AGENDA TITLE: Resolution No. 2006-58: Relating to Development; approving and
authorizing a release of assurances for Continental Reserve -
Block 9 and acceptance of public improvements for maintenance.
DISCUSSION
Approval of Resolution No. 2006-58 will release the following Assurance Agreement
regarding Continental Reserve - Block 9 as depicted on Exhibit A. Continental Reserve
Block 9 is comprised oflots 1-165 and common areas 'A' through 'K'.
In releasing said Assurance Agreement, the Town of Marana will accept for
maintenance, including regulatory traffic control signs and street signs, approximately
1.25 miles ofthe following paved streets:
Crested Quail Drive
Crimson Ridge Drive
Crimson Sky Drive
Rocky Brook Drive
Rosarita Place
Sand Flower Road
Shining Amber Lane
Siesta Rock Drive
The Town of Marana will also accept for maintenance, including hydrants, valves and meters, a
potable water system servicing the block as depicted on design plans on file with the Town.

RECOMMENDATION
Staff recommends that Mayor and Council release the Assurances for Continental Reserve
Block 9 and accept the public improvements for maintenance.

Release of Assurances Block 9 Continental Reserve
MARANA RESOLUTION NO. 2006-58
RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING A RELEASE OF
ASSURANCES FOR CONTINENTAL RESERVE - BLOCK 9 AND ACCEPTANCE OF
PUBLIC IMPROVEMENTS FOR MAINTENANCE.
WHEREAS, Continental Reserve - Block 9 is a 37.645 acre subdivision located east of
Continental Reserve Loop and at Pima Farms Drive, containing lots 1-165, common areas A
through K, and is recorded at the Pima County Recorder's Office in Book 55 of Maps and Plats,
Page 80; and
WHEREAS, the Town has previously entered into the following Assurance Agreement
assuring the completion of public improvements; and
· Assurance Agreement between Taro Properties Arizona I, LLC, an Arizona
limited liability company, (beneficiary) under Trust No. 4942 (subdivider) and
First American Title Insurance Company, a California corporation, (trustee) and
the Town of Marana for lots 1-165 and common areas A - K, recorded at the
Pima County Recorder's Office at Docket 11767, Page 5452.
· Assurance Agreement between GMAC Model Home Finance, Inc., a Virginia
corporation, (beneficiary) under Trust No. 4916 (subdivider) and First
American Title Insurance Company, a California corporation, ( trustee) and the
Town of Marana for lots 151, 152 & 153, recorded at the Pima County
Recorder's Office at Docket 11879, Page 3409.
· Assurance Agreement between Monterey Home Construction, Inc., an Arizona
corporation, (beneficiary) under Trust No. 4891 (subdivider) and First
American Title Insurance Company, a California corporation, (trustee) and the
Town of Marana for lots 5, 6, 9, 10 & 14, recorded at the Pima County
Recorder's Office at Docket 11835, Page 1230.
· Assurance Agreement between Monterey Home Construction, Inc., an Arizona
corporation, (beneficiary) under Trust No. 4891 (subdivider) and First
American Title Insurance Company, a California corporation, (trustee) and the
Town of Marana for lots 8, 15, 72, 75 & 78 and common areas A - K, recorded
at the Pima County Recorder's Office at Docket 11870, Page 3461.
· Assurance Agreement between Monterey Home Construction, Inc., an Arizona
corporation, (beneficiary) under Trust No. 4891 (subdivider) and First
American Title Insurance Company, a California corporation, ( trustee) and the
Town of Marana for lots 7, 11 , 12, 13 & 69, recorded at the Pima County
Recorder's Office at Docket 11870, Page 3461.

. Assurance Agreement between Taro Properties Arizona I, LLC, an Arizona
limited liability company, (optionor) and Monterey Horne Construction, Inc., an
Arizona corporation (optionee) under Trust No. 4942 (optionor trust) and 4891
(optionee trust) and First American Title Insurance Company, a California
corporation, (trustee) and the Town of Marana for lots 16, 20, 22, 23, 32-61,
63, 64, 80, 83-85, 87-89, 91, 94-150, & 154-165, recorded at the Pima County
Recorder's Office at Docket 12071, Page 4519.
WHEREAS, Pulte Homes Corporation, has completed the public improvements
acceptable to Town standards in accordance with the Assurance Agreement for Continental
Reserve - Block 9; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana as follows:
Section 1. Continental Reserve - Block 9 IS hereby released from the below
mentioned Assurance Agreement.
Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, 1.25 miles of paved streets for the following appurtenances, as
depicted on Exhibit A:
a. Crested Quail Drive
b. Crimson Ridge Drive
c. Crimson Sky Drive
d. Rocky Brook Drive
e. Rosarita Place
f. Sand Flower Road
g. Shining Amber Lane
h. Siesta Rock Drive
Section 3. The Town will also accept for maintenance, including hydrants, valves and
meters, a potable water system serving the block as depicted on design plans on file with the
Town.
