the residential design standards adopted by Ordinance No.
2005.18 supersede and take precedence over residential design
policies and standards of the Northwest Marana Area Plan
DISCUSSION
The Mayor and Council adopted the Northwest Marana Area Plan in 2000, addressing the
growth pressures that were beginning to develop. The Plan provides detailed goals, objectives
and policies concerning, among other things, infrastructure, economic development and
community design to help shape the Northwest growth area. The Plan contains a provision with
respect to the Plan's authority: "Whenever there is any question regarding the interpretation of
the provisions ofthis Area Plan or their application to any specific case or situation, the Town
Council shall interpret the intent of this title by written decision, and such interpretation shall be
followed in applying said provisions." (Page 43, Northwest Marana Area Plan.) Further, there is
another provision on the same page that states: "Where a conflict occurs between traditional
zoning standards and standards set forth in the Northwest Marana Area Plan, the rules and
standards of the Northwest Marana Area Plan take precedent." These provisions present
problems in part because a plan is adopted by resolution, while zoning standards are adopted by
ordinance; hence zoning standards must hold sway.
The Council did apply the standards of the Plan as a condition of rezoning actions that have
taken place since adoption. These include Gladden Farms, Payson Farms, The Village at
Barnett, and Sanders/Moore.
Subsequent to adopting the Plan, the Council adopted by ordinance residential design standards,
first in January 2004, and more recently in September, 2005. The design standards are a further
refinement and codification of some of the design policies begun by the Northwest Marana Area
Plan, although they apply throughout the Town. However, there are some distinct differences
between the new design standards and those of the Plan. These include, for example, location of
two story houses: the Plan restricts two story homes along arterials and collectors to forty
percent, while the design standards restrict them when adjacent to existing development. The
Plan also requires a minimum distance of 15 feet between houses, regardless of lot size and
required setbacks. One of the consequences of this standard was to "push" the garage forward of
the house (although the Plan also encourages minimizing the appearance of garages). The new
design standards specifically limit the prominence of garages.
Northwest Marana Area Plan Interpretation
Gladden Farms phases I and II have been platted and constructed or are in construction and have
adhered to the standards of the Plan as applied to plat notes for each subdivision; Phase III must
comply with the new residential design standards. Payson farms is platted, but not constructed.
The residential portion ofthe Sanders/Moore rezoning was platted as Fianchetto Farms. We have
not yet received plats for The Village at Barnett. As staff reviews building permits, the question
arises as to whether the Northwest Marana Area Plan policies apply in addition to those of the
Residential Design Standards.
RECOMMENDATION
Because of the potential conflict between the policies of the Northwest Marana Area Plan and
those of the more recent Residential Design Standards, staff recommends a clarification of policy
to affirm that the Residential Design Standards supersede the policies of the Plan.
The adoption ofthe Residential Design Standards as an ordinance of the Town supersedes the
Northwest Area Plan, which was adopted by resolution (Resolution No. 2000-111). This does
not mean that the intent and application ofthe Northwest Area Plan is null and void.

RELATING TO DEVELOPMENT; AFFIRMING THAT THE RESIDENTIAL
DESIGN STANDARDS ADOPTED BY ORDINANCE NO. 2005.18 SUPERSEDE
AND TAKE PRECEDENCE OVER RESIDENTIAL DESIGN POLICIES AND
STANDARDS OF THE NORTHWEST MARANA AREA PLAN
WHEREAS, the Mayor and Council of the Town of Marana adopted the
Northwest Marana Area Plan by Resolution No. 2000-111, October 17, 2000; and
WHEREAS, the Northwest Marana Area Plan established goals, objectives,
policies, and standards to guide growth and development as the northwest area was about
to develop; and
WHEREAS, the Northwest Marana Area Plan provided standards and policies for
residential design in the northwest growth area; and
WHEREAS, various rezonings and subdivision approvals of land in the northwest
area have included a condition requiring conformance to the Northwest Marana Area
Plan; and
WHEREAS, on September 19, 2005, the Mayor and Council adopted Ordinance
No. 2005.18, amending the Land Development Code to include comprehensive
Residential Design Standards; and
WHEREAS the standards and policies for residential design in the Northwest
Marana Area Plan are different from the Residential Design Standards adopted by
Ordinance No. 2005.18; and
WHEREAS the Northwest Marana Area Plan provides that it IS subject to
interpretation in writing by the Mayor and Council; and
WHEREAS, the Town Council has determined that this resolution is necessary to
clarify any confusion about which of the standards Town staff should apply when
reviewing projects.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council ofthe Town
of Marana, that the Residential Design Standards adopted by Ordinance No. 2005.18
shall apply in place of any standards or policies for residential design contained in the
Northwest Marana Area Plan.

IT IS FURTHER RESOLVED that any condition of a rezoning or subdivision
approval of land in the northwest area requiring conformance to the Northwest Marana
Area Plan shall be interpreted to require conformance to the Residential Design Standards
adopted by Ordinance No. 2005.18 only.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana,
