LORFFICE AT 3g2-2601 FOR QUESTIONS ORGANIZATION WIDE: A. BUILDING PLAN REVIEW: • Plans for the new Marana Health Center are currently under review. • The "Alive Church and Java Coffee Shop" tenant improvement plans are currently under review. • Staff are reviewing shop drawings for a new parking structure for the new Alicat Scientific project. • Miramonte Homes submitted three more new model home plans for review. • Staff are currently reviewing several swimming pool, patio wall and small residential plan sets along with an assortment of other smaller projects. -2- INSPECTIONS: • Our building inspectors continue to keep busy on an assortment of inspections ranging from commercial and residential construction to swimming pools, patio walls and dwelling addition. • Inspection work on the Ritz Hotel project is now at it's highest level. ADMINISTRATION: • An agreement has been reached with the Pima County Health Department "Vector Control" program for mosquito abatement treatment of our abandoned swimming pools. We continue to receive complaints each week regarding abandoned pools. B. CAPITAL IMPROVEMENT PROJECTS CAMINO DE MANANA PROJECT 2001-OS2 • Subcontractor selection continues • Plan revisions based on plan review comments underway • Real property acquisitions at 90% • Final GMP to be submitted by June 17, 2009 • Conducted an Open House public meeting on May 26, 2009. Over 100 people attended. TWIN PEAKS PROJECT 2001-044 • Construction partnering meeting was held May 27, 2009. • Construction will begin approximately June 2009. • Construction period is approximately 18 months. PAVEMENT REHABILITATION PROGRAM 2001-049 • Met with ADOT who is administering the $3.7 million that is allocated to the Town of Marana. • The projects will entail the mill and overlay of Twin Peaks Road over Rattlesnake Pass, the Overlay of Tangerine Road between I-10 and the eastern Town Limits, Marana Road between I-10 and the western Town Limits, and Sandario between Marana Road and Moore Road. • The Town is working to get the environmental clearances that are required by the Federal ARRA. BARNETT LINEAR CHANNEL PROJECT 2003-016 • The Town is putting the finishing touches on the 100% drainage design. • The hydraulic design has been checked against changes that have been made to the plans since the original calculations were performed. • We anticipate the complete plans in a week or two. These plans take into consideration the existing flooding being mitigated east of I-10 and the proposed direct discharges from anticipated development west of I-10. No direct discharge from development is anticipated from developments east of I-10 as part of these plans. • The Town of Marana received an agreement from the UPRR that allows the Town of Marana to purchase for $41,400 the right to build drainage improvements across UPRR property. The agreement also covers which cost will eventually be born by the UPRR and the Town of Marana when the project is constructed across their right-of-way. This agreement needs -3- approval from the Town Council and a check for $41,400. The project does not currently have this funding available. The Town of Marana has identified a significant number of tasks that have been or can be completed in-house. This has resulted in a reduced cost to complete the construction documents and perform the survey and roadway crossing and utilities crossing designs needed to complete the project. The original proposed project cost was $428,485 and has been reduced to $158,535 by eliminating tasks such as performing design work for the CMID siphons, and roadway drainage in house. Survey for the siphon design was completed by our CIP inspectors and GIS staff. Erosion control designs were performed in-house by CIP and Development Engineering. Due to the lack of a licensed surveyor on staff, more advance GPS equipment, roadway design software and the engineering experience to use it, it is not anticipated that further reductions in the design cost can be obtained at this time. TANGERINE FARMS LOOP ROAD • Project closeout in progress. • Preparing Draft of documents for project closeout Public Hearing in format from Bond Attorney. • Final quantities, costs and reassessment approach being calculated and coordination for closeout with Finance in progress. • Landscape Maintenance continuing through May 30, Inspection held May 6, punch list being established by O&M for takeover. • Record drawings and final project documentation being completed. CR WELL #2 EQUIPMENT, 12" OFFSITE MAIN, AND 15" SEWER MAIN REPLACEMENT • The project was advertised May 15th, 18th, 22nd and 26th. • The Bid Opening is scheduled for June 16, 2009. • A Pre-Bid Meeting is scheduled for June 4th, 2009. HONEA HEIGHTS WATER, SEWER, AND PAVING PROJECT: 2002-02 • Resolution of various real property, building safety, and zoning issues through intra- departmental communication/consultation is enabling additional properties to be included in Phase 1 of the project. • Site investigations are providing needed information for preparation of site plans, scope of work matrices to be incorporated into bid documents. • Honea Heights paving project is completed; mainline sewer plans with Marana Utilities/Westland Resources for PCRWRD/DEQ submittal preparation; water project completed. THORNYDALE TANGERINE INTERSECTION PROJECT 2006-012 • Landscape establishment is ongoing. • Closure of noise wall gaps at particular residential properties east of the project is pending execution of rights-of-entry and/or deed abandonments. Legal staff continues to contact and work with affected residents for needed responses. • Project was bid out, and the apparent low bidder is Southern Arizona Paving. The apparent low bid is approximately $251,000. -4- • Construction is estimated to start Late June, Early July 2009. THORNYDALE ROAD PROJECT: 2002-OS8 • C.I.P. and Legal are working in concert to issue preliminary deed abandonments to several residents which allow them to expedite closure of the noise wall gap at their particular properties with upgraded construction materials and methods beyond what the Town has offered. Wherever residents take on acceptable closure of the gaps themselves, this will provide cost savings to the Town. • Landscape establishment is ongoing. MARANA WATER 6-INCH WATER MAIN REPLACEMENT AT UNION PACIFIC RAILROAD MILE POST 962.09 • C.I.P. and the Utilities Department are jointly managing the project. • Westland Resources is completing revisions to the construction documents based on field data. gathered relative to the location and depth of underground utilities within UPRR's right-of- way, soil conditions, and intended means and methods. Revised construction documents will be submitted to UPRR for review and approval. Additionally, these same documents will be used as the basis for a needed ADOT right-of-way permit. • C.I.P. and Utilities Department personnel continue to coordinate closely with UPRR. SILVERBELL ROAD INTERCEPTOR PROJECT: 1999-OSO • Project complete; close out underway HONEA HEIGHTS WATER, SEWER AND PAVING PROJECT • Honea paving project is completed; mainline sewer plans with Marana Utilities/Westland Resources for PCRWRD/DEQ submittal preparation; water project completed. SILVERBELL/CORTARO DISTRICT PARK • NTP was issued on May 26, 2009. • DL Withers will begin construction June 1, 2009. C. COMMUNITY DEVELOPMENT HONEA HEIGHTS III -SPECIFIC PLAN • Met to discuss the longitudinal cost analysis of the project as part of the FY 2010 CIP budget. MARANA BUILDS HABITAT • Town of Marana Build Days on May 30 is full and confirmed. • "Community Yard Sale" took place on May 23rd in the Arizona Pavilions parking lot behind Chili's. We raised $400 to Habitat for Humanity to support the Marana Build Habitat project. Co-sponsors were the Affordable Housing Commission and Marana Weekly News. SYDNEY PLACE • Pima County Sewer is fully approved • Final Platt tentatively approved by all departments -5- • Final submission being prepared for Council consideration and possible approval. DISCRETIONARY FUNDING • Completing work on 2010 Outside Agency Funding procedures, application, and scoring worksheet. • Drafts sent to Legal and Finance for comment. HOUSING REHABILITATION PROGRAM • Continuing work on two Marana residences • Completed work started during Comcast Cares Days. AFFORDABLE HOUSING PROGRAM • Met with the Regional Housing Coalition and representative from the faith-based community on a regional housing plan. EMPLOYER ASSISTED HOUSING PROGRAM • Pending closings for two (2) employee home sales GRANTS • Work completed and funding requests sent to the Arizona Criminal Justice Commission for Fire Suppression in the Crown Victoria police cars. 61 fire suppression systems were installed over atwo-day period. • Continuing to work with the Governor's Office for Highway Safety for FY 2007 DUI program grant revenues never received. • Submitted two requests to the Governor's Office for Highway Safety for FY 2010 funding of the DUI Task Force and Speed Awareness Programs. Total requests equal more than $65,000. • Submitted an application to the National Bullet Proof Vest Program fora 50°1o cost share for the purchase and shipping of 19 BPVs during FY 2010. • Submitted reimbursement request for 12 BPVs purchased during FY 2008-2009. • Attended the community meeting on Stimulus Energy Block Grant funding. • Met with AZDOT -Airport Division staff to discuss payment under airport grant funded contracts. LEGAL WASTEWATER LTTIGATION/TRANSITION • Initial scheduling is being coordinated for June and July anticipated key witness depositions. • Requests for production of documents delivered to Pima County on May 4 and May 7 are anticipated to result in Pima County's delivery of background documents to Marana's attorneys during the first half of June. • A fully revised draft PAG 208 Amendment is being prepared by Town representatives, to address comments received by the PAG 208 Scope of Work Task Force, and is expected to be delivered to the Task Force within the next two weeks. • Legal staff expects to draft Town Code wastewater provisions beginning in July, after completion of the pending utilities engineer procurement process. CMID IGA NEGOTIATIONS • On May 21, the Town Council approved the CMID/CWUA Settlement and Purchase AGREEMENT WHICH WAS THEN APPROVED BY THE CMID/CWUA BOARDS ON MAY 22. • Exhibit I to the CMID/CWUA Settlement and Purchase Agreement, addressing ingress, egress and utility access to the well sites being acquired by the Town of Marana under the Settlement and Purchase Agreement, is continuing to be negotiated and revised to reflect available title information. • Upon finalization of Exhibit I, the parties anticipate that a fully executed, finalized CMID/ CWUA Settlement and Purchase Agreement will be delivered to Title Security of Arizona so that escrow may be opened. • As required by Paragraph 8 of the CMID/CWUA Settlement and Purchase Agreement, Town staff is arranging for the six well sites being acquired by the Town of Marana under the Agreement to be surveyed, so that insurable title may be obtained to the six well sites. • After close of escrow on the CMID/CWUA Settlement and Purchase Agreement, Legal staff anticipates completing negotiations with CMID concerning property rights needed to close out the Tangerine Farms Road project (the roadway crossings of the CMID channel adjacent to the I-10 Frontage Road and exchange of land for a wellsite in the Gladden Farms area). POLICE DEPARTMENT PERSONNEL MATTERS • Jane Fairall continues to monitor the MPOA lawsuit re: the Harris PARB hearing. The MPOA has filed a notice of appeal to the Court of Appeals. • Jane Fairall continues to monitor and coordinate with outside counsel the lawsuit brought against the Town by Barbara Harris, Lanell Garbini and Michelle Ochoa. As of May 5, 2009, the claims of Garbini and Ochoa were dismissed with prejudice; Harris' claim is ongoing; as of May 21, 2009, Harris' Title VII discrimination/retaliation claims (the bulk of the lawsuit) were dismissed. Harris' Equal Pay Act claim is ongoing. • Jane Fairall is monitoring and coordinating with outside counsel regarding Harris' newly filed EEOC charge. -7- PUBLIC WORKS PROJECTS • On Apri124, Legal Department Staff filed a stipulation for immediate possession in its first condemnation action and on Apri129 filed its second condemnation action for the Camino de Mariana project. • Negotiations continue with the property owners relating to the right of way needed for the Camino de Manana/Dove Mountain extension project headed up by Cedric Hay. Of the 52 parcels which are affected by the project we have completed our acquisitions on 38, are still in discussions with representatives for six parcels and the 8 remaining parcels will either be acquired from the banks who have initiated foreclosure proceedings or through condemnation. OTHER NOTABLE CIVIL MATTERS • The Legal Department prepared the agenda materials and quit claim deeds of abandonment for the Town Council's May 21 adoption of the resolution of abandonment for any public right of ingress and egress over the easement within and immediately west of the Saguaro Ranch project and located within the Town limits of Marana. • Frank Cassidy is scheduled to make a presentation at the June 5 State Bar of Arizona Land Use Law Update seminar in Phoenix on the subject of Arizona constitutional limitations on economic incentives to developers after Turken v. Gordon. • Frank Cassidy is finalizing a revised draft of a development agreement for the Marana Mercantile project, addressing reimbursements for public infrastructure costs anticipated to be incurred by the. developer for nearby public improvements. • Frank Cassidy filed a responsive pleading in a Board of Adjustment Appeal entitled Ohl v. Marana Board of Adjustment. • The Legal Department has prepared draft amendments to Title 14 and Title 16 of the Town Code to combine the Utilities Board and the Utilities Commission. Based on the Utilities Commission's recommendation at its May 12 meeting, the amendments are anticipated to be forwarded to the Council for consideration on June 2. • Frank Cassidy and Karen Cushing are working on a draft reformat of the Land Development Code. • Cedric Hay has prepared a draft letter which was sent by May 18 to Metron Farnier on behalf of the Water Utilities Department requesting that a refund for certain equipment be authorized. • Jane Fairall is working with Manager's Office and HR regarding options for budget reductions to offset anticipated budget shortfall for FY 2010, including legal issues surrounding organizational restructuring. • Jane Fairall is working with the Parks and Recreation Department to develop a policy manual for park facility users. • Jane Fairall has drafted five separation agreements for participants in the Separation Incentive Program (SIP). • Cedric Hay is preparing a suggested process of debarment to be used by the Public Works Division. • Cedric Hay and Jan Catalano continued preparation of Deeds of Abandonment for twelve of sixteen property owners who have expressed a willingness to accept the abandoned right of way along the Thornydale Rd. project. Deeds of abandonment have been completed for four of the twelve individuals; once legal descriptions have been prepared these will be sent to the Town Manager for final execution. The remaining deeds should be completed within the next week. -8- • Jane Fairall is working with Finance and the Manager's Office to finalize a new comprehensive Town fee schedule. • Cedric Hay and Jan Catalano are working with staff from Pima County Regional Flood Control District to finalize a property acquisition for the Twin Peaks Project. ~ Cedric Hay continues to work with attorneys for the parties associated with a tax lien foreclosure case in an attempt to acquire property in Honea Heights which will be used for affordable housing. • Cedric Hay and John Huntley met with representatives from the Town of Sahuarita to assist them with the development and implementation of their own building and zoning enforcement program. • Cedric Hay met with a citizen who was concerned about billboards in the Town of Marana. PROSECUTION ACTIVITIES AND STATISTICS: • Jane Fairall continues to consult with the MPD command staff regarding prosecution/criminal issues surrounding the Saguaro Ranch easement dispute. • Jane Fairall and Donna Marchinetti continue to draft a policy and procedure manual for Town Prosecutor's Office victims' rights implementation. • Laine Sklar represented the Town in a competency hearing in Pima County Superior Court at which the court ruled in the Town's favor and held that the defendant in an extreme DUI case is competent to stand trial. • Jane Fairall and Laine Sklar met with representatives from Motorola regarding the Prosecutor's Office's use of evidence obtained via the MPD's use of an in-car mobile digital recording system. • Jane Fairall and Laine Sklar met with representatives from the home detention monitoring company used by the Court Probation Department to discuss new equipment available and the services currently being provided. E. MARANA REGIONAL AIRPORT .1RP'TT(: TANK Design is under contact to Westland Resources Design is 92% complete Field samples were taken to be analyzed. BY-PASS APRON • Design is complete • 95% complete. In pavement lights will be installed the week of June 1 along with rock on edge of apron to prevent erosion of the surrounding ground. AIRPORT ACCESS ROAD • Landscaping is currently being completed • Final walk through will be on May, 21.2009. AIRPORT TERMINAL • Under design to Jacobs Carter Burgess -9- • Schematic design is 65°Io complete • Schematic design will be transferred to DWL • Design contract with DWL is being worked on AIRPORT CONTROL TOWER • Site Study is under contract with the FAA • Continuing to work with Gabrielle Giffords for construction funding • FAA completed on-site study of building heights • Marana attended the FAA AFTIL lab on 11/17 • FAA is working on final draft of the site study STATE LAND - ACQUIRE RIGHT OF WAY • The Airport has submitted an application to State Land to acquire utility and roadway right of way to the west of the airport. • State Land has received the application and it is being processed. • The airport has selected W.D. Schock to help with land issues around the airport. F. OPERATIONS AND MAINTENANCE FLEET SERVICES: • Completed 61 fire panels (gas tank) on MPD patrol vehicles. • Installed 40 "stop sticks" in trunk of patrol vehicles. • DP2 (Digital Controller, 2nd generation) video system is being discussed by MPD and Fleet Services for best process to install and utilize. • Small Engine Shop is very busy due to growing season with Parks and Rec and Operations and Maintenance requests for service. STREET MAINTENANCE: • Repaired damaged pavement on the corner of Star Commerce Drive and Ina Road (CRT request by a citizen). • Placed jersey barricades at either end of Saguaro Springs roadway to prohibit vehicles from driving on the roadway. There are several pavement discrepancies and the road has not been accepted by the Town. • Placed jersey barricades to block vehicular traffic on DeSpain Lane (in Farm Field 5, east of Sandario Road) due to pavement failure. This roadway has not been accepted by the Town. Barricades are placed to preserve public safety. • Working with the CIP group to improve drainage on Twin Peaks Road (west of Rattlesnake Pass). FACILITIES • Painted north hallway on third floor MMC by Manager's Office • Recalibrated emergency generator for MMC and MMC shelter to respond better to power surges and outages. • Johnson Controls is continuing work on the Number 1 chiller. They have withdrawn all of the Freon and are weighing it to determine how much has leaked out and what amount to put back -10- in (preliminary estimate of 1801bs.). Gaskets at either end of the centrifugal elbow are being replaced to factory specifications. Once the Number 1 Chiller is repaired, Johnson Controls will inspect the Number 2 Chiller for the same condition. No conclusion has been reached regarding the mysterious noise in the Board Room from May 12, 2009. All equipment (mechanical and electronic) in the vicinity of the room has been checked out and nothing unusual was discovered. ADMINISTRATION: • Evaluating Statement of Qualifications from 30 engineering firms for As-needed Engineering Services. • George Pesina, Sr. has resigned his position as Facilities Supervisor. No final date has been set as of yet. • Received two bids to repair bridge on Continental Reserve Loop Drive (damaged May 14, 2009) both are in the vicinity of $12,500. • Turned in specifications and requirements for RFQ for street sweeping services to Finance for advertisement. G. PARKS AND RECREATION MARANA CULTURAL AND HERITAGE PARK • Staff is working with the Tucson Pima County Arts Council to coordinate artist selection for public art at Marana Heritage and Cultural Park. First meeting of art panel set for June 15. SILVERBELL-CORTARO DISTRICT PARK • Staff is coordinating construction with C.I.P. TORTOLITA MOUNTAIN TRAILS WILD BURRO TRAILHEAD • Staff is meeting with representatives from Cottonwood Properties next week to schedule trail head construction. • Tucson Pima County Arts Council is coordinating selection of artist for public art component. First meeting of art panel set for June 15. • Tortolita Trail System visitors map is being finalized and prepared for printing. ORA MAE HARN PARK IMPROVEMENTS • Irrigation well located on Barnett Road is down. Temporary hook up to potable water accomplished by Marana Utility. PARKS AND RECREATION COMPREHENSIVE MASTER PLAN UPDATE • Staff is reviewing draft documents. RE CREATION • Successful pool opening May 23. • Pool staff is coordinating volunteer swim team program. • Summer staff training is complete. Summer programming begins June 1. -11- JULY 4TH STAR SPANGLED SPECTACULAR AT ARIZONA PAVILIONS • Staff is coordinating this year's Star Spangled Spectacular Event at Arizona Pavilions with area businesses and Town Departments. • Event plan is being finalized. • Publicity campaign starts June 1. • Council update June 9. POLICE MEMORIAL DAY WEEKEND DUI ARRESTS • Total of five DUI arrests were made • Several traffic stops resulted in Misdemeanor Arrests (warrants), criminal citations, repair orders, civil citations and verbal warnings NEW SERGEANTS ORIENTATION PLAN • Develop Sergeant performance objectives • Department strategic plan budget • Department strategic plan goals and objectives SAGUARO RANCH EASEMENT • Effective May 26, 2009 MPD began enforcement for trespassers • On May 27, 2009 two individuals were arrested for criminal trespassing ORANGE GROVE COMMUNITY INITIATIVE • On May 16, 2009 the Criminal Investigations unit conducted a second community awareness campaign at the Cantera Apartment Complex, 3500 W. Orange Grove Road. • The first part of this initiative was held on April 18th. This campaign consisted of Detectives and uniform Officers going "door to door" and providing residents with educational information on reporting suspicious activity and crimes in progress. • Detectives made contact with 55 residents of the complex. This campaign. is being supported by added patrols of the complex. We will be monitoring the reported crime in the area to determine if the added patrols and educational material have had a positive impact. TRAINING • On May 29, 2009 four recruits will complete the Post Academy. • On May 30, 2009 one lateral officer will begin a four week FTO process. NEIGHBORHOOD WATCH • On May 9, 2009 attended Gladden Farms Summerfield community block party and talked with residents about interest in starting a Neighborhood Watch. One couple offered to get it going and take the lead. .J. TOWN CLERK CREW BL MARANA 101 • We will begin advertising in late June for the Fa112009 CREW program. CITIZEN ADVISORY COMMISSIONS • Advertisement for the three PARB citizen positions is posted. The application is online and available through the Town Clerk's page of the website: • Staff is working with the Council task force to streamline the criteria for citizen advisory commission participation and outcomes. ELECTIONS • Final General Election results yielded a 17.1% voter turnout (out of 17,715 registered voters). There were 523 polling place ballots cast, 2,478 early ballots, and 22 verified provisional ballots cast for a total of 3,023. -14- Elected were Carol McGorray with 1,444 votes and Jon Post with 1,736 votes. Patti Comerford and Herb Kai were elected in the primary. All four will be sworn in at the June 2, 2009 Council meeting and presented with Election Certificates. The Alternative Expenditure Limitation (Home Rule Option) passed 63% to 37%. The final vote was 1,616 in favor and 946 opposed. RISK RETENTION • The Arizona Municipal Risk Retention Pool approved a property casualty dividend for Marana tentatively calculated at $78,011 for FY 08-09 and a tentative $37,568 workers' compensation dividend for the same period. These will be applied as a credit against premiums. MISCELLANEOUS • Staff continues to work with the Manager's Office on a Code of Ethics handbook for Council use. L.
