SUBJECT: Resolution No. 2006-91: Relating to Municipal Court; approving
the appointment of magistrates pro tempore and civil traffic hear-
ing officers.
DISCUSSION
Pursuant to Article 5-2 of the Marana Town Code, the Mayor and Council may appoint magis-
trates pro tempore to serve in the Marana Municipal Court on an as-needed basis. Therefore, I
recommend that the following licensed attorneys be appointed to serve in this capacity.
Thomas Benavidez, Frederick Klein, Daniel Jurkowitz, Kate Dawes,
David Dingeldine, and Thomas Johnson
Pursuant to Section 5-2-3 of the Marana Town Code, the Town Magistrate, with the approval of
the Mayor and Council, may appoint hearing officers to preside over certain civil traffic proceed-
ings on an as-needed basis. Therefore, I recommend that the following individuals be appointed
to serve as hearing officers.
George Anderson and Sandra Celaya
I believe that these individuals are qualified for the position and will serve honorably.
All of these appointments would be for a term concurrent with that of the Town Magistrate, until
June, 2008. Any of the appointees may be removed from office for cause. All ofthe appointees
would have the status of independent contractors with the exception of Ms. Celaya who is a full-
time employee of the Town. All magistrates pro tempore will be paid on a per-session basis at
the rate of $120.00 for a half day and $240.00 for a full day of service. Hearing Officer Ander-
son shall be paid at the rate of $75.00 for a half day and $150.00 for a full day of service. Ms.
Celaya, as a full-time employee of the Town, shall not receive additional compensation beyond
her regular salary and benefits.

RECOMMENDATION
Staff recommends adoption of Resolution No. 2006-91 approving the appointments of Thomas
Benavidez, Frederick Klein, Daniel Jurkowitz, Kate Dawes, David Dingeldine, and Thomas
Johnson as magistrates pro tempore and further recommends that George Anderson and Sandra
Celaya be appointed as Civil Hearing Officers, all with terms ending June 30, 2008.

MARANA RESOLUTION NO. 2006-91
RELATING TO MUNICIPAL COURT; APPROVING THE APPOINTMENT OF
MAGISTRATES PRO TEMPORE AND CIVIL TRAFFIC HEARING OFFICERS.
WHEREAS, Sections 5-2-1 and 5-2-2 of the Town Code, as amended, provide that the
Mayor and Council of the Town of Marana shall appoint assistants to the Town Magistrate, as
are needed from time to time; and .
WHEREAS, the Mayor and Council upon recommendation of the Town Magistrate, the
Honorable James West, have determined that it is necessary to appoint qualified individuals to
serve as assistant magistrates or magistrates pro tempore on an as-needed basis in the Marana
Municipal Court; and
WHEREAS, the Town Magistrate recommends that the Mayor and Council appoint the
following individuals to serve as assistant magistrates or magistrates pro tempore on an as-
needed basis: Thomas Benavidez, Frederick Klein, Daniel Jurkowitz, Kate Dawes, David
Dingeldine, and Thomas Johnson.
WHEREAS, the Mayor and Council find that these individuals meet the qualifications
imposed by Arizona law and possess the requisite skill and character to perform as judges pro
tempore; and
WHEREAS, pursuant to Section 5-2-3 of the Town Code, as amended, the Town
Magistrate, with the approval of the Mayor and Council, may appoint one or more hearing
officers to preside over civil traffic violation cases; and
WHEREAS, the Town Magistrate wishes to appoint George Anderson and Sandra Celaya
to serve as hearing officers; and
WHEREAS, the Mayor and Council find that these individuals meet the qualifications
imposed by Arizona law and possess the requisite skill and character to perform as hearing
officers.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, ARIZONA, that the following individuals are appointed to serve as
assistant magistrates or magistrates pro tempore on an as-needed basis: Thomas Benavidez,
Frederick Klein, Daniel Jurkowitz, Kate Dawes, David Dingeldine, and Thomas Johnson.
BE IT FURTHER RESOLVED that George Anderson and Sandra Celaya are appointed
to serve as civil traffic hearing officers.
BE IT FURTHER RESOLVED that these magistrates pro tempore and hearing officers
shall serve terms ending June 30, 2008, but may be removed for cause.

BE IT FURTHER RESOLVED that the magistrates pro tempore shall be paid at the rate
of $120.00 per half-day and $240 per full-day of service, and the hearing officer, George
Anderson, shall be paid $75.00 per half-day and $150 per full-day of service, as independent
contractors to the Town.
BE IT FURTHER RESOLVED that the hearing officer, Sandra Celaya, who is an
employee of the Town, shall receive no additional compensation as hearing officer other than her
regular pay and benefits as an employee of the Town.
PASSED AND ADOPTED BY THE MAYOR AND COUNCIL OF THE TOWN OF
MARANA, ARIZONA, this 20th day of June, 2006.
