DISCUSSION
ReQuest and Historv
The applicant requests approval of an amended final plat for a 25-10t single family detached
home subdivision on approximately 73 acres located north of Moore Road and east of Wild
Burro Road. This project was approved by the Town Council October 19, 2004 by Resolution
No. 2004-145. The original final plat was recorded at Book 58 Page 100.
ReQuested Plat Chan2:es
The general note #19 on the original plat stated each lot was restricted to a maximum disturbance
area of 15,000 square feet as per the requirement of the U.S. Fish and Wildlife Service in a letter
dated February 28,2004.
The project's developer re-consulted with the U.S. Fish and Wildlife Service which resulted in
an increase of allowable disturbance area. The new letter dated May 4, 2005 is included in this
packet and states the project will be allowed to disturb up to 25,000 square feet per lot. Further,
it requires that areas disturbed by septic tanks and leach fields will be re-vegetated with native
vegetation, minimizing the effect of disturbance. The developer is also required to submit to
U.S. Fish and Wildlife a site plan for each lot finalizing the location ofthe building envelope.
There will be a maximum 25 percent overall site disturbance. The amended plat calculations
show that once the roads are accounted for, the average lot disturbance area will be 23,670
square feet. Staff will track the grading area of each lot.

FINAL PLAT FOR GARDEN ESTATES.
WHEREAS, on October 19, 2004 the Town of Marana adopted Resolution No. 2004-
145, approving the final plat for Garden Estates, Book 58 Page 100; and
WHEREAS, Garden Estates L.L.C., the owner of Garden Estates, has applied for
approval of an amended final plat for a 25-10t single-family home subdivision on 72.66 acres,
including lots 1 through 25 and common area "A", and is generally located north of Moore Road
and west of Wild Burro Road, within Section 26, Township 11 South, and Range 12 East; and
WHEREAS, a new U.S. Fish and Wildlife letter, dated May 4, 2005, increased the
allowable disturbance area for each lot from 15,000 to 25,000 square feet, with a maximum
overall project disturbance of 25 percent; and
WHEREAS, the Town Council, at their regular meeting on October 18, 2005, determined
that the Garden Estates amended final plat should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that Garden Estates amended final plat is hereby approved.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 18th day of October, 2005.

Dear Mr. Schwartz:
This letter is in response to your April 14, 2005 request to modifY the overall percentage of
ground disturbance associated with the Garden Estates residential development located in
Marana, Pima County, Arizona. Specifically, you requested the flexibility of incre.asing the
building envelope within each lot to a maximum of25,000 if. The current building envelopes,
as described within the final biological opinion (BO) for this project, are approximately 15,000
if. The current ground disturbance levels were determined during section 7 consultation with
the Army Corps of Engineers (ACOE) in compliance with the Endangered Species Act (ESA).
Consultation was completed because of the potential effects of this project on the cactus
ferruginous pygmy-owl (Glaucidium brasilianum cactorum; pygmy-owl), a species listed as
endangered under the ESA. We have reviewed the proposed modifications in relation to the
analysis conducted during consultation and provide the following comments.
While the area ~f disturbance within each lot could potentially increase by 10,000 ft2, it is our
understanding that the maximum disturbance of25,000 ft2 is unlike1yJo be utilized on every lot.
You simply want the flexibility regarding the size pf the home to be constructed. It is also our
understanding that the driveway, septic tank, and leach field are included in the new level of
disturbance. Much of the disturbance associated with these features would be temporary, as you
have committed to revegetate most, if not all, of this disturbance with native vegetation. With
some additional flexibility, you indicated that you can construct a home that is more in harmony
with the resources of each site and, in many cases, reduce impacts to vegetation below what
would occur using the current building envelope. At our March 30, 2005- meeting, you showed
how this could be accomplished using a specific lot layout as an example. Overall, the
configuration of development evaluated during consultation would be maintained, and the wash
areas would continue to be preserved to provide pygmy-owl nesting and dispersal habitat. The
projected 25% overall disturbance level is still within the range of disturbance documented at
occupied pygmy-owl home ranges elsewhere in northwest Tucson.

You have agreed to avoid or minimize any additional effects to pygmy-owls or pygmy-owl
habitat through the incorporation of additional conservation measures. You have indicated that
the following conservation measures will be implemented during development of each lot within
this development:
_ Building envelopes will be located within each lot in such a way as to avoid impacts to the
highest quality pygmy-owl habitat (large trees and saguaros). The vegetation and topography
within in each lot will be considered as the building envelopes within each lot are identified.
- An II" x 17" site plan for each lot will be submitted to us for review and comment prior to
finalizing the location of the building envelope.
- The location ofthe driveway, septic tank, and leach field will be located within each lot in a
manner that minimizes disturbance to large trees and saguaros. Following the completion of
these features, the disturbed margins of the driveway and the above-ground area associated with
the septic tank and leach field will be revegetated using native plant species and emphasizing
trees and saguaros per your April 14, 2005 letter.
We have reviewed the proposed changes in relation to 50 CFR 402. I 6(a-d) to gauge whether
reinitiation of formal consultation may be warranted. Part c of those regulations states that
reinitiation is required "if the identified action is subsequently modified in a manner that causes
an effect to the listed species or critical habitat that was not considered in the biological
opinion. . ." In our opinion, the proposed change in the action does not alter effects to the pygmy-
owl or its critical habitat in a way that was not considered in the biological opinion.
Furthermore, none of the other three reinitiation criteria appear to be triggered. Therefore, we
believe that no further consultation is required at this time. This review is specific to these
proposed building envelope changes. The terms and conditions of the final biological opinion
are still valid and any further changes to the disturbance limits within this project are subject to
our review and/or reinitiation of consultation.
As the Federal action agency for this project, the ACOE will ultimately decide whether
reinitiation is appropriate. Please coordinate with the local ACOE project manager regarding this
