Berlin, AICP, Planning Director SUBJECT: Public Hearin2. Ordinance No. 2005.23: Relating to Development; approving and authorizing a rezoning for the Hopkins Family Trust. DISCUSSION Historv The town initiated this rezoning of approximately 14 acres of land owned by the Hopkins Family Trust. The intent of the rezoning is to replace the antiquated zoning of "E" with a contemporary zoning district in an area where development is imminent. Staff recommends the Hopkins Family Trust parcel be rezoned to "VC" Village Commercial because it will help to create a cohesive commercial core at the Marana Road interchange and at the western edge of the San Lucas development along 1-10. At no cost to the town, Hopkins Family Trust dedicated 1.5 acres of the 14 acres for right-of-way improvements leading into the San Lucas development off Adonis and Marana Roads. Location This property is approximately 14 acres of land located west of the San Lucas development, east of the railroad and 1-10 and generally north of Adonis Road. Zonin2 Current zoning on the site is "E" (Transportation Corridor). The town requests rezoning to "VC" (Village Commercial). Approximately 33 acres of land to the east and north are also Village Commercial. Interstate 1 0 lies to the northwest and to the southwest. Much of the land fronting 1-10 remains zoned "E". The General Plan identifies the rezoning area as Corridor Commerce, which is compatible with "VC" zoning. Future Development The Hopkins Family Trust intends to develop a retail center on the site. RECOMMENDATION Staff prepared the application in compliance with the Marana Land Development Code, Northwest Marana Area Plan and the Marana General Plan. Staff recommends approval of this rezoning with the following condition: RECOMMENDED CONDITION OF APPROVAL 1. Compliance with all provisions of the town's codes, ordinances, and policies at the time of any subsequent development. SUGGESTED MOTION I move to adopt Ordinance No. 2005.23. -2- 100405 PCZ-03043 Hopkins Family Trust Rezone MARANA ORDINANCE NO. 2005.23 RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING A REZONING FOR THE HOPKINS FAMILY TRUST. WHEREAS, The Town of Maran a represents the property owners of approximately 14 acres ofland located east ofthe railroad and 1-10 and generally north of Adonis Road within a portion of Section 22, Township 11 South, Range 11 East, as described on Exhibit "A", attached hereto and incorporated herein by this reference; and, WHEREAS, the Marana Planning Commission held a public hearing on August 31, 2005, and at said meeting voted 7-0 to recommend that the Town Council approve said rezoning, adopting the recommended conditions; and, WHEREAS, the Marana Town Council heard from representatives ofthe owner, staff and members of the public at the regular Town Council meeting held October 4, 2005 and has determined that the rezoning should be approved; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Maran a, Arizona, as follows: Section 1. The rezoning of approximately 14 acres ofland located east of the railroad and 1-10 and generally north of Adonis Road complies with the General Plan. Section 2. The rezoning area is hereby changed from Zone "E" (Transportation Corridor) to "VC" (Village Commercial) on the 14 acres of land, located east of the railroad and 1-10 and generally north of Adonis Road. Section 3. The intent ofthe rezoning is to replace the antiquated zoning designation of"E" with a contemporary zoning in an area where development is imminent. The 14 acre rezoning is subj ect to the following condition, the violation of which shall be treated in the same manner as a violation of the Town of Marana Land Development Code (but which shall not cause a reversion ofthis rezoning ordinance): 1. Compliance with all provisions of the town's Codes, Ordinances, and policies at the time of any subsequent development. Section 4. Ofthe 14 acres, 1.5-acres has been dedicated to the Town of Maran a at no cost for right- of-way improvements, including land for the extension of Adonis Road and land for the extension of Marana Road into Cochie Canyon Trail. All Ordinances, Resolutions and Motions and parts of Ordinances, Resolutions, and Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of Ordinance No. 2005.23. Section 6. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. IX.B.2 STAFF REPORT PLANNING COMMISSION August 31, 2005 I CASE No: PCZ-03043 I CASE NAME: Hopkins Family Trust Rezoning Owner's Name: Hopkins Family Trust Applicant's Name: Town of Marana Applicant's Address: N/A Location of Request: Approximately 14 acres of land located east of the San Lucas development, west of the railroad and 1-10 along Marana Road Nature of Request: Town of Marana request for rezoning on property known as the "Hopkins Family Trust Parcel" to change from Zone "E" (Transportation Corridor) to "VC" (Village Commercial). Site Size: Approximately 14 acres Zone District: "E" (Transportation Corridor) Existing Use: Vacant Proposed Use: Commercial Report Date: August 19, 2005 Project Planner: Thomas Thivener, Planner I SUMMARY OF APPLICATION This is a Town initiated rezoning of approximately 14 acres of land lying between the San Lucas development and the Union Pacific Railroad. The land is owned by the Hopkins Family Trust. The intent of the rezoning is to replace the antiquated alphabet zoning of "E" with a contemporary zoning in an area where development is imminent. Staff is recommends the Hopkins Family Trust parcel be rezoned to "VC" Village Commercial because it will help to create a cohesive commercial core at the Marana Road interchange and at the foot of the San Lucas development. Approximately 33 acres of land to the north and east of the Hopkins Family Trust (San Lucas blocks 1 and 10) is zoned "VC" (Marana Ordinance No. 2003.25). As a condition of the San Lucas development, the developer was required to perform a number of off site improvements to provide adequate regional circulation and appropriate access to the project itself. These improvements include the realignment of Cochie Canyon Trail with the existing Marana Road interchange and the extension of Adonis Road. In order for these right-of-way improvements to happen portions of the Hopkins Family Trust property were dedicated to the Town of Marana at no cost. Of the 14 acres of the property in question, approximately 1.5 acres have been dedicated. The Town initiated a rezoning in 2003 but the owners of the property, Hopkins Family Trust, requested a continuance to resolve unfinished matters regarding their property. Now the owners are ready to proceed with the rezoning. RECOMMENDED CONDITIONS 1. Compliance with all provisions of the Town's Codes, Ordinances, and policies of the General Plan, current at the time of any subsequent development, including, but not limited to, requirement for public improvements. 2. Before a certificate of occupancy is issued for any dwelling unit on the Property, the developer shall have completed or shall provide evidence to the Town's satisfaction that the developer has made a diligent effort to complete the process of having the Property annexed into a fire district. RECOMMENDED FINDINGS OF FACT 1. The development of the property in a fashion and use consistent with the adjacent San Lucas parcels will benefit the community. The project is in compliance with all other development standards related to this classification. 2. This proposal is consistent with the purpose and intent of the Land Development Code, the Northwest Marana Area Plan and the Town of Marana General Plan. 3. This proposal does not appear to be detrimental to the immediate area or to the health, safety, and welfare of the inhabitants of the area and the Town of Marana. Staff Recommendation: Staff recommends that the property be rezoned from "E" to "V C" Suggested Motion: I move that PCZ-03043, Hopkins Family Trust Rezoning be approved subject to staff recommended conditions.
