SUBJECT: Resolution No. 2005-90: Relating to Development; approving a
preliminary plat for Continental Ranch Retail Center -Westside.
DISCUSSION
This project was presented to the Planning Commission on June 29, 2005. The Planning
Commission recommends unanimous approval to the Council (Commissioner Hestwood absent).
The proposed plat is a resubdivision of Blocks 2, 3 and 4 of the Continental Ranch Retail Center
Subdivision approved by the Town Council on October 1,2002.
This is a 1O-lot commercial subdivision. The Continental Ranch Retail Center Westside
subdivision is generally located at the southwest comer of Arizona Pavilions Drive and Cortaro
Road. The site is bordered by the Santa Cruz River to the south, Cortaro Road to the west,
Arizona Pavilions to the north and the existing Pepper Tree Business Park to the east.
The land use designation as specified by the Continental Ranch Specific Plan is Freeway
Commercial ("C*"). The Freeway Commercial designation allows for a range of commercial
uses including retail commercial, commercial recreation, offices, rcstaurants, and financial
institutions. The proposed uses to datc within this center are In-N-Out Burger, Panda Express,
Chili's rcstaurant and retail shop space.
This project will be served by three acccss routes from Arizona Pavilions Drive and two from
Cortaro Road. This development will also have internal drives connecting all of the individual
on-site developments. Staff has required raised medians along Cortaro Road and Arizona
Pavilions Drive, along with a continuous right-turn lane on eastbound Cortaro Road as part of the
access management for this development. Due to the future commercial growth potential in this
area the master developer is being required to fund, by way of a financial contribution, future
traffic signal phasing/timing studies as well as all of the design and construction of
improvements when warranted. Recommended conditions 1 and 2 addrcss this rcquirement in
more detail.

RECOMMENDATION
Staff has reviewed the application for compliance with the Continental Ranch Specific Plan,
Marana Land Development Code and the Marana General Plan. This Preliminary Plat is in
conformance with all required development regulations and conditions of zoning. Staff

recommends approval of a Preliminary Plat for Continental Ranch Retail Center-Westside with
the following conditions:
RECOMMENDED CONDITIONS OF APPROVAL
1. All ofthe off-site improvements shown on engineering plan ENG0506-01O and approved by
the Town Engineer, shall be the responsibility of the master developer and shall be in place
prior to the issuance of any certificates of occupancy (temporary or permanent) for the
Westside Center development.
2. The master developer shall contribute $40,000 for two future traffic signal phasing/timing
studies at signalized intersections along the Cortaro Road corridor (Silverbel1lCortaro,
Cortaro/Arizona Pavilions, Cortaro/I-lO Ramps). Said monies will also be used to fund any
signal timings/phasing, geometric, striping or signing modifications required as a result of the
studies. The $40,000 must be submitted to the Town of Marana prior to the issuance of any
certificates of occupancy (temporary or permanent) for the Westside Center development.

MARANA RESOLUTION NO. 2005-90
RELATING TO DEVELOPMENT; APPROVING A PRELIMINARY PLAT FOR
CONTINENTAL RANCH RETAIL CENTER-WESTSIDE.
WHEREAS, The Continental Ranch Retail Center Subdivision was approved by the
Town Council on October I, 2002 and recorded at Book 56 Page 49; and
WHEREAS, The developer, Continental Ranch Retail Center LLC, has applied for a
resubdivision of Blocks 2, 3 and 4 ofthe Continental Ranch Retail Center Subdivision Plat; and
WHEREAS, The Continental Ranch Retail Center-Westside preliminary plat will consist
of a 10-lot commercial subdivision on approximately 30.85 acres located at the southwest comer
of Arizona Pavilions Drive and Cortaro Road, within a portion of Sections 26 and 35, Township
12South, and Range 12East; and
WHEREAS, the Town Council, at their regular meeting on July 19, 2005 has determined
that the Continental Ranch Retail Center-Westside Preliminary Plat should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that Continental Ranch Retail Ccnter-Westside, a resubdivision of Blocks 2,3
and 4 of the Continental Ranch Retail Center Subdivision, consisting of Lots I-lOon
approximately 30.85 acres located at the southwest comer of Arizona Pavilions Drive and
Cortaro Road, within a portion of Sections 26 and 35, Township 12South, and Range 12East is
hereby approved with the following conditions:

SUMMARY OF ArPLICA nON
This proposal requests approval of a preliminary plat for a 10-lot commercial subdivision. This plat is a
resubdivision of Blocks 2, 3 and 4 of the Continental Ranch Retail Center Subdivision approved by the
Town Council on October I, 2002 and recorded at Book 56 Page 49. The Continental Ranch RetaIl
Center Westside subdivision is generally locatcd at the southwest comer of Arizona Pavilions Drive and
Cortaro Road. The site is bordered by the Santa Cruz River to the south, Cortaro Road to the west,
Arizona Pavilions to the north and the existing Pepper Tree Business Park to the east.
The land use designation as specified by the Continental Ranch Specific Plan is Freeway Commercial
("C*"). The Freeway Commercial dcsignation allows for a multitude of commercial uses including retail
commercial, commercial recreation, offices, restaurants, and financial institutions. The Planning
Commission approved the In-N-Out development on Lot I of this site at the May 25th mccting. Staff is
currently reviewing a development plan for a Panda Express proposed on Lot 3.
This project will be served by three access ways from Arizona Pavilions Drive and two from Cortaro
Road. Staff has reqUIred raised medians along Cortaro Road and Arizona Pavilions Drive, along with a
continuous right-turn lane on eastbound Cortaro Road as a part of the access management for this
development. Due to the future commercial growth potential in this area the master developer is being
required to fund future traffic SIgnal phasing/timing studies as well as all of the design and construction
of all improvements warranted by the study. Recommended condition 2 and 3 address this requirement
in more detail. This development will also havc internal drives connecting all of the indiVIdual on-site
developments.
The proposed preliminary plat was review by staff for compliance with all applicable standards and
guidelines within the Continental Ranch Specific Plan and the Town of Marana Land Development
Code. All applicable development standards have been adhered to within this Preliminary Plat.
Therefore, staff recommends approval based on the recommended findings of fact.
RECOMMENDED FINDINGS OF FACT
1. The site is currently designated Freeway Commercial (C*), per the Continental Ranch Specific
Plan. The proposed subdivision is allowable under this designation. The project is in
compliance with all other development standards of the specific plan related to this classification.
2. This proposal is consistent with the purposc and intent of the Continental Ranch Specific Plan
and the Town of Marana General Plan.
3. The subject site is a part of the growing commcrcial area. This proposal does not appear to be
detrimental to the immcdiate area and to the general health, safety, and welfare of the inhabitants
of the area and the Town of Mar ana.

APPROVAL with conditions.
1. All of the off-site improvements shown on engineering plan ENGOS06-01O and approved by the
Town Engineer, shall be the responsibility of the master developer and shall he in place prior to
the issuance of any certificates of occupancy (temporary or pennanent) for the Westside Center
development.
2. The master developer shall be responsible for funding future traffic signal phasing/timing studies
that include all signalized intersections along the Cortaro Road corridor (Silverbell/Cortaro,
,"_ Cortaro/Arizona Pavilions, Cortaro/I-IO Ramps) as required. (A maximum of two studies will be
required; the studies will be scheduled and administered by the Town. The last study will be
performed no later than six months following build-out of the development.) The master
developer shall be responsible for funding any traffic signal, roadway, signing or striping
modifications that are required based on the results of the studies.
3. The master developer shall be responsible for funding the design and construction of traffic
signals at the intersections of Arizona Pavilions and the Wal-MartlWestside Center driveways,
and the Cortaro Road - Courtney Page Way/Westside Center driveway when required per the
warrants found in the Manual on Uniform Traffic Control Devices (most recent edition). (Town
staff will perform the signal warrant studies as required.) If a traffic signal is found to be
warranted at the Cortaro Road - Courtney Page Way/Westside Center driveway intersection but
the Town deems that the proximity of that intersection to the Arizona Pavilions intersection
precludes the installation of a signal, the master developer shall be responsible for any
improvements that may be required to improve the traffic safety at the subject intersection. Such
improvements may include, but not be limited to, geometric modifications such as the
construction of directional median openings on Cortaro to prohibit left-turns out of the Courtney
Page Way/Westside Center driveway approaches, etc.

CASE ANALYSIS
REVIEW CRITERIA:
1. Ability to complv with Development Regulations, i.e., Water. Sanitation, Access. Developable
Parcel. etc.: The property is currently designated Freeway Commercial (C*). Adequate area exists for
development on this site. The subdivision is in compliance with the requirements of all agencies.
2. Ability to complv with requirements of the Zoning Regulations, i.e.. Lot Size. Frontage, Setbacks,
etc.:
This proposal complies with all the requirements of the Freeway Commercial land use designation.
3. Is it consistent with the purpose of the Zoning Regulations and with the intent of the General Plan:
This proposal is consistent with the purpose and intent of the Continental Ranch Specific Plan, and
the Town of Marana General Plan.
4. Compatibility. with the surrounding area; not detrimental to the immediate area or the
development of the area and is not detrimental to the general health, safety, or welfare of the aJJ;a:
The subject site is surrounded by commercial uses and the Santa Cruz River. The proposal does not
appear to be detrimental to the immediate area or to the health, safety, and welfare of the area.
Suggested Motion:
I move to approve Case No. PRV-04003, the Preliminary Plat for the Continental Ranch Retail Center
Westside Subdivision subject to the conditions outlined in this staff report.
