HomeMy WebLinkAboutResolution 2009-195 united fire and casualty company v pima county relating to honea heightsMARANA RESOLUTION N0.2009-195 RELATING TO FINANCE; APPROVING THE TRANSFER OF $250,000 IN BUDGETED EXPENDITURE AUTHORITY FROM THE GENERAL FUND CONTINGENCY LINE ITEM TO THE UNINSURED LOSS LINE ITEM FOR THE PARTIAL PAYMENT OF THE SETTLEMENT OF THE CASE ENTITLED UNITED FIRE & CASUALTY COMPANY V. PIMA COUNTY, CASE NO. CV 08-381-DCB, INVOLVING SEWER INSTALLATION AND CONNECTION WITHIN HONEA HEIGHTS WHEREAS, on June 23, 2009, the Council adopted the fiscal year 2009-2010 budgetary document and overall financial plan which set the legal level of budgetary control at the department level for the General Fund and at the fund level for all other funds; and WHEREAS, on November 17, 2009 Mayor and Council approved the settlement of the case entitled United Fire & Casualty Company v. Pima County, Case No. CV 08-381- DCB, involving sewer installation and connection within Honea Heights; and WHEREAS, the settlement agreement allows for the settlement amount of $625,000 to be paid in two installments with the first payment of $250,000 due within thirty days of the agreement's approval and the second installment of $375,000 by the end of July 2010; and WHEREAS, reallocations of budgetary amounts between the contingency line item in the General Fund to other line items are necessary from time to time. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that the of transfer of $250,000 from the General Fund's budgeted contingency line item to the uninsured loss line item to pay for the first of two settlement payments shall be approved.
