Berlin, AICP, Planning Director Frank Cassidy, Town Attorney SUBJECT: Resolution No. 2005-98: Relating to Development; approving a final plat for Parcels 56, 57 & 72 Continental Ranch. DISCUSSION The proposal requests approval a final plat for Parcels 56, 57 & 72 Continental Ranch, a 10-lot commercial subdivision on approximately 15.8 acres, generally located at the east comer of Cortaro Road and Silverbell Road, within a portion of Sections 34 & 35, Township 12 South, and Range 12 East. The land use designation as specified by the Continental Ranch Specific Plan is Commercial ("C"). The commercial designation allows for a range of commercial uses including retail commercial, commercial recreation, offices, restaurants, and financial institutions. The proposed uses to date within this plat are Fletcher Automotive and Auto Zone. This project will be served by two access ways from Silverbell Road and one from Cortaro Road. Leilani Lane will be the extension of the existing drive for the Walgreens. Additionally, the existing Walgreens and M & I Bank share an access off of Cortaro Road. This development has two other internal drives, Mamie Kai Drive and Schisler Drive that connect all of the individual on-site developments as well as M & I and Walgreens that are along Leilani Lane. This project will also provide connections to the future library as well as the regional park. The Town has not yet received a dedication ofthe triangle ofland within Leilani Lane at the east comer of the Walgreens lot and annotated "R.O.W. TO BE DEDICATED BY SEPARATE INSTRUMENT." The developer has represented that it holds a non-exclusive easement for utilities and access over land that includes this triangle, and has committed to prepare and submit to the Town Attorney an assignment of its rights in the triangle prior to the Council's consideration of this item. The Town Attorney will request that this item be continued to a later meeting if a legally sufficient assignment has not been delivered to the Town when this item comes up for consideration. In connection with this plat approval, the adoption of Resolution No. 2005-97 will also abandon a 50-foot strip ofland held by the Town partially in fee ownership and partially as an easement. The 50-foot strip was created in connection with the library exchange approved in December 2003 by Ordinance No. 2003.32. The 50-foot strip was intended to serve a parcel of land then owned by the Town but that was later exchanged to the developer in October 2004 by Ordinance No. 2004.20. Unfortunately, the 50-foot strip was not addressed at the time and was "orphaned" amid developer-owned parcels. Adoption of Resolution No. 2005-97 will also extinguish a 35-foot drainage, access, utility and clear zone easement along Cortaro Road that the Town no longer needs. RECOMMENDA nON Staff has reviewed the application for compliance with the Continental Ranch Specific Plan, Marana Land Development Code and the Marana General Plan. This final plat is in conformance with all required development regulations and conditions of zoning. Staff recommends approval of a final plat for Parcels 56 57 & 72 Continental Ranch. SUGGESTED MOTION I move to approve Resolution No. 2005-98. {00001012.DOC I} 080205 PRV-04053 Continental Ranch 56, 57, & 72 FP TC.doc - 2 - 7/26/20053:47 PM LS FJC MARANA RESOLUTION NO. 2005-98 RELATING TO DEVELOPMENT; APPROVING A FINAL PLAT FOR PARCELS 56, 57 & 72 CONTINENTAL RANCH WHEREAS, the Town of Marana approved and adopted the specific plan for the area known as Continental Ranch on April 5, 1988 (Ordinance No. 88.09), located within the corporate boundaries ofthe Town of Marana, Arizona; and WHEREAS, the developer, Continental Ranch Development LLC, has applied for approval of a final plat for Parcels 56, 57 & 72 Continental Ranch, Lots 1 through 10; and WHEREAS, the final plat for Parcels 56, 57 & 72 Continental Ranch will consist of a 10- lot commercial subdivision on approximately 15.8 acres located at the east comer of Cortaro Road and Silverbell Road, within a portion of Sections 34 and 35, Township 12 South, and Range 12 East; and WHEREAS, the final plat for Parcels 56, 57 & 72 Continental Ranch requires abandonment of certain Town rights-of-way and easements depicted on the plat, and the Town Council expressly finds that abandonment of these rights-of-way and easements is in the best interests of the public and the Town; and WHEREAS, the Town Council, at their regular meeting on August 2, 2005 has determined that the final plat for Parcels 56, 57 & 72 Continental Ranch should be approved. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, that the final plat for Parcels 56, 57, & 72 Continental Ranch, Lots 1-10, situated on approximately 15.8 acres located at the east comer of Cortaro Road and Silverbell Road, within a portion of Sections 34 and 35, Township 12 South, and Range 12 East is hereby approved. IT IS FURTHER RESOLVED that approval of the final plat for Parcels 56, 57 & 72 Continental Ranch carries out the transfer to the developer and abandonment of a certain 50-foot wide strip of land that had been retained by the Town (partially by fee title and partially by easement) for access and right-of-way purposes in connection with and pursuant to the Real Estate Exchange and Development Agreement recorded in the Pima County Recorder's office at Docket 12201, Page 4073 (see Marana Ordinance No. 2003.32) and the Deed of Easement recorded in the Pima County Recorder's office at Docket 12201, Page 4121, in exchange for the public rights-of-way granted by the final plat for Parcels 56, 57 & 72 Continental Ranch, under the authority of A.R.S. S 28-7203, as indicated by the notes on the plat. IT IS FURTHER RESOLVED that approval of the final plat for Parcels 56, 57 & 72 Continental Ranch carries out the extinguishment pursuant to A.R.S. S 9-402(E) of that certain {OOOO I 020. DOC /} Marana Resolution No. 2005-98 - 1 - 7/27/2005 12:47 PM LS FJC 35-foot drainage, access, utility and clear zone easement created by the instrument recorded in the Pima County Recorder's office at Docket 8097, Page 1950, which is no longer needed by the Town, as indicated by the notes on the final plat for Parcels 56, 57 & 72 Continental Ranch. IT IS FURTHER RESOLVED that the Town Manager is hereby authorized to execute on behalf of the Town any quit-claim deed or other documentation needed or beneficial to evidence the Town's transfer or abandonment of property rights by this Resolution.
