CALLED TO ORDER At 7:04 P.M., by Mayor Ora Ham II. PLEDGE OF ALLEGIANCE Mayor Ora Harn, led the Pledge of Allegiance. III. INVOCATION Rev. Purdy, delivered the invocation. IV. ROLL CALL Ora M. APPROVAL OF AGENDA A motion was made by Elwin Clifton and seconded by Bill Schisler, carried unanimously, to accept the agenda as submitted. VI. APPROVAL OF MINUTES A motion was made by Bill Schisler and seconded by Elwin Clifton to approve the minutes of the Regular Meeting of August 6, 1991 with one correction: page four, paragraph four, last word should be "expense". The motion carried unanimously, with Jo Rex not voting. 1 MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL~ AUGUST 20~ 1991. A motion was made by Bill Schisler and seconded by Elwin Clifton to approve the minutes of the Special Council Meeting of August 5, 1991. The motion carried unanimously with Jo Rex not voting. VII. PETITIONS AND COMMENTS 1. David Morales, 13420 W. Price Lane. A. Spoke on the Roberts Rules of Order and presented the Mayor with a book on the Roberts Rules of Order 1990 edition. B. Mr. Morales asked the Council to review the minutes of May 30, 1989 regarding the $1.00 payment to Council Members. C. The Council does not listen to the citizens of Marana, the council should respond to the citizens request and/or problems in writing, do not ignore them. D. Mr. Morales wants a written reply on the resolutions to buy within the Town preference to the Town Citizens and also to give a copy of all approved Town paperwork such as Ordinances, Resolu- tions. and Minutes to the Library. E. Mr. Morales asked the council what they are going to do about the Cable Ordinance, enforce it or tear it up. 2. David Ritterer, 7414 W. Palm Brook Place. Spoke on the article in the Arizona Daily Star in reference to the expansion of the Tangerine Land Fill. I am not in favor of it and would appreciate someone looking into it and maybe we could force some safety issues and to stop a bad situation from getting worse. 3. Sandra Ritterer, 7414 W. Palm Brook Pi. Also agrees with David Ritterer, and added that it appears that the pond is leaking into the ground. 4. Charlyne Abbett, 7505 W. Mountain Sky Dr. Mrs. Abbett, also referred to the article in the Arizona Daily Star and is opposed to the expansion of the liquid waste pond at the Tangerine Land Fill, also where is this new proposed regional sight why is it a secret? 5. Charlie Villescaz, 13704 N. Reyer Ave. Stated he is in favor of Waste Management. On another issue has concerns regarding a trailer that was moved in on corner of Sandario and Denny St. he the 6. Nelson Sabbe, 12311 W. Moore Rd. A. Would like to see a cemetery in the Town of Marana B. Would like the Council to contact the Marana School Board and find out why there wasn't a hearing or a better way of han- dling the Coach Acker situation. C. ANNOUNCEMENTS David Morales invited everyone to the St. Christopher's Fest the 4th and 5th of October. October Russell Dove, informed the council that the Avra Valley Fire Alarm now will have a monthly calendar in it for the publics use. IX. PRESENTATION - TOWN COUNCIL SERVICE PLAQUE TO MR. BOB MCCREA Mayor Ora Harn presented a plaque to Mr. Bob McCrea service to the community as a member of the Town Council, past Vice Mayor. Mr. McCrea, thanked the Council. X. PUBLIC HEARING for his and as A. Ordinance 91.19 Amendments and Additions to the Grading Code and Floodplain Management Code - Requiring Approval of Erosion Control Measures Before Removal of Native Vegetation. A motion was made by Elwin Clifton, seconded by Bill Schisler, and carried unanimously, that we go into Public Hearing 91.19 Amendments and Additions to Grading Code and Floodplain Manage- ment Code - Requiring Approval of Erosion Control Measures Before Removal of Native Vegetation.(Time 7:35 P.M.) 1. Russell Dove, 13915 N. Sandario Rd. Addressed the Town Council speaking in favor of Ordinance and asked the council to vote in favor of the Ordinance. 91.19 2. Katherine Magner, Property Manager for Westinghouse Communi- ties. Asked if the Ordinance would be limited to the flood plain as it did not state that in the ordinance, also asked if it would affect the developers with current Specific Plans and how does this affect the developers clearing the right of ways. 3. Nelson Sabbe, 12702 N. Sanders Rd. Asked the council to vote in favor of the ordinance. A motion was made by Bill Schisler, seconded by Jo Rex, carried unanimously to come out of the Public Hearing. and Out of Public Hearing at 7:42 P.M. XI. MARANA VOLUNTEER FIRE DEPARTMENTf INC. Appointment of Ms. Sharon Price to the Marana Citizens Budget Committee. A motion was made by Doug Mostyn, seconded by Elwin Clifton, and carried unanimously, to appoint Ms. Sharon Price to the Marana Citizens Budget Committee. 4 MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL~ AUGUST 20~ 1991 B. Special Events Liquor License - Boys and Girls Club of Tucson Vance Falbaum, 5051 N. Sabino Canyon Rd. Tucson, AZ Mr. Falbaum,the President Elect of The Boys and Girls Club of Tucson, introduced Mr. Neubauer. Dr. Bill Neubauer 5190 E. Farness, Tucson, AZ Mr. Neubauer addressed the council giving a brief explanation of what the Boys and Girls Club is all about. Mr. Falbaum explained how the liquor would be handled and an- swered questions from the Council Members. A motion was made Elwin Clifton to deny the request for the Special Events Liquor License in the name of the Boys and Girls Club, seconded by Ora Harn. ROLL CALL VOTE: Elwin Clifton, Helen Key and Ora Ham voting aye, and Eddie Honea, Doug Mostyn, Jo Rex, and Bill schisler voting nay. Motion failed. A motion was made by Eddie Honea, seconded by Doug Mostyn approve the application for the Special Liquor License for the Boys and Girls Club. ROLL CALL VOTE: Elwin Clifton and Ora Harn voting nay, and Eddie Honea, Helen Key, Doug Mostyn, Jo Rex and Bill Schisler voting aye. Motion carried. to C. Marana Unified School District Request to Use Marana Pool from August 20, 1991 through September 27, 1991. Dick Yetwin attorney for the Marana Public Schools 2525 E. Broad- way, Tucson. Mr. Yetwin addressed the council concerning the school request and the quit claim deed. A motion was made by Doug Mostyn, seconded by Bill Schisler to allow Mr. Jim Rex to address the Council regarding the request. Carried unanimously. Jo Rex did not vote. Jim Rex, 11126 W. Grier Rd. Mr. Rex gave a little history on the issue and how it had been handled by the County, he also suggested that better communica- tion between the School and the Town was necessary and the School would provide whatever notification the Town requires in the future. A motion was made by Eddie Honea, seconded by Helen Key that we approve the request for the use of the pool from August 11, 1991 through September 27, 1991 at no cost to the school district. A motion was made by Elwin Clifton, to amend the motion to read that the school would absorb one half of the expense and the Town the other half. no second The original motion carried with Elwin Clifton voting nay. MINUTES OF REGULAR COUNCIL MEETING~ MARANA TOWN COUNCIL~ AUGUST 20~ 1991 D. Residency Requirement for Marana Standinq Committees and Commissions. A motion was made by Elwin Clifton, seconded by Doug Mostyn, that we adopt the Residency Requirements for Marana Standing Committees and commissions. ROLL CALL VOTE: Helen Key, Jo Rex, Bill Schisler and Ora Harn voting nay and Elwin Clifton, Eddie Honea and Doug Mostyn voting aye. Motion failed. Recess at 8:45 Back in session at 8:57 E. Town Council Discussion of the Fiscal Year 1991-92 5% Salary/Wage Adjustment. A motion was made by Bill Schisler, seconded by Doug Mostyn and carried unanimously to stay with the 5% adjustment on the base salary. A motion was made by Bill Schisler, seconded by Eddie Honea, that the salary adjustment be retroactive back to July 1, 1991. The amendment to the motion carried unanimously. The amended motion carried unanimously. F. Arizona League of cities and Towns Municipal Policy Statement Amendments on Additions Council asked Mr. Laos to ask the staff if they have any input at the next staff meeting. G. Ordinance 91.19 - Native Vegetative Removal Erosion Control Measures, Amendments to the Grading and Floodplain Management Codes. A motion was made by Bill Schisler, seconded by Jo Rex and car- ried unanimously to accept Ordinance 91.19 - Native Vegetative Removal Erosion Control Measures, Amendments to the Grading and Floodplain Management Codes. H. Mayor's Report Mayor Harn informed the citizens and Council that Waste Manage- ment is willing to look at other sights and a citizens committee of 5 people has been selected and these people must be open minded and that the community's interest come first, also they must not be financially involved. Mayor Harn stated that we are still pursuing the Bank Protection Issue and suggests we have a memorial service on October 5 for those who lost property and their lives and that we must bring this to the attention of the public. We are not going to wait for the UP-RI~-ER improvements, so the water can be sent to Marana more quickly to cause further destruction and loss of lives. 6 MINUTES OF REGULAR COUNCIL MEETINGt MARANA TOWN COUNCIL~ AUGUST 20, 1991 I. Manager's Report As of the 15th of August all the Police Department vehicles and two Street and Roads vehicles are now pumping gas at the Pima County yards for 82 cents opposed to $1.09 per gallon for about a $7,000.00 savings for the year. There are two pumping stations locations, one is on Ina Rd. and the other is on Sanders Rd., both in the Town limits. XIV. EXECUTIVE SESSION PURSUANT TO A.R.S. SECTION 38-431-03 (A) (3) AND (1) TO DISCUSS PERSONNEL MATTERS A motion was made by Doug Mostyn, 2nd by Eddie Honea and carried unanimously to go into Executive Session Pursuant to A.R.S. Sec- tion 38-431-03 (A) (3) and (1) to Discuss Personnel Matters. Time 9:20 P.M. Out of Executive Session at 10:55 P.M. XV. FUTURE AGENDA ITEMS 1. Pima County Liquid Waste Pond expansion 2. Providing Public Library with copies of Minutes and other items i.e. Specific Plan. 3. Posting or the proposed Ordinances along with the Agenda and stamped with "DRAFT" XVI. ADJOUR/NMENT 11:20 P.M.
