B. PLEDGE OF ALLEGIANCE AND INVOCATION/MOMENT OF SILENCE

C. APPROVAL OF AGENDA
Upon motion by Council Member Comerford, seconded by Council Member Escobedo, the
agenda was unanimously approved.
D. CALL TO THE PUBLIC
Carol Lundsford addressed the Council and said her granddaughter, Alexis Lundsford, Poppy
Princess, represents the American Legion Post 73 in Tucson. The making of poppy was
started during World War I and II in honor of Veterans. Today the poppy is still made and
worn in honor of veterans.
Ora Mae Ham, addressed the Council and gave an update on the Santa Cruz Valley Heritage
Alliance. A commission was formed of 24 members representing a diversity of local
interests, some of which include local governments, historic preservation, nature
conservation, parks, tourism, lodging, ranching and agriculture. With public input, the
Alliance developed the concept of a Santa Cruz Valley National Heritage Area to preserve
heritage areas. With funds provided by local governments, a Feasibility Study was
completed and submitted to the National Park Service and Congressional delegation. The
Feasibility Study includes inventories and maps of the significant natural, cultural, historic,
scenic, and outdoor recreational resources in the region. Ms. Ham also spoke about an action
plan to promote heritage in the Marana community, and thanked the Town for the help and
support they have given in promoting preservation of heritage. A fundraiser will be held

David Morales addressed the Council and said "Mayor Council Members, the Town of
Marana does not have a heartbeat. I am serious. I have been doing this since 1985 and I
have always felt a heartbeat, but today the Town doesn't have a heartbeat. I mean the Town
is not ready for a recall, it is not ready for anything. I say this in all honesty. I wasn't even
going to come today, but I felt that I at least owed you the reason why it went down and why
other things will go down in Marana, and why you have such a low, low voter turn out.
Number one, Where is Main Street Marana? There's no Main Street. You go to any town
and you got Main Street. Is main street Dove Mountain Blvd, is it Sandario Road, is it
Silverbell Road, is it Cortaro, is it Ina, is it Thornydale? See there's no main street to
Marana. You've got three separate political bodies in Marana. You got the
intercourse/Gladden Farms now, you got Dove Mountain, and you got Continental Ranch.
These are total separate units. They're separate from each other and I don't know how you
guys are going to join the Town, but I can tell you the Town is without a heartbeat.
I wrote an evaluation, like I did of the Council, this is on the voters of Marana. You know I
love to evaluate, but then you know, I went to Eller School and that's all we do is evaluate.
The first voter is, I do not live in Marana, I live in my closed or gated community, so go
away or I will call the police and the police will be called. These closed gated communities,
as far as they're concerned they're not part of Marana, they have their own little community
and to them that's all they care about.
The second one, I do not want to be bothered. I will not open the door, and this is 50 percent
of the doors that you knock will be this type. People just do not open doors no more. And so
50 percent would not open the door for you, that's a given.
The third type of voter is what I call the apathetic voter of Marana, its voter, and by the way
these are registered voters that I'm talking about, I'm not talking about citizens, I'm talking
about registered voters. The apathetic voter in Marana, I do not know what's going on, I do
not know, I do not want to know what's going or do I wish to know what's going on. I mean,
I'm serious these people don't care, the Town could go bankrupt as far as they're concerned
as long as it doesn't affect them, they don't care.
The fourth voter is what I call the Gestapo syndrome, and I came across a bunch of these.
Gestapo syndrome is if I sign the recall the Town is going to [sick] their dogs on me. Now
are these people feel that this Town government is Nazi Germany. That you're gonna knock
on their doors in the middle of the night and do all kind of harm to them. Don't ask me why
they feel this way, but you look in their eyes and you can see the fear in their eyes. They
wanted to sign it, but they say no, I can't sign it because I don't want to be bothered with the
Town. That's a shame that here we live in a democratic society and they have this fear.
The fifth one is the one that really has me concerned. I call it the Speculation bird, like
snowbirds they are here only temporary snowbirds for the winter. A Speculation bird,

they're here for a couple of year until the property yields a profit then they sell and leave.
They have no ties to the Town. Marana is only a real estate portfolio to them. In the new
developments, four out of five will be Speculation birds seeking and waiting for a profit. So
all those homes that are going up, four out of five they're just here temporary.
Number six, not yet a voter. I just moved here a few months ago and I am not a registered
voter. And because the Town has so much developing going on, you have a bunch ofthese,
God, you have em. I dropped off about 50 voter registration forms so I imagine Marana will
have between 30-40 new voters.
Number seven, Marana is my home and I care. These are only a handful and they're far and
few between, I mean this is the make up of the Town. I don't know how you gonna resolve
this, but I mean, nobody cares, either way nobody cares. I can tell you right now, come
November, you Mr. Mayor, Jim Blake, and Bob Allen will get your petitions. You will not
be challenged. There will be a low voter turn out because what I found out in the Town.
Now everything is subject to change if something happens, but it would take a monumental
event for these numbers to change.
The other thing, I'm tired, I tired oftrying to convince people that don't want to be
convinced so I don't think you're gonna see me for awhile; I got too many other things going
on in my life. I would like to leave you with this thought about groupthink. This is a paper
that I pulled from the internet, it's the Office of the Attorney General Terry Goddard, it's
dated Phoenix, Arizona February 10, 2006, so this is very current. It deals with the open
meeting law, the third paragraph (by the way, I'll leave this over there on the way out and I'll
also leave the voters in Marana) it states the public has the right to observe the deliberations
and communications of its government, Goddard said. My office continues to work with
local governments to ensure they understand the law, and we will investigate and hold
accountable any public body to make sure the public's business is done in the open. In the
Agenda you have an item called the minutes." Mayor Honea asked Mr. Morales to finish up,
stating that he had already spoken for 10 minutes.
E. PRESENTATIONS
PROCLAMATIONS - George A. Brinsko; Municipal Clerks Week; VFW
Vice Mayor Kai said the Town has a proclamation honoring George Brinsko, who passed
away March 30, 2006. It was because of George's vision that Marana enjoys the growth it
has today. Vice Mayor Kai presented George's wife Gloria, and daughters, Kathy and
Melissa with the proclamation.
Jocelyn Bronson, Town Clerk, read a proclamation remembering George A. Brinsko as a
friend of Marana, a man of principle and integrity, and a respected leader.
Mayor Honea said that on behalf of the Town, there will be a brick paver placed entering the
Marana Municipal Complex in memory of George.
F. MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS
Council Member Comerford thanked everyone for helping and supporting Nicholas
Comerford with the Arbor Day celebration.

Mayor Honea said that he attended the Arbor Day celebration and said there were many
families that attended and helped plant trees. He also said that Marana has a lot of heart and
shows it everyday.
G. MANAGER'S REPORT: SUMMARY OF CURRENT EVENTS
Jim DeGrood, Assistant Town Manager, addressed the Council and said the April 30, 2006,
Tour of the Tucson Mountains bike ride was successful, and forwarded appreciations to the
Council from tour organizers.
H. STAFF REPORTS
GENERAL ORDER OF BUSINESS
I. CONSENT AGENDA
1. Resolution No. 2006-57: Relating to Development; approving and
authorizing a fmal plat for The Villas at Continental Ranch (Barbara
Berlin)
2. Resolution No. 2006-58: Relating to Development; approving and
authorizing a release of assurances for Continental Reserve - Block 9, and
acceptance of public improvements for maintenance (Keith Brann)
3. Resolution No. 2006-59: Relating to Development; approving and
authorizing a fmal plat for Hidden Springs (Barbara Berlin)
4. Minutes of the April 18, 2006 regular meeting.
Upon motion by Council Member Escobedo, seconded by Council Member
McGorray, the consent agenda was unanimously approved.
J. COUNCIL ACTION
1. Ordinance No. 2006.12: Relating to Development; accepting and approving
the technical report recommending construction cost increases in impact
fees; adopting revised development impact fees for the South Transportation
Benefit Area, the Northwest Transportation Benefit Area and Parks Benefit
Area; providing for the automatic revision of these impact fees on July 1 of
each year based on the Engineering News Record 20 City Construction Cost
Index; adopting an affordable housing impact fee waiver for areas
designated as Colonias; declaring an emergency with respect to the
affordable housing impact fee waiver provision; and providing an effective
date (Jim DeGrood)
Mr. DeGrood addressed the Council and said Ordinance No. 2006.12 will
increase the development impact fees. The Twin Peaks interchange impact fee
will increase 2004 percent to the amount of $2,932 per equivalent dwelling unit

(EDU), the Northwest transportation impact fee will increase five percent to
$6,238/EDU and the Parks impact fee will increase five percent to $3,028. The
ordinance also makes provisions allowing a waiver of impact fees within the
Town's Colonias. The Town is also declaring an emergency relating to impact
fees within the Town's Colonias.
Mr. DeGrood said a correction is needed in Section 5 of the ordinance, which had
an error in referencing of Resolution No. 1998-76 and said it should be
referencing Resolution No. 1998-21.
Upon motion by Council Member McGorray, seconded by Council Member
Blake, Ordinance No. 2006.12 was unanimously approved with the correction in
section 5.
2. PUBLIC HEARING. Resolution No. 2006-60: Relating to Development;
approving and authorizing a conditional use permit for a self-contained
automatic carwash on the property located at 8598 N. Silverbell Road
(Barbara Berlin)
Mayor Honea declared the public hearing open.
Barbara Berlin, Planning Director, addressed the Council and said the public
hearing is for a conditional use permit for a proposed commercial development
called Monkey Business and is located within the Silverbell Corridor District.
This request was recommended for approval with a 4-2 vote by the Planning
Commission on March 29,2006, and the design was unanimously approved on
April 19, 2006, by the Silverbell Road Commercial Overlay District. The
proposed development is a 2-acre site with an 11,000+ square foot building that
includes a 7,000 sq ft restaurant, 4,500 sq ft retail/commercial use, and additional
3,000 sq ft for future retail space. A carwash will be located behind the building,
with vehicles entering on the east side of the building onto a one-way drive. The
carwash will be an automatic wash, but will employ one staff member and will be
equipped with surveillance cameras. Ms. Berlin said that the neighborhood was
notified prior to the Planning Commission meeting and some letters had been
received in objection and some in approval ofthe development.
Gene Goldstein, Gene Goldstein Architect, addressed the Council and said the
owner's design is one that is simple, low-key, but good-looking. During the
design process, he was asked to consider a four-sided architecture design, and a
restaurant drive-through was eliminated from the design.
Council Member Comerford asked Ms. Berlin to make sure staff contacts Mary
Tyson, a resident opposing a drive-through restaurant, to clarify that there will not
be a drive through.
Council Member Comerford said on public record "Continental Ranch
Homeowners Association all the sudden deciding that they have a degree or are

traffic engineers and can decide what a good flow of traffic is or isn't. I want it
on the record that when they make a comment like that in a letter proposed to the
Town, I want to see the degree after the name ofthe person and where they got
that information. Really kind of getting tired of homeowners associations
dictating to businesses anything outside the guidelines that they have to contribute
to in that situation. I am tired of getting phone calls from businesses in
Continental Ranch that want to start up business and are having a hard time
because of the homeowner association involvement."
Council Member Comerford also asked about advertising plans for the carwash.
Ms. Berlin said that the signs will be adequate with directional signage toward the
carwash, and that signage designs will be presented to the Council at a later date.
Vice Mayor Kai verified that the carwash would be a single vehicle automatic
carwash, with one attendant, and no vacuuming services for backed up service.
There being no speakers, Mayor Honea declared the public hearing closed.
Upon motion by Council Member Escobedo, seconded by Vice Mayor Kai,
Resolution No. 2006-60 was unanimously approved.
David McGuire said it has been wonderful working with Cindy Ross, Town
Planner.
K. ITEMS FOR DISCUSSION/POSSIBLE ACTION
1. State Letdslative Issues: Discussion/Direction/Action regarding all pending
bills before the Legislature (Mike Reuwsaat)
Mike Reuwsaat, Town Manger, addressed the Council and said the impact fee
bill that affected the construction sales tax has been written out of the bill. The
Municipal Tax Incentive Bill looks like it is dead, and the revenue sharing is still
working through the process.
L. BOARDS. COMMISSIONS AND COMMITTEES
M. EXECUTIVE SESSIONS.
1. Executive Session. Pursuant to A.R.S. ~38-431.03 (A)(3), Council may ask
for discussion or consultation for legal advice with the Town Attorney
concerning any matter listed on this agenda.
N. FUTURE AGENDA ITEMS
Notwithstanding the mayor's discretion of what items to place on the agenda, if
three or more council members request an item to be placed on the agenda, it must
be placed upon the agenda for the second regular town council meeting after the
date of the request (Marana Town Code, Title 2, Chapter 2-4, Section 2-4-2 B)

Upon motion by Council Member Escobedo, seconded by Council Member McGorray, the
Council voted unanimously to adjourn. The time was 7 :40 p.m.
