Home My WebLink About03/07/2006 Blue Sheet Amendment of Pima County Bond Descriptions TOWN COUNCIL MEETING INFORMATION TOWN OF MARANA MEETING DATE: March 7, 2006 AGENDA ITEM: J.3 TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: PUBLIC HEARING: Resolution No. 2006-39: Relating to Public Works; authorizing and approving the amendment of Pima County Bond Project descriptions for the Santa Cruz River in the Vicinity of Continental Ranch project and the Marana Rattle- snake Park project. DISCUSSION In 1997 and 2004, Pima County voters approved bonds to fund projects as described in the 1997 and 2004 Pima County Bond Implementation Ordinances. The action presented to you today involves two ofthose projects. The first is project P-45 from the 1997 Pima County Bond Implementation Ordinance, entitled "Maran a Rattlesnake Park (Continental Ranch)," authorizing $500,000 for athletic fields, play- grounds, ramadas, picnic areas, restrooms, basketball court, volleyball court, parking, lights and landscaping in the proposed district park site located adjacent to the new proposed Wheeler Taft Abbett Library. The second is project 5.9 from the 2004 Pima County Bond Implementation Ordinance, entitled "Santa Cruz River in the Vicinity of Continental Ranch," authorizing $4,000,000 in bond fund- ing for certain bank protection and linear park improvements in the vicinity of the proposed Wheeler Taft Abbett Library site. Section IV.B. of the 2004 Pima County Bond Implementation Ordinance provides that "no pro- ject requested by a political subdivision or jurisdiction and approved for inclusion in the 2004 bond program shall be modified in scope, location, funding amount, or schedule without the ex- press written request of the jurisdiction that requested the project." The purpose of this action is to modify the project descriptions for the Santa Cruz River in the Vicinity of Continental Ranch project and the Marana Rattlesnake Park project so that the amended descriptions may be pre- sented to the Pima County Bond Advisory Committee for recommendation and to the Pima County Board of Supervisors for adoption of amendments to the Bond Implementation Ordi- nances. Santa Cruz River in the Vicinity of Continental Ranch The original project description for the Santa Cruz River in the Vicinity of Continental Ranch project included bank protection extending all the way from Cortaro Road to Ina Road and a re- {00001831.DOC /} FJC/cds 2/28/06 claimed water line from the Ina Road Wastewater Treatment Plant to the vicinity of Cortaro Road, among various other things. With the passage of time and increased construction costs, the Town realizes that the financial feasibility of the project requires that its scope be reduced to provide bank protection only from Cortaro Road to the Yuma Mine Wash, and to eliminate and modify various other elements ofthe project as originally described. Staff proposes to modify the project description for the Santa Cruz River in the Vicinity of Con- tinental Ranch project as shown on Exhibit A attached to Resolution No. 2006-39, which accom- panies this Council item. Marana Rattlesnake Park The original project description for the Marana Rattlesnake Park project anticipated construction during Implementation Periods 2, 3, and 4, which according to the 1997 Pima County Bond Im- plementation Ordinance (Table 5) covers the years 1999 through 2005. Since the Marana Rattle- snake Park project has not yet been implemented, it is necessary to amend the project description to include Implementation 5, which extends implementation through Fiscal Year 2007. RECOMMENDATION Staff recommends Council approval of the revised project descriptions for the Santa Cruz River in the Vicinity of Continental Ranch and the Marana Rattlesnake Park project. SUGGESTED MOTION I move to adopt Resolution No. 2006-39. {OOOOJ83J.DOC I} -2- FJC/cds 2/28/06 MARANA RESOLUTION NO. 2006-39 RELATING TO PUBLIC WORKS; AUTHORIZING AND APPROVING THE AMENDMENT OF PIMA COUNTY BOND PROJECT DESCRIPTIONS FOR THE SANTA CRUZ RIVER IN THE VICINITY OF CONTINENTAL RANCH PROJECT AND THE MARANA RATTLESNAKE PARK PROJECT. WHEREAS, Pima County voters approved bond packages to fund projects described in the 1997 and 2004 Pima County Bond Implementation Ordinance; and WHEREAS, the 2004 Pima County Bond Implementation Ordinance requires the jurisdiction requesting an amendment to a bond project description to hold a public hearing and formally approve the amended bond project description; and WHEREAS, the Town Council of the Town of Marana held a public hearing regarding the revision ofthe bond project descriptions addressed in this resolution on March 7, 2006; and WHEREAS, the Town Council finds that the amendment ofthe bond descriptions and the adoption of this resolution are in the best interests of the citizens of Marana. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: SECTION 1. Project P-45 of the 1997 Pima County Bond Implementation Ordinance, entitled "Marana Rattlesnake Park (Continental Ranch)," is hereby requested to be modified to add implementation period 5, providing for implementation through fiscal year 2007. SECTION 2. The project description for Project 5.9 of the 2004 Pima County Bond Implementation Ordinance, entitled "Santa Cruz River in the Vicinity of Continental Ranch," is hereby requested to be modified in the manner shown on Exhibit A attached to and incorporated by this reference in this resolution. SECTION 3. The Town's Manager and staff are hereby directed and authorized to undertake all other and further tasks required or beneficial to carry forward these bond project {00001832.00C I} FJClcds 2/28/06 amendments through the Pima County processes, including the authority to make additional revisions as determined necessary by the Town Manager. Bronson, Town Clerk APPROVED AS TO FORM: Frank Cassidy, Town Attorney {00001832.00C I} FJC/cds 2/28/06 - 2 - 5.9 Santa Cruz River in the Vicinity of Continental Ranch Location: Santa Cruz River, Yuma Mine Wash to EI Rio Neighborhood Park Scope: The Town of Marana is developing plans for bank protection on the west bank of this segment of the Santa Cruz River between the Yuma Mine Wash and Cortaro Road as part of the development of a regional park that was authorized in Pima County's 1997 General Obligation Bond election. The project includes the construction of a soil cement underpass at Cortaro Road. The County is providing bond funding and flood control funds for the park and bank protection, respectively. The Town of Marana is securing all rights-of-way for the park elements of this project, and the County flood control district is securing all rights-of-way for the bank protection. The Town of Marana is also working with the Arizona Department of Transportation (ADOT) to construct a paved pathway following the eastern boundary of the Continental Ranch community along the western top of bank and low flow bank of the Santa Cruz River beginning at the Yuma Mine Wash, south of Cortaro Road, and ending north of the proposed Cortaro Mesquite Bosque project, at EI Rio Neighborhood Park, a total of approximately 4.1 miles. ADOT will provide $998,000 of the total estimated project cost of $2,400,000 for the Marana Shared Use Path Project. Plans for the northern 2.7 miles of the path are complete and construction is nearing completion. The Town is continuing to develop the southern 1.4 miles of the project. The project includes paving of the underpass ramp at Cortaro Road, landscaping and irrigation along the pathways, two pedestrian bridges, and three informational kiosks. This proposal includes the construction costs for the bank protection, the cost of developing a landscaped linear park and shared use path alongside the bank protection that would connect with the existing Marana Shared Use Path at the EI Rio Neighborhood Park. The project will also include two parking nodes with ramadas. Benefits: This project will benefit the Town of Marana and the Continental Ranch community as it will further protect the existing Cortaro Road Bridge, the commercial development, the proposed Rattlesnake park and the Wheeler Taft Abbett Library south of the bridge from flood and erosion damage. The project will also provide continuation of the Juan Bautista de Anza National Historic Trail, the Pima County linear river park and trail systems, and provides alternative modes of transportation along the Santa Cruz River. Cost: $6,020,000 with Construction Administration being $250,000 Construction being $5,100,000, Design being $500,000 and Public Art being $170,000. Bond Funding: $4,000,000 Other Funding: State, Marana and County flood control district funding to supplement bond funds. Project Duration: Bank Protection: Design Completion at 3 to 6 months and Construction at 6 to 9 months. Implementation Period: 1, 2, 3, 4, 5 Project Management: The Town of Marana will manage design and construction, pursuant to an intergovernmental agreement between the Flood Control District and the Town. Future Operating and Maintenance Costs: Pima County Natural Resources, Parks and Recreation, with annual maintenance costs of $72,250 per mile when completed. {00001789.00C /3}
