Regular Council meetings are usually held the first and third Tuesday of each month at 7:00 p.m. at the Marana Town Hall, although the date or time may change, or Special Meetings may be called at other times and/or places. Speaking at Meetings If you are interested in speaking to the Council during Call to the Public, Public Hearings, or other agenda items, you must fill out a speaker card (located in the lobby outside the Council Chambers) and deliver it to the Town Clerk prior to the convening of the meeting. All persons attending the Council meeting, whether speaking to the Council or not, are expected to observe the Council Rules, as well as the rules of politeness, propriety, decorum and good conduct. CIVIC CENTER DRIVE, MARANA, ARIZONA 85653 COUNCIL CHAMBERS, June 9, 2009, 6:00:00 PM To: Mayor and Council From: Gilbert Davidson ,Town Manager Strategic Plan Focus Area: Commerce Item P 1 Subject: Presentation: Relating to Economic Development; update on the Marana Economic Roadmap strategic planning process Discussion: The Marana Economic Roadmap is identified in the Town's recently-adopted strategic plan as the top priority initiative under the "Commerce" focus area. The Roadmap is intended to lay the foundation for Marana's fixture economic development decisions by bringing together diverse organizations and industries from throughout Southern Arizona to engage in discussion, data sharing and visioning. The collaborative process will result in a strategic plan that will be reviewed by the public and eventually considered for adoption by the Mayor and Council. The stakeholders involved in the Roadmap have formed a Technical Advisory Committee (TAC) to begin the complex task of assembling a complete economic picture of Marana. The Town is again. working with Partners for Strategic Action, Inc. (PSA) for facilitation of TAC meetings and assembly of the draft Roadmap plan. The TAC held its first meeting on May 28, 2009 and will meet next on July 9, 2009. The meetings will occur on approximately a monthly basis thereafter, with expected completion of a draft document by the end of the calendar year. The TAC includes many regional stakeholders, including representatives from utilities, education, Town Council, citizen commissions, major employers, small businesses, tourism and hospitality, the Marana Chamber of Commerce, industrial brokerages, and Tucson Regional Economic Opportunities, Inc. (TREO). This presentation item has also been scheduled per the Town Council's direction at its May 5, 2009 meeting that a discussion be held regarding the Town's current and future relationship with TREO. Since its beginning at the Avra Valley Regional Airport 10 years ago the event has brought the community together for a traditional celebration that brings family fun and enjoyment to Marana's citizens and visitors. Subject: Presentation: Relating to Parks & Recreation; an update on the July 4th Star Spangled Spectacular to be held. at Arizona Pavilions Discussion: Ora Mae Harn Park has been the venue for the Star Spangled Spectacular since the late 90's. As the event and the Town grew, the logistics of providing a safe event for all the people wishing to see Marana's July 4th fireworks show became more complicated and expensive. As the 2009 event approached, an idea was generated to move the venue to the new district park in Continental Ranch once it was completed. As the Town and the regional financial situation worsened, thought was given to move the event to a location where the Town's business community might gain some advantage from the added traffic. Arizona Pavilions, one of the Towns major business centers, was considered. The idea was presented to the Parks and Recreation Citizen's Advisory Commission at their April 16th meeting, and the Commission approved the idea and moved to recommend it to the Town Council. The Council approved the recommendation at their Apri128th Special Meeting. Staff began planning for the event at its new venue immediately. Weekly meetings with Arizona Pavilion business owners and partners began that first week in May and continue. As a result of those meetings, Comcast has donated $10,000 to sponsor the fireworks display. The Pines Golf course is planning an entertainment venue on their driving range with music, food, drink, and activities. Boston Pizza is entertaining the younger crowd with music, batting cages, and games. Cricket Communications is providing a jumping castle and face painting for the little ones. Tower Theatres will have movie specials and a fireworks viewing area convenient to the theatre with food and drink. The Native New Yorker and Nana's Kitchen will feature outdoor dining and music. La Quinta Inns will be running room specials. Continental Ranch Development is providing space for a fireworks viewing area and the Town's Mobile Stage. Staff is coordinating entertainment, weekly meetings have occurred with Parks and Recreation staff, Traffic Engineering, Marana Police, and Street Maintenance to insure that all traffic, safety, and site issues have been addressed. Staff has coordinated the fireworks launch site with Northwest Fire and the Town Environmental Division. First Aid is being coordinated between Recreation staff and Northwest Fire. The business community, Town Departments, and residents have come together to produce a quality event for the community and region.. Since the Town's incorporation, fees and rates have been adopted as needed to offset the cost of services or programs and reduce dependence on the general fund. Currently, the Town charges over 540 different rates or fees in a wide variety of departments. As part of the FY 2010 budget preparation process, staff initiated an effort to review and update fees in the following ways: , 1) Create a comprehensive, centralized schedule of all fees and rates currently being charged to customers across all Town departments. 2) Determine where fees were duplicated or inconsistent and develop a more streamlined and transparent approach to charges. 3) Propose fee increases, decreases, eliminations or additions where appropriate based on surveys of other comparable jurisdictions and cost-of-service analysis. The new proposed comprehensive fee schedule includes important changes that will benefit both the Town and its many customers. To promote consistency across all departments, similar fees have been standardized to a single rate. Additionally, fees which had been adopted but are no longer in use or no longer accurate have been deleted and/or replaced as appropriate. Finally, a small number of new fees Special Council Meeting -June 9, 2009 -Page 8 of 63 and fee increases have been included based on the actual cost of providing the service or program to customers. The Mayor and Council reviewed the proposed fee schedule at its May 12, 2009 meeting as well as the building plan review and building permit fee schedule and fee calculation method included in the next agenda item. The Council recommended that both items be brought back for consideration at tonight's meeting. Since that time, there have been several existing, inadvertently overlooked items added to the fee schedule that should be noted: 1) Development Plan; Application Fee 2) Public Improvement Construction and Repayment Agreement; Application Fee 3) Public Improvement Construction and Repayment Agreement; Annual Administration Fee 4) Election Signs; Blanket Permit Fee 5) Signs; Off-premise Development Kiosk Sign Program; Modification Fee 6) Vehicle Storage Fee; Base Fee 7) Vehicle Storage Fee; Daily Rate 8) Sexually oriented business license 9) Sexually oriented business employee license None of the above listed items are new fees nor is staff recommending any changes to existing fees for these items. One new fee has also been proposed, based on the cost to provide the service to customers. 1) Commercial Public Records Request; Base Hourly Rate (applies to public records requests seeking information that is to be re-sold for profit) Finally, per Utilities Commission and Mayor and Council request, the fee for a new water service connection has been increased as directed. This item is as a public hearing pursuant to Chapter 14-11 of the Town Code. Pursuant to that Chapter, all proposed changes to Title 14 (Water) of the Town Code must first be presented to the Utilities Commission for its recommendation and then considered by Council following a public hearing. The Utilities Commission approved the proposed changes at its May 12, 2009 meeting. Staff intends for a comprehensive review of all fees to become an annual exercise as part of the budget preparation process to keep the Town current and accountable to its customer base. Financial Impact: Staff estimates that adoption of the proposed comprehensive fee schedule, including the building plan review and building permit fee schedule and fee calculation method in the next agenda item, will generate approximately $100,000 in additional revenue in FY 2010. D. All charges for a license required by this chapter shall be paid in advance and in lawful money of the United States of America at the office of the town clerk. E. Any license issued pursuant to this chapter shall expire and a renewal charge for all licenses provided in this chapter shall become due and payable on the anniversary date of the issuance of the license and every anniversary date thereafter. Any new license charge shall become due and payable and be paid on or before the day of commencing to carry on, transact, or practice the trade, calling, profession, occupation or business for which a license is required by this chapter. A request for meter re-read or meter retest, paid for by the customer, shall constitute a challenge to the accuracy of the water bill. All connection fees are to be retained in a separate and special fund and account to be used for water source development to upgrade and improve existing systems. Funds could be used to pay for appropriate portions of any new source development that was partially paid for by a developer to serve a new area and which has excess capacity that could be interconnected and benefit existing customers. Funds could also be used to develop facilities to take and treat C.A.P. water if it were to become a viable alternative for existing sources in the future. H. Set charges for installations reflect estimated expenses and are the required up front charges. These are estimated charges for the simplest type of installation. The actual cost of installation will be billed as determined by the Marana municipal water system. The actual cost will be increased in the case of pavement cutting, excessive length, rocky ground, or any other additional cost inflating factors, or if the actual costs are less than the installation charge, the excess will be refunded. Since the installation of large meters involves such variable situations, these will be evaluated individually and an estimate will be made in each case. The same policy of actual cost to Marana municipal water system would apply. Large meter installations can be made by the customer's contractor provided the contractor builds to town standards and furnishes proof of contractor licensing and town business licensing. All final inspections and approvals shall be made by Marana municipal water system personnel. I. Where the water system, including wells and all infrastructure, is paid by the developer, the developer shall not pay the installation and connection charge per ^°^*~^^ , ~ ~ ~ the fee schedule, .but shall have a licensed contractor install the system with current technology in accordance with town standards. Section 14-7-3 Other service charges The following service charaes are established, the amounts of which are set forth in a fee schedule adopted by the council and amended from time to time A. New service establishment fee: $~ The new service establishment fee is for the cost of establishing the new customer service account during regular working days (Monday through Friday) between the hours of 9:00 a.m. and 4:00 p.m., and requires 24 hours notice. No service connections will be made after hours, weekends or holidays except in an emergency situation as determined by the Marana municipal water system. B. Noncompliance may result in discontinuance of water service without further notice. B. Backflow prevention assemblies installed prior to enactment of this chapter and which do not comply with the requirements set forth in this chapter, shall be replaced with assemblies which comply with the standards set forth in this chapter. Upon development of any property within or outside the Town limits for which an Additional Capacity Public Infrastructure Improvement (hereinafter "Public Improvement") project will be constructed, the owner or developer (hereinafter "owner/developer') paying the cost of the Public Improvements may request the Town to enter into a Public Improvement Construction and Repayment Agreement (hereinafter "Repayment Agreement") to authorize. construction of the Public Improvements and to collect reimbursement amounts from the developers and owners of parcels specifically benefited by the project located within or, as permitted, outside the Town. B. Any owner or developer who wishes to enter into such an agreement, shall complete an Application for Public Improvement Construction and Repayment Agreement on a form to be approved by the Town Engineer. Upon submission of the completed application, the applicant shall tender an application fee in an amount established by a fPP schedule adopted by the council and amended from time to time, said fee to cover, among other things, the costs of publication, legal notices, legal fees, engineering fees, and other costs associated with the processing of the application. This application fee shall be non-refundable. The Repayment Agreement shall designate the parcels and persons who are entitled to reimbursement amounts and shall include a diagram of the properties and respective amounts from which reimbursement amounts may be collected. B. The Repayment Agreement shall set forth the total of the reimbursement amount to be paid to the Town, which agrees to pay such reimbursement amounts to the owner/developer. The total of such reimbursement amounts shall not exceed that portion of the agreed construction costs of the Public Improvement allotted to the 'property outside the area of the owner/developer. The Repayment Agreement shall be for a term not to exceed ten (10) years commencing with the date of approval by Resolution, and may terminate earlier if the total amount provided for by Subsection 04.06.04 is repaid. C. The approved construction costs as described in Subsection 04.06.04 will be used for calculation of all reimbursement amounts. D. Upon entry into a Repayment Agreement with the Town, the owner/developer shall have the right to connect to the Public Improvement in consideration for their entry into the Repayment Agreement. E. The engineering, plans and specifications required for a Public Improvement shall be prepared by the developer and approved by the Town Engineer prior to construction. The engineering costs for preparation of plans and staking of the special public infrastructure improvements on the property which are incurred by the owner may be included as determined by the Town Engineer in the agreed construction costs as provided in Subsection 04.06.04. F. The Town shall have sole and exclusive control of connections to the Public Improvements. Connections to the Public Improvements may only be made upon issuance of a written permit from the Town Engineer. It shall be unlawful to make a connection to a Public Improvement without a permit. Such connections may be removed by the Town and the costs of removal assessed to the party making connection. G. Prior to the Town's final inspection and acceptance of construction of the Public Improvement, all reimbursement amounts due by an owner/developer for repayment of the benefit which their property received from the Public Improvement shall be paid to the Town. H. The sign shall not be located within the dedicated public rights-of--way, and shall be setback a minimum of five feet from any. property line and no closer than fifteen (15) feet from the edge of pavement of a private street and shall be limited to an area that is outside the sight visibility triangle of any roads or driveways. C. The signs shall not be installed more than twenty (20) days prior to the election in which the candidates or issues are to be voted on. D. The signs shall be removed no more than five (5) days after the election. E. The maximum square feet of each sign shall not exceed thirty-two (32) square feet. F. The signs shall not be greater than ten (10) feet in height from grade. G. The signs shall not be illuminated. H. Since the Town's incorporation, fees and rates have been adopted as needed to offset the cost of services or programs and reduce dependence on the general fund. Currently, the Town charges over 540 different rates or fees in a wide variety of departments. As part of the FY 2010 budget preparation process, staff initiated an effort to review and update fees in the following ways: 1) Create a comprehensive, centralized schedule of all fees and rates currently being charged to customers across all Town departments. 2) Determine where fees were duplicated or inconsistent and develop a more streamlined and transparent approach to charges. 3) Propose fee increases, decreases, eliminations or additions where appropriate based on surveys of other comparable jurisdictions and cost-of-service analysis. The new proposed comprehensive fee schedule includes important changes that will benefit both the Town and its many customers. To promote consistency across all departments, similar fees have been standardized to a single rate. Additionally, fees which had been adopted but are no longer in use or no longer accurate have been deleted and/or replaced as appropriate. Finally, a small number of new fees and fee increases have been included based on the actual cost of providing the service or program to customers. The Mayor and Council reviewed the proposed fee schedule at its May 12, 2009 meeting, as well as the building plan review and building permit fee schedule and fee calculation method included in this agenda item. The Council recommended that both items be brought back for consideration at tonight's meeting. The calculation of building permit fees utilizes the most recently published International Code Council Building Valuation Data, and any additional published general construction valuation data, along with the "Permit Fee Table." The building valuation and general construction valuation data shall be adjusted for regional variations in construction values. All permit fees are based on current market value of construction for the proposed project, unless otherwise noted. Either the valuation stated on the permit application or currently published valuation data, as adjusted for regional differences, will be utilized. The higher valuation amount will be used to calculate the permit fee. Basic process. The calculation of a building permit fee is a multiple step process: 1. The valuation of the proposed structure is determined, 2. That valuation is entered in the "Permit Fee Table" and the construction fee is determined, and 3. Applicable plan review, plumbing, mechanical and electrical fees are calculated from the construction fee. All fees are summed for the total building permit fee. For each structure a separate valuation is obtained by determining the square foot area of each occupancy and type of construction encompassed by the structure, multiplied by the dollar value per square foot taken from building valuation data. Tenant improvements. The valuation of tenant improvements -shall be determined by either 10% of the valuation of the square foot method, or by submission of a contract value for the proposed work prepared by a certified construction estimator. The first tenant improvement for a shell building shall be calculated at 20% of the valuation, or by submission of a contract value for the proposed work prepared by a certified construction estimator. Calculation of construction fee. The construction fee is calculated using the "Permit Fee Table." The row in the table whose range includes the total valuation calculated as noted above is selected. The construction fee is the sum of the base fee plus any additional fee which is multiplied by each additional $100.00 or $1,000.00 (see the table), or fraction thereof, in total valuation. Calculation of total permit fee. The total calculated permit fee is the sum of the construction, plan review, plumbing, mechanical and electrical fees. The plan review fee is calculated at 65% of the construction fee determined above. The plumbing, mechanical and electrical fees are each calculated at 25% of the construction fee. As part of the effort, staff has also looked at ways to make the administration of the budget more transparent. Town staff analyzed best practices from other area jurisdictions and is proposing policies related to council travel, training, memberships, dues and community and public relations for council's consideration and adoption. The proposed changes if adopted would be effective on July 1, 2009, for the FY 2010 budget. The policies presented for council's consideration propose individual accounts for each council member in the aforementioned line items. The policies additionally create a process for requesting an expenditure from one of the line items and a "checks and balances" system for approving purchases. Staff will provide council members with individualized expense reports on a regular basis so that spending can be easily tracked. Travel and training includes any event which requires transportation and/or payment of a fee to attend. Funds shall only be appropriated for events, activities or organizations which can be demonstrated to directly benefit or positively represent the town through meeting the goals and objectives of the Strategic Plan. Funds shall only be used for the attendance or participation of a Town of Marana elected official staff member, or citizen board or commission member. Policy: When a council member wishes to attend an event or join an organization as described above, a check request form or Travel Advance Authorization Form must be filled out and routed through the approval process as specified below. The council member should additionally attach to the check request or Travel Advance Authorization Form event registration materials, a membership application, or any other available supporting documentation. The check request or Travel Advance Authorization Form shall require an approval signature from the Mayor, Town Manager and Finance Director. If the Mayor is requesting the travel or training expenditure, the signatures of the Town Manager and Finance Director shall be required for approval. If any of the aforementioned officials does not approve the request, then it shall be scheduled for a vote of the Town Council during open session. A majority vote of the Council shall constitute the final determination of approval or disapproval of the expenditure. Upon approval of the request, the Council Liaison or other designated staff shall complete travel arrangements/event registration or the membership application for the council member. No travel arrangements shall be made prior to approval of the request. Reimbursements for any amounts spent in excess of what was previously approved will require approval from the Finance Director. A receipt and a memo explaining the reason for the expenditure must be submitted for reimbursement to be considered. In the event that an individual council member exhausts his or her travel and training or membership budget before the end of the fiscal year, he or she may ask the other council members for a transfer of funds at a public meeting of the Town Council. Such a request must be placed on the agenda by the Mayor prior to the meeting. Any unspent travel and training or membership funds remaining at the end of the fiscal year shall be returned to the general fund. Funding may not be carried over from one fiscal year to the next. Policy: When a request for funds is made to the Town Council or to an individual council member, a check request form must be filled out and routed through the approval process as specified below. The check request shall require an approval signature from the Mayor and Town Manager. If either the Mayor or Town Manager does not approve the request, then it shall be scheduled for a vote of the Town Council during open session. If the Mayor is requesting the community funding expenditure, the signatures of the Town Manager and Finance Director shall be required for approval. If either the Finance Director or the Town Manager does not approve the request, then it shall be scheduled for a vote of the Town Council during open session. A majority vote of the Council shall constitute the final determination of approval or disapproval of the expenditure. In the event that an individual council member exhausts his or her community funding budget before the end of the fiscal year, he or she may ask the other council members for a transfer of funds in open session, during the "Future Agenda Items" section of the agenda. Such a request must be placed on the agenda by the Mayor prior to the meeting. A Funds Transfer Request must be completed, and submitted to the Finance Department for the appropriate signatures. Any unspent community funding remaining at the end of the fiscal year shall be returned to the general fund. Funding may not be carried over from one fiscal year to the next. All discussion and action regarding funding requests and community funding must comply with the. provisions of the Arizona Open Meeting Law. Special Council Meeting -June 9, 2009 -Page 63 of 63
