Grief Rd., Marana Other members of the public. I. Call to Order Mayor Ora Harn called the meeting to order at 7:03 p.m. II. Pledge of Allegiance Mayor Harn led the public in the pledge of allegiance to flag. the III. Invocation The Rev. Elwin Clifton, Jr. gave the invocation. IV. Roll Call The Town Clerk called the roll. Approval of Agenda Doug Mostyn moved to approve the agenda was seconded by Jo Rex and carried. as submitted. The motion VI. Approval of Minutes Since it appeared that a line was omitted at the bottom of page 3 of the minutes of January 2, 1991, David Morales moved to hold approval of these minutes until the next meeting. Bill Schisler seconded the motion and it carried. VII. Petitions and Comments Nelson Sabbe of the Chamber of Commerce, 12418 N. Sandario Road, thanked Council for their support on their application to the R.E.D.I. Program. They are meeting regarding the housing project tomorrow, January 16, at 2:00 p.m. They need to cut corners wherever possible to make this work. There is a problem with the existing sewer. VIII. Announcements Leilani Schisler, 12561 N. White Ave., said that last Sunday's paper listed the wrong date for the Afternoon of Art and Music. The correct date is Saturday, January 16, 1991. Doug Mostyn reported on the Founders Day Committee. Sandy Grose- close is co-chairperson this year. Committee heads are the same but volunteers are still needed. The theme this year will be "Best in the West." IX. Marana Volunteer Fire Department, Inc. - Including E.M.T. Costs Chief Insalaco introduced Mr. Blanset, the new Assistant Chief, who is well qualified for this position. Chief Insalaco said Emergency Services sent a letter stating a fuel supply is avail- able, but the Department is conserving their supply. David Morales asked Chief Insalaco to explain the need for an Emergency Medical Technician. Most qualified professionals want to get paid for the job, and the shift fee is $45. Qualified fire fighters will be graduating at the end of January, so they will be looking for jobs. Bob McCrea said he has always supported the Fire Department, but the town first has to get its own house in order. He thinks the town should be thinking about the formation of a fire district, and this should be a future agenda item. David Morales said that right now, the department needs to come up to speed. Doug Mostyn moved to bring back this item after the Budget Com- mittee has met, seconded by Bill Schisler. Mr. Mostyn said the Fire Department is asking for an amount in excess of $14,000, and he would like to see more facts and figures. Motion carried. X. Staff Reports X.A. Engineer's Report Morgan Johnson's report was in writing and he answered questions. X. B. Police Report Chief Radcliffe's report was in writing and he answered ques- tions. X. C. Street Report The Street Report was in writing. Bob Kern answered questions, and he was commended for his department's good safety record. X. D. Water Maintenance and Improvement Report The written report was filed by Bob Kern and he answered ques- tions. Doug Mostyn asked about a generator for night work. Mr. Kern said that is not the best solution around water, but port- able lights better addresses the problem. Mr. Mostyn asked for a report for next Council meeting. X. E. Water Financial Report Dan Groseclose said his reports are available. Town personnel can see that Council receives a copy. The funds are separate from other town funds. Bob McCrea said there is an outstanding bill from Linden, Chapa, Fields (attorneys) in the amount of $26,000. This is to be paid from the bonds sale when the Cortaro acquisition is accomplished. Mr. McCrea will report further at the next Council meeting. X.F. Magistrate Report The written report was filed and Judge Kline His staff was commended for a fine job. answered questions. X.G. Building Inspector's Report The report was in writing and Vick Charn±s answered questions. X.H. Financial Report The report was just received this evening. Further discussion will be held at the Budget Committee meeting on Thursday, January 17, 1991. Bob McCrea asked about the Special Police Fund. Chief Radcliffe said the money going into the fund comes from evidence and is not a part of the town's money. X. I. Planning and Zoning Report MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL JANUARY 15, 1991 PAGE 4 OF 8 The report was in writing and Mr. Dinauer answered questions. The minutes of the last Planning & Zoning meeting are not yet completed. There was a recess at 8:00 p.m. and the meeting resumed at 8:09 p.m. XI. Order of Business XI. A. Update on Sales Tax Survey The information was included in the packet. XI. B. Marana Park Transfer Approval Dan Felix, Director of Pima County Parks and Recreation at 1204 W. Silverlake, presented background information and answered questions. The County Commissioners will meet next Tuesday, and The School Board will meet on the 29th. The water rights and the governmental buildings are still of concern to Council. Mr. Felix said the water issue is not a problem and the use can be changed from 40 to 84 acre feet. Since the park is surrounded by the town, it should belong to the town. The County's funding was reduced so the County wanted to give up Marana Park, and negotia- tions began with the Town of Marana. The amount of $250,000 would be paid over time until 1/31/93. The governmental buildings have always been a special consideration. Acquiring the park would increase our insurance approximately $5000 per year. Jo Rex moved to approve the Marana Park transfer dependent upon the approval of our attorney and with the provisions that Mr. Felix has just stated that we would have continued 84 acre feet as long as necessary to keep the park alive and that the build- ings will remain negotiable. The motion was seconded by Doug Mostyn. Following discussion, the roll call vote was as follows: Vice Mayor McCrea, no David Morales, yes Doug Mostyn, no Jo Rex, yes Bill Schisler, no Mayor Harn, yes Motion failed due to lack of majority. David Morales moved, since there was a tie, to place it on the next agenda. This was ruled out of order. Doug Mostyn moved to place the item back on the agenda at the MINUTES OF REGULAR COUNCIL MEETING MARANA TOWN COUNCIL JANUARY 15, 1991 PAGE 5 OF 8 next full Council Meeting, hopefully the first meeting in Febru- ary. The motion was seconded by David Morales and carried, with Bob McCrea voting "no". Mr. Felix said he would delay actions of other concerned Boards. XI. C. Consent Calendar 1. Approval of Filing Blank Annexation Petition For: a. Marana Park Town Island b. Northgate Annexation (Tempo) Bob McCrea moved to approve the consent calendar, Doug Mostyn. Motion carried. seconded by XI. D. GLHN Engineer's Cost Explanation - Barnett Road Morgan Johnson explained the costs on the written report. Bill Schisler moved to approve engineer's cost The motion was seconded by Jo Rex and carried, votin9 "no". on Barnett Road. with Doug Mostyn XI. E. Taxability of Coin OP Carwash and Laundry Machines Mayor Harn had placed this item on the agenda. She wants the Council's opinion whether coin operated carwash and laundry machines should be exempt from the sales tax. Bill Schisler moved that Council direct Mayor and staff to con- tact Cathy Connolly at the League and 9et the purview necessary to make the change to exempt coin operated carwash and laundry machines. The motion was seconded by David Morales and carried, with Jo Rex voting "no". XI. F. Significant Land Use Change ARS Tile, 13421N. Lon Adams Road Chuck Dinauer 9ave background information. Last Wednesday, the Plannin9 & Zoning Commission approved the use. Bill Schisler read a list of conditions as follows: 1. There will be no outside storage of equipment or product. Ail work to be conducted inside buildin9 except loadin9 and unloading. 2. Provide proof from State and/or Pima County EPA process of glazing the tile will not produce toxic or fumes, hazardous waste, and obnoxious odors. that the hazardous 3. Ail trucks used to service the business will be under five ton gross weight. In the event of the need to use heavier trucks, permission will be obtained from the Town Road Superin- tendent. 5. The building and grounds will be maintained to eliminate deterioration. 6. Approval of this land use change is null and void if ARS Tile is not in business at 13421 N. Lon Adams Road before January 1, 1992. Mayor Ham added that if the business vacates the premises, this land use change will be null and void. She would also like to see better landscaping to better match the neighborhood. David Morales agreed with Mr. Schisler's terms, but the owner is not present tonight, Mr. Morales moved to postpone item XI. F until the next meeting and request the owner's presence. The motion died for lack of a second. Nelson Sabbe said the process of land use change is so lengthy no wonder the man is not here tonight. Bob McCrea moved to approve the significant land use change for ARS Tile at 13421 N. Lon Adams Road with the stipulations stated above by Mr. Schisler and the Mayor. The motion was seconded by Doug Mostyn and carried, with Mr. Morales voting "no". XI. G. Town Manager Selection Committee Appointments Mayor Harn listed her appointees as Doug Mostyn, Bob McCrea, Hal Horrigan, Dorothy Honeycutt, and a person from Dr. Foster's staff to be selected by him. David Morales moved to approve the names stated as the Town Manager Selection Committee. The motion was seconded by Jo Rex and carried. XI. H. Council Standard Operating Procedures Committee Appoint- ments. Mayor Ham listed her appointees as Bill Schisler, Jo Rex, and Acting Town Manager Chuck Dinauer. David Morales moved to accept the Mayor's appointments to the Standard Operating Procedures Committee. The motion was seconded by Doug Mostyn and carried. XI. I. OF 8 At a recent meeting with Oro Valley, the Town Manager offered their present dais, as they are building a new town hall. The Rotary Club had some donations and will use that money to have the dais moved from Oro Valley to our Town Hall. The new Oro Valley Town Hall will be dedicated April 15. Mayor Harn reported on the status of the Aviation Highway and the use of HURF funds. She will be going to Phoenix on Friday to work with ADOT and the Pima County Regional Council. Recall petitions have been received for Mayor Ham, Vice Mayor McCrea, and Councilman Schisler. Doug Mostyn reported we have received a flag that flew over the White House Thanksgiving week, and it was displayed to those present. XI. J. Manager's Memo The report was in writing. Approve Fire District - McCrea/Mostyn/Morales David Morales thought this item should not be until second meeting in February. at least the Status of MUPI loan - Doug Mostyn. Mayor Ham said anyone can go to the Manager for information. Tucson Local Development Corpo- ration is handling those loans. XIII.
