HomeMy WebLinkAbout10/04/2005 Blue Sheet Facilities Usage Agreement with Pima Community College October 4, 2005 AGENDA ITEM: ~ (:~:) ~ J.4 TOWN COUNCIL MEETING INFORMATION MEETING DATE: TOWN OF MARANA TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: Resolution No. 2005-128: Relating to Town Facilities; approving and authorizing the Mayor to execute an agreement allowing Pima Commu- nity College to use Marana Meeting Facilities. DISCUSSION Pima Community College ("PCC") has approached the Town about using the Conference Center at the Marana Municipal Complex and the large conference room at the Parks and Recreation administration building to hold classes for the 2006 Spring Semester. The Town's Meeting Facilities Usage Policy suggests that special arrangements for regular, long-term use of Town meeting facilities be the subject of a special agreement approved by the Council, establishing such fees and other provisions for room usage as the Council determines appropriate for the particular circumstances. Because of the close and cooperative historic relationship between PCC and the Town ofMarana, Town staff believes that it is appropriate to allow PCC to use the above-mentioned facilities in accordance with the terms of the proposed meeting facilities usage agreement with PCC presented to the Council tonight for its consideration. RECOMMENDATION Staff recommends approving and authorizing the Mayor to execute the meeting facilities usage agreement with PCC. SUGGESTED MOTION I move to approve Resolution No. 2005-128. MARANA RESOLUTION NO. 2005-128 RELATING TO TOWN FACILITIES; APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT ALLOWING PIMA COMMUNITY COLLEGE TO USE MA- RANA MEETING FACILITIES. WHEREAS, Pima Community College has requested to use Marana Meeting Facilities, i.e., the Conference Center and the Parks and Recreation large conference room, for the 2006 Spring Se- mester; and WHEREAS, the Mayor and Council ofthe Town of Marana feel it is in the best interests of the public to allow such use. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, that the agreement between the Town of Maran a and Pima Community Col- lege attached to and incorporated by this reference in this resolution as Exhibit A is hereby approved, and the Mayor is hereby authorized to execute it for and on behalf ofthe Town of Marana. IT IS FURTHER RESOLVED that the Town's Manager and staff are hereby directed and au- thorized to undertake all other and further tasks required or beneficial to carry out the terms, obliga- tions, and objectives ofthe aforementioned agreement. Bronson, Town Clerk APPROVED AS TO FORM: Frank Cassidy, Town Attorney {0000/306.DOC I} FJC.'cds 9127105 ~ MARANA ~/l, TOWN OF MARANA AGREEMENT BETWEEN THE TOWN OF MARANA AND PIMA COMMUNITY COLLEGE FOR THE USE OF MARANA MEETING FACILITIES The Town of Marana (the "Town") hereby grants to Pima Community College ("PCC") use of the following Town facilities from January 15, 2006 through May 15,2006: Marana Municipal Complex Conference Center, Second Floor West, 11555 W. Civic Center Drive, Marana AZ 85653, 5 P.M. - 9 P.M. Mondays and Thursdays Marana Parks and Recreation Facility, Large Conference Room, 13251 N. Lon Adams Road, Marana AZ 85653, 9 A.M. - 1 P.M., Tuesdays and Thursdays PCC may at its option use the facilities for less time than is shown in this agreement. PCC shall pay the Town a room usage fee of $300 per section, and currently anticipates sched- uling five sections during the times set aside under this agreement. The total semester cost, currently anticipated to be $1,500, is payable no later than January 1,2006. If PCC needs technical assistance with the audio/visual or other equipment from Town person- nel, PCC shall pay the Town's standard rates for that assistance as set forth in the Town's Meeting Fa- cilities Usage Policy as it may be amended from time to time. PCC acknowledges that it has received a current copy of the Town's Meeting Facilities Usage Policy and agrees that it shall comply with and enforce the rules of conduct as set forth in that Policy. This agreement shall be effective when it is signed on behalf of both parties and shall continue in full force and effect until May 15, 2006. PCC shall release, hold harmless and indemnify the Town and its officers, employees and agents from and against any and all losses, liability, claims, actions, suits or damages (including but not limited to, personal injury damages, including death, or property damages) which arise, result, or are otherwise attributable to PCC's negligent acts or omissions in connection with its use of the Town's facilities.
