SUBJECT: PUBLIC HEARING. Ordinance No. 2005.17: Relating to Water;
amending Section 14-7-1 of the Town Code by revising the water
rates and adopting code language establishing tiered water rates
based on consumption and use; and providing for an effective
date.
DISCUSSION
On June 21, 2005, the Mayor and Council heard a presentation regarding proposed water rate
increases. Per the presentation, the need for the increase is to promote water use conversation
and maintain the overall integrity of the water system. The Mayor and Council instructed staff to
proceed with the rate increase process. On July 5, 2005, the Notice of Intention was presented to
the Mayor and Council and approved. Publications were made July 8, July 11, July 12 and July
13,2005 setting a public hearing on the proposed water rate increases for September 6,2005. A
Notice of Public Hearing on proposed increase in Town of Marana water system rates was sent
on July 21,2005 and August 1,2005 to all Town of Marana municipal water system customers.

RECOMMENDATION
The Water Utility Advisory Committee and staff recommend approving and authorizing the
adoption of the new water rates.

MARANA ORDINANCE NO. 2005.17
RELATING TO WATER; AMENDING SECTION 14-7-1 OF THE TOWN CODE BY
REVISING THE WATER RATES AND ADOPTING CODE LANGUAGE ESTABLISHING
TIERED WATER RATES BASED ON CONSUMPTION AND USE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the revision of the water rates and adoption of Town Code language estab-
lishing tiered water rates based on consumption and use is in the best interests of the Town of
Marana.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
TOWN OF MARANA, AS FOLLOWS:
SECTION 1. The Town Code of the Town of Marana is hereby amended by revising
Section 14-7-1 as follows (with additions shown by double underlinim! and deletions shown by
strikethrough):
Section 14-7-1 Monthly charges
A. Charges for water utility service shall be made at monthly intervals and shall, to
the extent consistent with the express policy to charge for water in direct proportion to
the cost of securing, developing and delivering water to the customers of the Town wa-
ter system, recover all capital, operational and maintenance costs associated with or at-
tributable to providing water service through the Town water system. Water charges will
be computed through the summation of a monthly .base water service fee plus a monthly
water use charge, plus any applicable state or local sales taxes.
B. The monthly base water service fee (including the first 1,000 gallons of '....ater)
shall be based upon the meter size, and shall be as follows:

gallons above the minimum service fee.~

D. VVhen a customer has a meter larger than 5/8" x 3/4" that is required for fire pro
tection, sprinkler, or other fire related reacons in a residential home, the minimum
charge will be assessed as though the meter were only 5/8" x 3/4", so long as the cus
tomer'c water ucage does not exceed 15,000 gallonc in any billing period. If the house
hold usage exoeeds 15,000 gallons in any billing period, tho cuctomer shall be oharged
the minimum charge associated with the actual meter size, ac cet out in subsection B of
this Section.
SECTION 2. The Town's Manager and staff are hereby directed and authorized to under-
take all other and further tasks required or beneficial to carry out the terms, obligations, and ob-
jectives of this ordinance.
SECTION 3. The provisions of this ordinance shall apply to water bills mailed on and af-
ter January 1, 2006.
