Berlin, AICP, Planning Director SUBJECT: Resolution No. 2006-27: Relating to Development; approving and authorizing a final plat for Willow Ridge Commons. DISCUSSION This item was held over from the February 7,2006 and February 21,2006 meetings. ReQuest The applicant, CPE Development Company, requests a resubdivision of Block A of the Willow Ridge Block Plat for final plat approval of a 155-lot single family subdivision, consisting of Lots 1-155 and Common Areas "A", "B", "c" and "D". Location The subdivision is approximately 60,3 acres located south ofCortaro Farms Road and directly east of the Oshrin Park Subdivision, approximately two-thirds of a mile east of Interstate 10, Back2round The site analysis for the Willow Ridge rezoning indicated that approximately 25.41 acres would be preserved as natural undisturbed open space, 13,05 acres would be natural open space and ,73 acres would be active recreational open space, The total open space will be approximately 39 acres or 38% of the entire site. All areas of disturbance within the designated open space will be re-vegetated where possible, The common areas are identified as Common Area "A" Natural Undisturbed Open Space, Common Area "B" Natural Open Space, and Common Area "c" Active Recreation, The following table represents this projects contribution to the overall requirement. The majority of the natural undisturbed open space will come from the custom lot R-16 zoned property to the east of Sandy Desert Trail. Those lots are restricted to 10,000 square feet of buildable/graded area with the remaining to be undisturbed and maintained through conservation easements. Required open space acreage per the Provided within Block A Rezoning Site Analysis Natural Undisturbed O/S ---25.41 7,59 acres Remaining acreage to be provided within the remaining Blocks 17,82 acres Natural Open Space ---------13,05 9.29 acres 3.76 acres Active Recreation O/Sm---O,73 0,81 acres None The rezoning conditions require a 50' bufferyard along the entire western boundary adjacent to the Oshrin Park subdivision, This bufferyard will include a 16' path for vehicular access to the existing well along with pedestrian and equestrian passage. Landscaped drainage basins will also be included within this 50' 020706 PR V -04125 Willow Ridge Commons Plat FP TC.doc bufferyard. The applicant has agreed to a height restriction of 24' within the NC zone as well as a prohibition of two-story homes within 300 feet of Cortaro Farms Road and along the western boundary adjacent to Oshrin Park. This project is required to provide 29,970 square feet of on-site recreation area, and provides 35,397 square feet between two areas identified as Common Area "c", The plat will be divided into three distinct areas to preserve open space, Lots 1-97 will have two accesses off Cortaro Road, lots 98-148 will have two accesses off the newly created Sandy Desert Trail, and lots 149-155 will be located on a cul-de-sac off of Sandy Desert Trail. The developer is working with US Fish and Wildlife on securing the 404 permit. The Town will not issue any grading or improvement permits until a copy of the 404 is supplied to the Town, The applicant is also working on an archaeology testing plan for one area of the site, Arizona State Museum has cleared the site for construction with the exception of one location. The Town will not release this area for construction until the testing is completed to the satisfaction of ASM, The developer has submitted a native plant permit application for review in accordance with the requirements of the rezoning. The NPPO cannot be approved until the Town has received the approved 404 permit for the project. The landscape plan is also in review by Town staff. Per the approved Development Agreement, this project is subject to an Open Space, Park and Trail System Contribution of $6,400 per new residential dwelling unit. The approved Development Agreement places this property within the Marana South Transportation Benefit Area and therefore, subject to the impact fee of $2,435 per new residential dwelling unit. Finally, the Development Agreement requires a school improvement contribution fee of $1 ,200 per new residential dwelling unit. RECOMMENDA TION Staff has reviewed the application for compliance with the Development Agreement adopted by Resolution No. 2004-49, the Rezoning Conditions adopted by Ordinance 2004.07, the Marana Land Development Code and the Marana General Plan. This Final Plat is in conformance with all required development regulations and conditions of zoning. Staff recommends approval of a Final Plat for Willow Ridge Commons with the following conditions: RECOMMENDED CONDITIONS OF APPROVAL 1. The Town shall not issue any grading or improvement permits until the Developer has supplied the Town with their approved 404 Permit. 2, The Town shall only issue grading or improvement permits on areas that have been approved by the Arizona State Museum.
