HomeMy WebLinkAbout03/07/2006 Blue Sheet MUSD Meeting Room Usage Agreement TOWN COUNCIL MEETING INFORMATION TOWN OF MARANA MEETING DATE: March 7, 2006 AGENDA ITEM: 1.4 TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: Resolution No. 2006-36: Relating to Town Facilities; approving and au- thorizing the Mayor to execute an agreement allowing the Marana Uni- fied School District Governing Board to use conference facilities at the Marana Municipal Complex. DISCUSSION The Marana Unified School District (MUSD) Governing Board has approached the Town about using conference facilities at the Marana Municipal Complex for various events. The Town's Meeting Facili- ties Usage Policy suggests that unusual arrangements for use of Town meeting facilities be the subject of a special agreement approved by the Council, establishing such fees and other provisions for room usage as the Council determines appropriate for the particular circumstances, Because of the close and cooperative historic relationship between MUSD and the Town of Marana, Town staff believes that it is appropriate to allow the MUSD Governing Board to use various conference facilities at the Marana Municipal Complex for the Governing Board's needs without charging MUSD a fee. Instead, the proposed room usage agreement with MUSD presented to the Council simply provides for reimbursement of any Town costs incurred in providing technical assistance for equipment usage and clean-up costs incurred. ATTACHMENT Agreement between the Town of Marana and the Marana Unified School District governing use ofMa- rana Conference Facilities, RECOMMENDATION Staff recommends approving and authorizing the Mayor to execute the room usage agreement with MUSD, SUGGESTED MOTION I move to adopt Resolution No, 2006-36, {00001813.DOC /} FJC/cds 2/22/06 MARANA RESOLUTION NO. 2006-36 RELATING TO TOWN FACILITIES; APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT ALLOWING THE MARANA UNIFIED SCHOOL DISTRICT GOVERNING BOARD TO USE CONFERENCE F ACILITIES AT THE MARANA MUNICIPAL COMPLEX. WHEREAS, the Town of Maran a desires to allow the Marana Unified School District Gov- erning Board to use conference facilities at the Marana Municipal Complex to hold various events; and WHEREAS, the Mayor and Council of the Town of Marana feel it is in the best interests of the public to allow such use. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, that the agreement between the Town of Marana and the Marana Unified School District Governing Board, attached to and incorporated by this reference in this resolution as Exhibit A is hereby approved, and the Mayor is hereby authorized to execute it for and on behalf of the Town of Mar ana. IT IS FURTHER RESOLVED that the Town's Manager and staff are hereby directed and au- thorized to undertake all other and further tasks required or beneficial to carry out the terms, obliga- tions, and objectives of the aforementioned agreement. Bronson, Town Clerk APPROVED AS TO FORM: Frank Cassidy, Town Attorney {0000/8UDGe /} FJC.'cds 2/22/06 ~~ lYIARANA ~/ 1 "- TOWN OF MARANA AGREEMENT BETWEEN THE TOWN OF MARANA AND THE MARANA UNIFIED SCHOOL DISTRICT FOR THE USE OF MARANA CONFERENCE FACILITIES The Town of Marana (the "Town") hereby grants use of the Town's Council Chambers, Conference Center, and other meeting facilities at the Marana Municipal Complex to the Marana Unified School District Governing Board ("MUSD") to hold various events at no charge to MUSD after confirmation of availability with and scheduling by the office of the Town Manager. This agreement shall continue in force and effect unless and until it is terminated by the Town of Marana upon thirty days written no- tice to MUSD. MUSD will be responsible for cleanup after any event. Damage to the walls, furniture repair or clean- ing, and removal of carpet stains which may require the entire room to be cleaned will be billed to MUSD at contractor cost. If MUSD needs technical assistance with the audio/visual or other equipment from Town personnel, MUSD shall pay the Town's standard rates for that assistance as set forth in the Town's Meeting Fa- cilities Usage Policy as it may be amended from time to time. MUSD acknowledges that it has received a current copy of the Town's Meeting Facilities Usage Pol- icy and agrees that it shall comply with and enforce the rules of conduct as set forth in that Policy. MUSD shall release, hold harmless and indemnify the Town and its officers, employees and agents from and against any and all losses, liability, claims, actions, suits or damages (including but not lim- ited to, personal injury damages, including death, or property damages) which arise, result, or are oth- erwise attributable to MUSD's negligent acts or omissions in connection with its use of the Town's facilities.
