SUBJECT: Ordinance No. 2005.16: Relating to Development; adopting plan
review fees.
DISCUSSION
The purpose of creating the Development Services Fee Schedule is to update the 1995
development plan review fee ordinance as it relates to the Planning Department, the Subdivision
Engineering Division of Public Works and the Building Services Department. In addition, this
proposal creates a comprehensive fee schedule for all development services plan review items of
the Town. The key issues related to this update are as follows:
1. Recover a reasonable amount of the cost of service for the various Development Services
departments involved in review services;
2. Charge similar Town plan review fees after comparison with local jurisdictions with
similar services delivered in the metropolitan area;
3. Address general increases in service costs over the last ten years since the current Town
fee schedule has been effective;
4. Add a provision to cover incremental fee increases annually for the future;
5. Add plan review fees for services lacking fees for which the Town incurs a cost.
6. Adjust Building Permit Fee Table up to equal the 1997 Uniform Administrative Code,
Table 3-A, adopted four years ago, implemented incorrectly,
7. Add a Solar Energy Utilization credit to the Building fees for residential construction,
8. Combine four development related plan review fees, namely, Planning, Grading, Signs,
and Building review, into one comprehensive Development Services Fee Schedule.
The fees related to the Building Department and Planning Department's sign review are not
under review for a comprehensive revision at this time.
Staff analyzed the fee schedules of the Town of Oro Valley and Pima County because both
have development services agencies with similar plan review functions as the Town and both
have updated their plan review fee schedules recently in 2004.
Staff analyzed a sample group of old development review cases comparing the 1995 fees with
the proposed 2005 fees. The proposed fees will not be the highest fees in the region but will be
comparable to the plan review fees of adjoining jurisdictions.
During the past several years, the Town staff has been seriously stretched in its ability to give
timely development reviews. Increased development fee resources are expected to give the
Town more flexibility in adjusting its staff resources to development activity and improving
customer services.
The proposed fee schedule includes a process that provides for an annual increase based on a
staff report that reviews resources, the Consumer price index, and national valuation tables.
This process will assure that the fee schedule will not fall out of date and will respond to specific
fee increases or overall fee increases based on the report. The concept is to adjust resource needs
for improved customer service and any national pricing trends.
In FY 2004 the Town collected $954,000 in development fees. Through April 27, 2005 of FY
2005 the Town has collected $1,320,000. An average of the two years is $1,137,000. Staff
estimates the new fee schedule could generate an overall increase of between 20-30% thereby
improving customer service.
ATTACHMENTS
Exhibit A shows the Proposed 2005 Development Services Fee Schedule (Draft Ordinance).
Exhibit B (Development Review Fee Schedule Analysis) is a comparison between the current
review fees used by Pima County and Oro Valley for comparable development review services.
This matrix shows how the new Town fees were developed.
Exhibit C lists all the additional fees added to the proposed fee schedule for which the Town
provides a service but has no current fee.
Exhibit D lists development cases comparing the 1995 fee and the proposed 2005 fee.
Exhibit E shows the Current 1995 fee schedules.
RECOMMENDATION
Staff recommends adoption ofthe Development Services Fee Schedule 2005. It reflects fees that
are current and up to date within the region and is organized into a more user friendly format.
The proposed fees are not the most expensive fees in the region but are similar to those being
used in adjoining jurisdictions that have updated their fee schedules in 2004 and offer similar
development related services.

RELATING TO DEVELOPMENT; ADOPTING PLAN REVIEW FEES.
WHEREAS, the Town of Marana desires to establish an updated comprehensive
fee schedule to address and include plan review fees for planning, building, grading, and
sign plan reviews.
WHEREAS, Exhibit A presents the proposed Development Services Fee
Schedule;
WHEREAS, Exhibit B presents a comparison between the current Town review
fees and regional jurisdictions review fees with recommendations;
WHEREAS, Exhibit C presents a list of additional fees added to the proposed fee
schedule where services are provided but no fee exists;
WHEREAS, Exhibit D presents a list of development review cases such as
rezonings and subdivision plats comparing the current and proposed fees; and
WHERERAS, Exhibit E presents the current 1995 development review fee
schedule, the building services review fees from Chapter 7 of the Town Code, the sign
review fees from Title 16 of the Land Development Code, and the grading development
review fees.
NOW THEREFORE BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona as follows:
Section I. The amended and newly established Development Services Fee
Schedule attached and referenced as Exhibit A is hereby adopted.
Section 2. The adoption of this ordinance shall have the effect of repealing that
portion of all previous ordinances, resolutions, or motions that is different from the above
standards.
Section 3. In the event that any provision, or any portion of any provision, of this
ordnance or application thereof, is held invalid, illegal or unenforceable, such invalidity,
illegality or unenforceability shall have no effect on the remaining portion of any
provision or any other provision or their application, which can be given effect without
the invalid provision or application and to this end the provision of this ordinance shall be
deemed to be severable.
Section 4. This ordinance shall become effective thirty days after adoption by the
Town Council.

11 The calculation of Building Services Department permit fees utilizes the followi,ng tables: 5B-I Residential
12 Building Valuation Tables or 5B-2 Commercial Building Valuation Tables and 5B-3 Permit Fee Table.
13 The calculation ofa permit fee is a multiple step process: I) the valuationpfa proposed structure is
14 determined, 2) that valuation is entered in the permit fee table and aC?flStructiOllfee,petermined and 3)
15 applicable plan review, plumbing, mechanical and electrical fees are calculated fromthe construction fee
16 and all fees summed for the total building permit fee.

18 For each structure a separate valuation is obtained by determining the square foot area of each6ccupancy
19 and type of construction encompassed by a structure, taken frpm Table$B~ I or 5B-2. That area is
20 multiplied by the appropriate cost per square foot from either Table ~B-I or 5B-2 and the sum is the total
21 valuation for a structure.

23 The construction fee is calculated using Table 5B~3. 1'Qe row whose range includes the total valuation
24 calculated above is selected. The construction fee is the sum of the base fee plus an additional fee which is
25 multiplied by each additional $100.00 or $1000.00 (see the table), or fraction thereof, in total valuation.

27 The total calculated permit fee is the sum of the cOl1struction, plan review, plumbing, mechanical and
28 electrical fees. The plan review fee is calculated at 6~% of the construction fee determined above. The

EXHIBIT C
Based on staffs analysis the following fees have been added to the proposed fee
schedule:
Planninl! Fees:
. Minor Amendment for a General Plan Amendment. The adopted General Plan
provides for a minor amendment process, the Town currently does not have an
adopted fee to be charged.
. Rezoning Time Extension. With the current practice of placing sunset dates on
rezoning, there may be times when a project needs additional time and is still
consistent with the objectives ofthe Town.
. Modification or Waiver of Rezoning Conditions. A rezoning Condition may need
to be modified or waived to address a change in the actual events taking place.
. Land Development Code Amendments. There may be times when a request to
amend the land Development Code is presented to the Town.
. Fees based on acreage for Preliminarv and Final Block Plats. Block Plats should
be charged based on acreage and not number oflots.
. Minor Land Division. The will codify a fee the fee currently being accessed with
the approval of the last amendments to the subdivision ordinance.
. ResidentiallNeighborhood Design Plan. The ToWn is currently working on
amending the Land Development code and is proposing to add the Neighborhood
Design Plan process.
. Administrative Review Process. Staff can spend a lot of time researching and
analyzing individual administration requests, and it is appropriate to establish a
fee for this service.
. Zoning Verification letter. Staff can spend a lot of time researching and analyzing
individual zoning verification request, and it is appropriate to establish a fee for
this service.
Grading Review Fees:
. AT-RISK Grading Fee. The dollar amount justifies the amount of time necessary
for staff, administrative support and observation required for the AT-RISK
permit.
. Partial Release of Assurances. The fee supports the recording fees paid to Pima
County, Staff inspection time and administrative support time necessary for a
partial release of assurance.
. Right-of- W av Access Permit Fees. This fee supports staff review and inspection
time and coordination with additional departments.
. Traffic Control Plan Check Fee. This fee supports staff review time and time
spent coordinating with additional departments.
. Haul Route Permit Fee. This fee supports staff review and inspection time and
coordination with additional departments.
. Extension Fee. This fee supports staff review and inspection time and
coordination with additional departments.
Building Fees:
· Deck. Add a fee to reflect the additional work by staff to review and inspect
decks.
· Ramada Reduce the fee to reflect work required to plan review and inspect a
ramada.
· Storage Buildings Add a fee for storage buildings equal to or over 400 sq. ft.
· Above ground swimming pool Reduce the fee to reflect work required to plan
review and inspect above ground swimming pools.
· Metal Patio Cover Add a fee for metal patio covers to reflect the difference in the
work required by the inspection staff to inspect the installation.

being paid by the applicant prior to the issuance of said permit or approval of said

16.11 FEES
16.11.01 Initial Fees
A. In addition to other applicable fees, which may be required by the Town for the
erection of a free-standing sign, the initial sign fee shall be as follows:
1. One dollar ($1.00) per square foot of signboard on which a display appears,
plus
2. Two dollar ($2.00) for each foot of height of the sign in excess of twelve (12)
feet, as measured to the top of the sign, plus
3. An additional fifteen dollars ($15.00) per sign if the sign ;s to be lighted.
B. In addition to other fees applicable fees which may be required by the Town, the
following fees (per sign or as indicated) shall apply:
1. Permanent sign:
(i) Base fee per permit $10.00
(ii) Fee for a sign less than or equal to ten (10) feet in height $35.00
(iii) Fee for a sign over ten (10) feet in height $50.00
2. Temporary sign:
(i) Base fee per permit $10.00
(ii) Fee for each sign $10.00
3. Renewal fee:
(i) Temporary sign (every six months for each sign) $5.00
(ii) Billboard (non-conforming) $500.00
4. Blanket fee per six month period for directional signs:
(i) Base fee per permit $10.00
(ii) Fee for a maximum of 3 signs per permit $100.00
5. Recovery fee: (for each occurrence)
(i) For the first sign $25.00
(Ii) Plus $10.00 for each additional sign
6. Per-diem storage fee:
(i) Fee for a sign less than or equal to ten (10) feet in height $5.00
(Ii) Fee for a sign over ten (10) feet in height $7.50
7. Temporary special event sign. permit: $20.00
