Brad DeSpain, Utilities Director SUBJECT: Ordinance No. 2005.25: Relating to Water; adopting development impact fees for water; and providing for an effective date. DISCUSSION On June 21, 2005, the Council heard a presentation regarding proposed water impact fees. On July 5, 2005, the Council reviewed, approved and made available to the public the notice of intention to adopt water development impact fees and impact fee technical reports for the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee. Notice was published on July 8 for a September 6 public hearing, where no members. of the public spoke. Staff has met with Southern Arizona Home Builders Association to explain the water impact fees. If the water impact fees are adopted the first day for collection of the fees will be January 2,2006. RECOMMENDATION The Water Utility Advisory Committee and Staff recommend adoption of Ordinance No. 2005.25, adopting the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee. WHEREAS, the Town is authorized by A.R.S. S 9-463.05 to assess and collect development impact fees so that development pays for itself; and WHEREAS, the technical reports entitled "Proposal for Town of Marana Gravity Storage and Renewable Water Resource Fee" and "Proposal for Water System Infrastructure Impact Fee" (the "Technical Reports") identify the current and anticipated future service area of the Town of Marana Water Utility as the benefit area of the Town water development fees and determine the fair-share water development impact fees attributable to the typical water customer within the area using a 'is'' x %" meter as an "Equivalent Dwelling Unit" ("EDU") and calculating EDU equivalency to other meter sizes; and WHEREAS, the Technical Reports determine the Town's reasonably anticipated costs for providing water service and facilities needed to serve the Town's expanding population and wa- ter demands; and WHEREAS, the Technical Reports consider the contributions made or to be made in the future by applicants for Town water service toward or for the construction of Town water facili- ties; and WHEREAS, the Technical Reports contain all documentation supporting the assessment of the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water Sys- tem Infrastructure Impact Fee WHEREAS, the Technical Reports were released to the public on July 5, 2005, when advance notice of intention to assess the water development impact fees was given, and a public hearing was held on the proposed fees on September 6,2005, all in accordance with A.R.S. S 9- 463.05; and WHEREAS, the adoption of the water impact fees is in the best interests of the Town of Marana. {00001322.00C I} Water Development Impact Fee Ordinance - 1 - 9/27/20051:08 PM FJC NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, AS FOLLOWS: SECTION 1. The current and anticipated future service area of the Town of Marana Wa- ter Utility is hereby established as the benefit area of the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee. SECTION 2. The Marana Gravity Storage and Renewable Water Resource Fee is hereby adopted as follows: Meter Size (inches) EDUs Fee %x% 1.0 $1,467.00 % 1.2 $1,760.00 1 2.5 $3,667.00 lY2 5.0 $7,335.00 2 8.0 $11,736.00 3 15.0 $22,005.00 4 25.0 $36,675.00 6 50.0 $73,350.00 SECTION 3. When calculating the amount of the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee to be collected for any other meter size, Town Staff shall determine the meter's EDU equivalency using the meth- ods set forth in the Technical Reports. SECTION 5. Town Staff shall collect the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee for residential dwelling units when construction permits for the dwelling units are issued. For all other uses, Town Staff shall collect the Marana Gravity Storage and Renewable Water Resource Fee and the Marana Water System Infrastructure Impact Fee when an application for water service is submitted. {OOOOI 322.DOC I} Water Development Impact Fee Ordinance - 2 - 9/27/20051:08 PM FJC SECTION 6. When assessing the Marana Gravity Storage and Renewable Water Re- source Fee and the Marana Water System Infrastructure Impact Fee, Town Staff shall give credit for the required dedication of public sites and improvements provided by the fee payer for im- provements funded with the respective fees, as provided by law. SECTION 7. All Marana Gravity Storage and Renewable Water Resource Fees and Ma- rana Water System Infrastructure Impact Fees collected by the Town shall be held and disbursed in accordance with the requirements of A.R.S. S 9-463.05. SECTION 8. The Town's Manager and staff are hereby directed and authorized to under- take all other and further tasks required or beneficial to carry out the terms, obligations, and ob- jectives ofthis ordinance. SECTION 9. The provisions of this ordinance shall be effective and shall apply to all ap- plications for water service submitted on and after January 2,2006.
