the budget preparation process to keep the Town current and accountable to its customer base. The calculation of Building Safety Department permit fees utilizes the most recently published International Code Council Building Valuation Data, and any additional published general construction valuation data, along with the "Permit Fee Table." The building valuation and general construction valuation data shall be adjusted for regional variations in construction values. All permit fees are based on current market value of construction for the proposed project, unless otherwise noted. Either the valuation stated on the permit application or currently published valuation data, as adjusted for regional differences, will be utilized. The higher valuation amount will be used to calculate the permit fee. Basic process. The calculation of a building permit fee is a multiple step process: 1. The valuation of the proposed structure is determined, 2. That valuation is entered in the "Permit Fee Table" and the construction fee is determined, and 3. Applicable plan review, plumbing, mechanical and electrical fees are calculated from the construction fee. All fees are summed for the total building permit fee. For each structure a separate valuation is obtained by determining the square foot area of each occupancy and type of construction encompassed by the structure, multiplied by the dollar value per square foot taken from building valuation data. Tenant improvements. The valuation of tenant improvements shall be determined by either 10% of the valuation of the square foot method, or by submission of a contract value for the proposed work prepared by a certified construction estimator. The first tenant improvement for a shell building shall be calculated at 20% of the valuation, or by submission of a contract value for the proposed work prepared by a certified construction estimator. Calculation of construction fee. The construction fee is calculated using the "Permit Fee Table." The row in the table whose range includes the total valuation calculated as noted above is selected. The construction fee is the sum of the base fee plus any additional fee which is multiplied by each additional $100.00 or $1,000.00 (see the table), or fraction thereof, in total valuation. Calculation of total permit fee. The total calculated .permit fee is the sum of the construction, plan review, plumbing, mechanical and electrical fees. CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 COUNCIL CHAMBERS, May 12, 2009, 6:00:00 PM To: Mayor and Council From: Erik Montague ,Finance Director Strategic Plan Focus Area: Commerce, Progress and Innovation Item P 2 Subject: Presentation: Relating to Transaction Privilege Tax; amending the tax code of the Town of Marana by increasing the tax rate on transient lodging by three percent; and establishing an effective date Discussion: In accordance with the Town Code, the Town of Marana's transient occupancy tax, also known as "transient lodging tax" or simply "bed tax," is applied to the "gross income from the business activity of any hotel engaging or continuing within the Town in the business of charging for lodging and/or lodging space furnished to any transient." The bed tax does not apply to commercial or residential rentals, but rather any hotel/motel or other lodging property which rents rooms for temporary occupancy. Most bed tax revenues originate from non-residents (generally tourists or other travelers). The Town of Marana's bed tax rate is presently set at 3.0%, which is half or less than the bed tax rate charged by neighboring municipalities. The Town of Oro Valley and Pima County (unincorporated areas only) each charge a rate of 6.0% for their respective bed taxes, while the City of Tucson charges a rate of 6.0% plus a flat fee of $1.00 per room, per night. Tonight's presentation represents the first formal presentation of a proposed ordinance to increase the bed tax rate. The ordinance will be brought back to Council for adoption on May 20, 2009, with an effective date of July 3, 2009. Following adoption of this change, the Town is required to provide 60 days notice to the Arizona Department of Revenue who collects and remits this revenue on the Town's behalf. Staff is working with the Arizona Department of Revenue to determine if collections can begin as early as July 3, 2009, rather than July 21, 2009. In addition, staff is working with the Marana Chamber of Commerce to schedule educational sessions for affected businesses as soon as possible after adoption of this ordinance, so that businesses will have adequate notice to effect any software changes and personnel training. Financial Impact: An increase in the bed tax rate was included as one of the revenue enhancements contained in the Level I Budget Modifications presented to the Council on April 28, 2009. The modifications in all three levels were recommended by staff to close a $5.2 million dollar budget gap in FY 2010. The bed tax rate increase is estimated to result in an additional $500,000 in revenue. This program provides incentives to employees who voluntarily separate employment due to a retirement or a resignation and who notify the Town in writing by May 19, 2009 that they will end their employment with the Town, with their last day of work occurring no later than August 31, 2009. The SIP was adopted in order to include voluntary reductions in personnel. costs as part of the FY 2010 budget preparation process. The SIP as described in the program outline provided to Council on April 28, applies only for fiscal year 2010, defined as July 1, 2009 through June 30, 2010. Thus, as adopted, the SIP applies only to employees who separate between July 1, 2009 and August 31, 2009 who have properly notified the Town of their desire to participate in the SIP by the SIP deadline of May 19, 2009. However, since the SIP was adopted by Council two weeks ago, some employees have come forward and expressed a desire to voluntarily separate their employment prior to July 1, 2009 and take advantage of the SIP incentives. This agenda item seeks approval to expand the SIP program to apply to eligible employees who voluntarily separate employment between Apri129, 2009, the beginning of the SIP election period, and June 30, 2009, due to a retirement or a resignation and who notify the Town in writing by May 19, 2009 that they will end their employment with the Town. In addition, under the SIP as approved by Council, eligible employees electing to participate in the program will receive a 50% payout of their accrued sick leave. This item clarifies that only the participating employee's earned sick leave will be included in the calculation and not any donated leave the employee may have received from other employees pursuant to the Town's leave donation policy (Policy 4-10 of the Personnel Policies and Procedures). The second regular Council meeting in May would normally occur on May 19. Since that's the date set for the Town of Marana General Election, the regular meeting would normally be moved to the next day, Wednesday, May 20, unless the Council takes action to set it on another date. Based on the authority of Town Code section 2-4-1, Town staff has given notice in two pending rezoning actions (Advantage Materials and QuikTrip) that the meeting would be held on May 20. Town staff has now learned that the Marana High School graduation is scheduled for May 20, and that Council members may plan to be in attendance at the graduation ceremony. Consequently, Town staff has set this item to facilitate a Council decision on whether to go ahead and hold the meeting on Wednesday, May 20, or to move it to a different day. If the meeting is moved, people who show up for the two scheduled rezoning hearings will be met with a notice on the door indicating the date and time of the reset meeting. Legal staff believes that this is a defensible way to preserve the notice as already given, but there is some chance that a court would rule that the notice was not sufficient to move the date of the meeting. Consequently, there is some risk that moving the meeting away from May 20 could require the Council to rehear the two rezoning cases currently set for May 20.
