HomeMy WebLinkAbout11/01/2005 Blue Sheet Disaster Assistance Agreement with Arizona Division of Emergency Management TOWN COUNCIL MEETING INFORMATION TOWN OF MARANA MEETING DATE: November 1, 2005 AGENDA ITEM: I. 2 TO: MAYOR AND COUNCIL FROM: Richard Vidaurri, Chief of Police AGENDA TITLE: Resolution No. 2005-137; Relating to the Police Department; approving and authorizing the execution of a disaster assistance agreement between the Arizona Division of Emergency Management and the Marana Police Department DISCUSSION The purpose of the agreement is to allow the Arizona Division of Emergency Management to provide assistance funds to political subdivisions for emergency situations. Prior to the distribution of funds, the jurisdiction must designate an agent and submit a completed assistance agreement. Steven W. Johnson, sergeant in charge of administration services for the Marana Police Department, is deemed the appropriate agent for this purpose. ATTACHMENT Disaster Assistance Agreement. RECOMMENDATION Staff recommends approval of the agreement between the Arizona Division of Emergency Management and the Marana Police Department. SUGGESTED MOTION I move to adopt Resolution No. 2005-137. DEAiga 11/01/05 MARANA RESOLUTION NO. 2005-137 RELATING TO THE POLICE DEPARTMENT; APPROVING AND AUTHORIZING THE EXECUTION OF A DISASTER ASSISTANCE AGREEMENT BETWEEN THE ARIZONA DIVISION OF EMERGENCY MANAGEMENT AND THE MARANA POLICE DEP ARTMENT. WHEREAS, the Arizona Division of Emergency Management provides assistance funds to political subdivisions for emergency situations; and WHEREAS, the Arizona Division of Emergency Management requires that prior to the distribution of disaster assistance funds, a jurisdiction must designate an agent and submit a completed assistance agreement; and WHEREAS, the Mayor and Council of the Town of Marana feel it is in the best interests of the public to enter into this agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that the disaster assistance agreement between the Town of Marana and the Arizona Division of Emergency Management, attached to and incorporated by this reference in this resolution as Exhibit A, is hereby approved. IT IS FURTHER RESOLVED that the staff designated in the agreement is hereby directed and authorized to undertake all other and further tasks required or beneficial to carry out the terms, obligations, and objectives ofthis agreement. Bronson, Town Clerk Frank Cassidy, Town Attorney {00001006.DOC /} DISASTER ASSISTANCE AGREEMENT FOR STATE PROCLAMATIONS (Political Subdivisions) This Agreement between the Division of Emergency Management, State of Arizona, and the APPLICANT NAME (the applicant) shall be effective on the date signed by both parties. It shall apply to all assistance funds provided by the State to the Applicant as a result of an emergency situation, beginning August 15, 2005 through February 15, 2006, and pursuant to the Governor's Declaration of Emergency on August 15,2005. The designated representative of the Applicant certifies that: 1. He/She has legal authority to apply for assistance on behalf of the Applicant. 2. The Applicant shall provide all necessary financial and managerial resources to meet the terms and conditions of receiving State disaster assistance. 3. The Applicant understands that final payment will be made after work is completed and claimed costs have been audited. 4. The Applicant shall establish and maintain a proper accounting system to record expenditures of disaster assistance funds in accordance with generally accepted accounting standards or as directed by the Governor's Authorized Representative. 5. The Applicant shall, upon request of the Governor's Authorized Representative, participate with State personnel in performing interim and/or final inspections. 6. The Applicant shall comply with all applicable codes and standards in completion of eligible repair or replacement of damaged public facilities. 7. The Applicant shall comply with any mitigation requirements specified by the State for repair or replacement projects subject to repeated damages from flooding or other hazards. 8. The Applicant shall comply with all applicable provisions of State laws and regulations in regard to procurement of goods and services and to contracts for repair or restoration of public facilities. 9. The Applicant shall comply with applicable State and Federal laws regarding the environment (NEP A; National Environmental Protection Act). 10. The Applicant shall comply with all State laws and regulations relating to nondiscrimination. 11. The Applicant shall comply with provisions of the Hatch Act limiting the political activities of public employees. 12. The Applicant shall comply with the flood insurance purchase requirements which may be required. 13. The Applicant shall not enter into cost-plus-percentage-of-cost contracts for completion of disaster restoration or repair work. 14. The Applicant shall not enter into contracts for which payment is contingent upon receipt of State funds. 15. The Applicant shall not enter into any contract with any party that is debarred or suspended from participating in State assistance programs. 16. The Applicant shall comply with cost-sharing requirements of State disaster assistance; specifically, that State assistance is limited to 75% of eligible expenditures. The Applicant shall provide the remaining 25% share of eligible costs. 17. The Applicant shall use disaster assistance funds solely for the purposes for which these funds are provided and as approved by the GAR. 18. The Applicant shall return to the State, within two months of such request by the Governor's Authorized Representative, any partial reimbursement not supported by audit or other State review of documentation maintained by the Applicant. 19. The Applicant's records and supporting documentation relating to claims made by the Applicant shall be kept for five (5) years from the ending date of an emergency and shall be available for inspection and audit at all reasonable times by the Department and the Auditor General. 20. The Applicant understands and will abide by the following work completion deadlines: Emergency Work (Category A&B) February 15. 200ft; Permanent Work (Category C-G) Not Applicable Extensions will be granted due to conditions/causes, which are beyond Applicant's control. 21.
