DISCUSSION This Release of the Assurance Agreement between Richmond American Homes of Arizona, Inc., a Delaware corporation under Trust No. 60,127 and Fidelity National Title Agency, Inc., an Arizona corporation, and the Town of Marana, relates to Gladden Farms - Block 10, as depicted on Exhibit A. Gladden Farms - Block 10 is comprised of lots 1-84 and common areas 'A' through 'C'. In releasing said Assurance Agreement, the Town of Marana will accept for maintenance, including regulatory traffic control signs and street signs, approximately 0.75 miles of the following paved streets: · Amber Stone Drive · Harvester Drive · Stone Mound Drive · Stone Pillar Drive · Stone Ring Drive ATTACHMENTS · Exhibit A - Map of streets to be accepted RECOMMENDATION Staff recommends Mayor and Council release the Assurances for Gladden Farms - Block 10, and accept the public improvements for maintenance. WHEREAS, Gladden Farms - Block 10 is a 25.57 acre subdivision located west of Lon Adams Road and south of Gladden Farms Drive, containing lots 1-84, common areas A through C, and is recorded at the Pima County Recorder's Office in Book 57 of Maps and Plats, Page 97; and WHEREAS, the Town has previously entered into an Assurance Agreement with Richmond American Homes of Arizona, a Delaware corporation (beneficiary) under Trust No. 60,127 (subdivider) and Fidelity National Title Agency, Inc., an Arizona corporation, (trustee), recorded at the Pima County Recorder's Office at Docket 12292, Page 6636, assuring the completion of public improvements; and WHEREAS, Richmond American Homes of Arizona, has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Gladden Farms - Block 10; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Gladden Farms - Block 10 is hereby released from the Assurance Agreement with Richmond American Homes of Arizona under Trust No. 60,127 and Fidelity National Title Agency, Inc. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 0.75 miles of paved streets for the following appurtenances, as depicted on Exhibit A: a.
