Thomas Gill, Jr., Director of Public Works SUBJECT: Resolution No. 2006-09: Relating to Development; approving and authorizing the release of assurances for Gladden Farms Block 12 and acceptance of public improvements for maintenance. DISCUSSION Approval of this resolution will release the Assurance Agreement between Pulte Horne Corporation, a Michigan corporation, under Trust No. 9021, and First American Title Insurance Company, a California corporation, and the Town of Marana, regarding Gladden Farms Block 12 as depicted on Exhibit A. Gladden Farms Block 12 is comprised of Lots 1-104 and Common Areas 'A' through 'K'. The subdivision is recorded in Book 57 of Maps and Plats, Page 76, Pima County Recorder's Office, Arizona. In releasing said Assurance Agreement, the Town of Marana will accept for maintenance, including regulatory traffic control signs and street signs, approximately 1.02 miles of the following paved streets: Barbadense Drive Case Way Denier Drive Drawbar Drive Hirsutum Drive Jute Way Motes Drive Nep Lane Tare Lane A TT ACHMENTS Exhibit A -map of streets to be accepted RECOMMENDATION Staff recommends Mayor and Council release the Assurances for Gladden Farms - Block 12 and accept the public improvements for maintenance. Gladden Farms - Block 12 Full Release MARANA RESOLUTION NO. 2006-09 RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING THE RELEASE OF ASSURANCES FOR GLADDEN FARMS BLOCK 12 AND ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR MAINTENANCE. WHEREAS, Gladden Farms Block 12 is a 28.85-acre subdivision located east of Lon Adams Road and south of Gladden Farms Drive, containing Lots 1-104, Common Areas A through K, and is recorded in the Pima County Recorder's Office at Book 57 of Maps and Plats, Page 76; and WHEREAS, the Town has previously entered into an Assurance Agreement with Pulte Home Corporation, a Michigan corporation, (beneficiary) under Trust No. 9021 (subdivider) and First American Title Insurance Company, a California corporation, (trustee), recorded in the Pima County Recorder's Office at Docket 12173, Page 1375, assuring the completion of public improvements; and WHEREAS, Pulte Home Corporation has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Gladden Farms Block 12. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Gladden Farms Block 12 is hereby released from the Assurance Agreement with Pulte Home Corporation under Trust No. 9021, and First American Title Insurance Company.
