MARANA RESOLUTION NO. 2000-15
A KESOLUTJON OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, VACATING THE EAST 45.00 FEET OF THE SANDARIO ROAD RIGHT-OF-WAY.
WHEREAS, an application for abandonment of the east 45 feet of the Sandaho Road right-
of-way, recorded in a deed to Pima County in Docket 4333 at Page 768, has been submitted to the
Town by Mr. and Mrs. Jack Horton and Mr. and Mrs. Michael Pierce; and
WHEREAS, the Mayor and Council have the authority, pursuant to A.R.S. § 28-7202, to
dispose of a portion of a public roadway that is no longer necessary for public use; and
WHEREAS, the Mayor and Council have determined that the east 45 feet of the Sandario
Road right-of-way, as recorded in Docket 4333, Page 768, is no longer necessary for public use; and
WHEREAS, the Mayor and Council have determined that the beSt disposition for the east
45 feet of the Sandario Road right-of-way is to vacate it, pursuant to A.R.S. § 28-7205, in favor of
the abutting landowners; and
WHEREAS, pursuant to A.R.S. § 28-7208, the Mayor and Council have given due
consideration to the nature and situation of the roadway portion to be vacated and find that the Town
is receiving good and sufficient consideration from the abutting landowners to whom the vacated
portion will accrue.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that the Town of Marana abandon the east 45 feet of the Sandario Road right-of-
way as deeded to Pima County and recorded in Docket 4333 at Page 768, as more fully depicted in
the map attached hereto as Exhibit I and legally described in Exhibit A incorporated herein by this
reference, subject to the following conditions:

Reservation of a public easement for roadway purposes.
Reservation of the following, in accordance with A.R.S. § 28-7210:
a) existing sewer, gas, water or similar pipelines and appurtenances;
b) canals, laterals or ditches, and appurtenances; and
c) electric, telephone and similar lines and appurtenances.
Pursuant to A.R.S. § 28-7215, no adjoining land is left without an established public road
connecting the adjoining land with another established public roadway.

Re: Request for Abandonment of Right-of-Way
Dear Sirs:
The Right-of-Way being requested to be Abandoned was erroneously
conveyed to Pima County, Arizona, by the applicants, Jack and Judith
Horton, at no cost to Pima County, Arizona, on January 22, 1972_, and
is not needed by the Town of Marana as a Right-of-Way.
Pima County, Arizona, failed to register the conveyance with the Pima
County Assessor's Office and the applicants have been paying property
tax on said land for 27 years.
