SUBJECT: Resolution No. 2006-32: Relating to Development; approving and
authorizing a modification to rezoning conditions of the Patania-
Hartman Rezoning Ordinance (Ordinance No. 94.09)
DISCUSSION
Historv
On July 19, 1994, Council approved Ordinance 94.09, which rezoned 100 acres of vacant land
located near Hartman Lane and Overton Road (a parcel of land located today between the Hartman
Vistas and Hartman Ten Subdivision) from E to R-8. The rezoning was subject to six conditions (see
attached Ordinance No. 94.09).
ReQuest
Planning Resources on behalf of Marana 59 L.L.c. requests the removal of conditions #1 and #6
from Ordinance No. 94.09. Condition #1 required the entire northeast portion of the parcel to remain
open space rather than commercial as originally planned. The recently proposed conceptual layout
shows a majority of the northeast portion as open space. Condition #6 requires adherence to the
comments in a memo dated June 23, 1994 from the Town Engineer. These comments refer to
technical aspects of the preliminary site analysis which the preliminary plat will address to the extent
they remain applicable.

A copy of the rezoning ordinance with attachments, a letter from the owner's representative and
conceptual layout of the proposed subdivision.
RECOMMENDATION
Staff recommends the removal of conditions #1 and #6 from Ordinance No. 94.09. The concept plan
for this subdivision meets the intent of the original condition # 1 but with the proposed
reconfiguration of the lots, some lots may encroach on the conditioned open space. The proposed
subdivision has fewer lots than originally planned, reduced from 172 (3 RAe) to 58 (.99 RAe).
Accordingly, the concept plan provides 33.4 acres (58% of the net area of the project) for natural and
functional open space. Baker & Associates Engineering Inc., the consulting engineer for Marana 59
L.L.C., met with U.S. Fish and Wildlife Service (USFWS) regarding the site's environmental
constraints. USFWS finds the conceptual plan for the 58 lot subdivision acceptable.

RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING A
MODIFICATION TO REZONING CONDITIONS OF THE PATANIA-HARTMAN
REZONING ORDINANCE (ORDINANCE NO. 94.09).
WHEREAS, on July 14, 1994, the Town of Marana adopted Ordinance No. 94.09
approving the rezoning of a parcel of land near the southwest comer of Hartman Lane and
Overton Road, consisting of portions of Section 23, Township 12 South, Range 12 East,
approximately 100 acres in size; and
WHEREAS, Marana 59 L.L.C., the owner of the parcel, has requested the removal of
rezoning conditions #1 and #6 from Ordinance No. 94.09, on approximately 100 acres and is
generally located at the southwest comer of Hartman Lane and Overton Road, consisting of
portions of Section 23, Township 12 South, Range 12 East; and
WHEREAS, the Town Council, at their regular meeting on February 21, 2006 has
determined that the removal of rezoning conditions #1 and #6 from Ordinance No. 94.09 should
be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, that the modifications to the rezoning conditions of the Patania-Hartman rezoning
ordinance (Ordinance No. 94.09) are hereby approved.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,

\VHEREAS, Frank Patania is the owner of a parcel of land near the Southwest comer of
Harnnan Road and Overton Road, consisting of pOl1ions of Section 23, Township 12 South, Range
12 E:lst, approximately 100 acres in size, and more particularly set fOl1h in Exhibit A attached
here~o, which is currently zoned "C" Zone; and
WHEREAS, Frank Patania applied to the Town of ?v1arana to change the zoning of this
property from "c" Zone to appro~imate!y 97 acres ofR-6 and 3 acres ofNC; and
\VHEREAS, the Marana Planning Commission held a public hearing..on the rezoning request
on June 30, 1994, and recommended, with conditions, that the Town Council approve said request
for rezoning to R-6; and
\VHEREAS, the Town Council of the Town ofl\'farana held a oublic hearing: on the rezoning:

request on July 19, 1994, to obtain public input on the request for rezoning.
o NOW, THEREFORE BE IT ORDAINED that the ~vrayor and Council of the Town of
Marana does hereby change the zoning or the property particularly described on Exhibit A hereto,
from "C" Zone to R-8 as set forth in Exhibit B attached hereto, and subject to the following
conditions:
1. The area shown as "commercial" on Exhibit B is not granted NC zoning, but shall be open
space, and shall be reflected as such on the final site plan and plat.
2. The rest of the property shall be rezoned to R-8 (residential, 8000 square foot minimum lot
size), with no more than four (4) houses per acre.
3. The property will be required to adhere to Marana's Native Plant Ordinance.
4. A report of the two archaeological sites on the propel1Y shall be submitted to the town prior
to any grading on the site, and grading will not be allowed until the report is sufficient to the
town, and the town approves grading.
5. Dedications shall be granted as specified by the Town Engineer.
6. The Comments and Conditions made by the Town Engineer in his correspondence dated
June 23, 1994, attached heretO as Exhibit C. shall be adhered to.

r A December 9.2005 meeting was held at the olliees of the U.S. Fish and Wildlife Service (USFWS) to discuss Ihe
conceptual layout for the subject project. In attendance were Scott Richardson (USFWS). Rick Carson and myself. In
summary, Scott Richardson agreed that the concept layout was acceptable, with some adjustments to the width of
proposed C.A. "B" drainage (detention) and CA "C' (open) on the ease side of the development (see attached layout).
Scott also agreed lhatthe width provided between proposed lots 6 and 7 was adequate and did not merit elimination of
any lots. After the aforementioned adjustmenls are made by our office, ane the percent disturbed areas are calculated, we
will submit this information to Scott for his review and subsequent approval.
