Resolution No. 2005-118: Relating to Town Facilities; approving and
authorizing the Mayor to execute an agreement allowing the Marana
Unified School District Governing Board to use the Council Chambers
at the Marana Municipal Complex.
DISCUSSION
The Marana Unified School District (MUS D) Governing Board has approached the town about using the
Council Chambers for their regular MUSD Governing Board meetings at 7:00 p.m. on the second and
fourth Thursdays of each month. Historically, the Governing Board has moved its meetings to various
locations throughout the district. The board has decided to establish a consistent meeting location.
The town's Meeting Facilities Usage Policy suggests that special arrangements for regular, long-term use
of town meeting facilities be the subject of a special agreement approved by the Council, establishing
such fees and other provisions for room usage as the Council determines appropriate for the particular
circumstances.
Because of the close and cooperative historic relationship between MUSD and the Town of Marana, town
staff believes that it is appropriate to allow the MUSD Governing Board to use the Marana Town Council
Chambers at the new Marana Municipal Complex for the Governing Board's regular meetings without the
need to charge MUSD a fee for the regular use of the facilities. Instead, the proposed room usage agree-
ment with MUSD presented to the Council simply provides for reimbursement of any town costs incurred
in providing technical assistance for equipment in the Council Chambers.

RECOMMENDATION
Staff recommends approving and authorizing the Mayor to execute the room usage agreement with
MUSD.

MARANA RESOLUTION NO. 2005-118
RELATING TO TOWN FACILITIES; APPROVING AND AUTHORIZING THE MAYOR TO
EXECUTE AN AGREEMENT ALLOWING THE MARANA UNIFIED SCHOOL DISTRICT
GOVERNING BOARD TO USE THE COUNCIL CHAMBERS AT THE MARANA MUNICIPAL
COMPLEX.
WHEREAS, the Town of Marana desires to allow the Marana Unified School District Gov-
erning Board to use the Council Chambers at the Marana Municipal Complex for their regular meet-
ings; and
WHEREAS, the Mayor and Council of the Town of Maran a feel it is in the best interests of
the public to allow such use.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, that the agreement between the Town of Marana and the Marana Unified
School District Governing Board, attached to and incorporated by this reference in this resolution as
Exhibit A is hereby approved, and the Mayor is hereby authorized to execute it for and on behalf of
the Town of Marana.
IT IS FURTHER RESOLVED that the Town's Manager and staff are hereby directed and au-
thorized to undertake all other and further tasks required or beneficial to carry out the terms, obliga-
tions, and objectives of the aforementioned agreement.

AGREEMENT BETWEEN THE TOWN OF MARANA
AND THE MARANA UNIFIED SCHOOL DISTRICT
FOR THE USE OF THE MARANA COUNCIL CHAMBERS
The Town of Marana (the "Town") hereby grants use of the Town's Council Chambers at the
Marana Municipal Complex to the Marana Unified School District Board ("MUSD") to hold school
board meetings beginning at 7 P.M. on the second and fourth Thursday evenings of each month, at no
charge to MUSD. If MUSD needs technical assistance with the audio/visual or other equipment from
Town personnel, MUSD shall pay the Town's standard rates for that assistance as set forth in the
Town's Meeting Facilities Usage Policy as it may be amended from time to time. MUSD acknowl-
edges that it has received a current copy of the Town's Meeting Facilities Usage Policy and agrees that
it shall comply with and enforce the rules of conduct as set forth in that Policy.
This agreement shall be effective when it is signed on behalf of both parties and shall continue
in force and effect unless and until it is terminated by either party upon thirty days written notice to the
other.
MUSD shall release, hold harmless and indemnify the Town and its officers, employees and
agents from and against any and all losses, liability, claims, actions, suits or damages (including but
not limited to, personal injury damages, including death, or property damages) which arise, result, or
are otherwise attributable to MUSD's use of the Town's facilities. This release, hold harmless, and in-
demnity includes any cause whatsoever, including negligence of the Town or its officers, employees or
agents.
