DISCUSSION The Community Development Block Grant Program Contract for 2004 between the Town of Marana and Pima County expires on December 31, 2005. Pima County is requesting Amendment Number 1 to the contract to extend the contract to December 31, 2006. ATTACHMENTS Intergovernmental Agreement Amendment Number 1. RECOMMENDATION Staff recommends that Council approve the Amendment Number 1 to extend the outstanding 2004 CDBG program contract with Pima County. SUGGESTED MOTION I move to approve Resolution No. 2005-147. MARANA RESOLUTION NO. 2005-147 RELATING TO COMMUNITY DEVELOPMENT BLOCK GRANTS; APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT NUMBER 1 TO THE 2004 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CONTRACT FOR MANAGEMENT AND IMPLEMENTATION OF REMAINING PROJECT FUNDS WHEREAS, the Town of Marana and Pima County entered into an intergovernmental agreement relating to the implementation of the Community Development Block Grant Program for 2004 which expires December 31,2005; and WHEREAS, both the Town and the County desire to extend the expiration date to December 31,2006; and WHEREAS, the Town believes extending the intergovernmental agreement would greatly benefit the citizens of the Town of Marana and would be in the Town's best interest. NOW, THEREFORE, BE IT RESOLVED that the Town of Marana shall enter into amendment to the Intergovernmental Agreement between the Town of Marana and Pima County to change the expiration date of the Intergovernmental Agreement for the implementation of the Community Development Block Grant Program, Amendment 1 to Contract No. 01-70-M-135462-11 04, to December 31, 2006. ARTICLE I - TERM AND EXTENSION/RENEWAL: a. Delete the first two sentences in their entirety and replace with the following: This Contract shall commence on the 1$t day of November. 2004, and shall terminate on the 31st of December. 2006 unless sooner terminated or further extended pursuant to the provisions of this Contract, provided that it shall not be effective until recorded with the Pima County Recorder following execution by both parties. This Contract, upon mutual consent of the parties, may be extended for succeeding one-year periods for up to 1 additional year. All other provisions of this contract, not specifically changed by this amendment, shall remain in effect and be binding upon the parties. This amendment shall be effective upon execution by the Chair of the Pima County Board of Supervisors, provided that it has been previously executed by the CONTRACTOR.
